HomeMy WebLinkAbout10-16-95 PC MinutesREGULAR MEETING AND JOINT PUBLIC HEARING PLANNING COMMISSION AND CITY COUNCIL October 16, 1995 City Council Chambers A Regular Meeting and Joint Public Hearing of the Planning Commission and City Council was held on October 16, 1995 with the following members present: Chairman Elmer Embs Commissioner Sally Bundy Commissioner Rob Clark Commissioner Laurie Leister Commissioner Bessie Chisum Commissioner Cleveland Nisby Commissioner Bill Lucas Commissioners absent: Vice -Chairman Marva Provo Commissioner Bill Kimbrough Councilmembers present: Mayor Pro-Tem Becky Ames Councilmember-at-Large Andrew Cokinos Councilmember Guy Goodson Councilmember Lulu Smith Councilmembers absent: Mayor David Moore Councilmember Bobbie Patterson Councilmember John Davis Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Bonnie Semien, Planning Technician and Jill Cole, Recording Secretary. Commissioner Clark made a motion to approve the minutes of the September 18, 1995 Regular Meeting and Joint Public Hearing. Motion was seconded by Commissioner Bundy. Motion to approve carried 6:0. Planning Commission oclober 16, 1995 REGULAR MEETING 1) File 1204-ZIP and 1227-P: Consider a request to extend the time limit of a specific use permit by 18 months for an amended specific use permit granted on October 26, 1993. Location: Dowlen at Wellington, south end of tract. Request for 1.07 acres of original 8.67 acres. Applicant: Dowlen Development Company Mr. Richardson told the Planning Commission that the extension request is for what is called Area "A", which consists of 1.06 acres. The site plan approved by City Council on October 26, 1993 allows a single office building of 9,600 square feet. Plans are now being finalized for a professional office building containing approximately 7,735 square feet. 1227-P expires on October 26, 1995. Because the building would not be substantially completed by that date, the property owner is asking for an extension for Area "A" only. The specific use permit will expire on the remaining 7.61 acres. Mr. Richardson recommended approval of the request. (Commissioner Chisum arrived.) Chairman Embs asked for the applicant's comments. Bill Wilson, representing Dowlen Joint Venture, the applicant, addressed the Commission. Chairman Embs asked for comments in favor or in opposition. No comments were made. Commissioner Leister made a motion to approve the extension of the time limit of a specific use permit by 18 months for an amended specific use permit granted on October 26, 1993. Commissioner Bundy seconded the motion. Motion to approve carried 6:0. (Commissioner Clark abstained from voting.) JOINT PUBLIC HEARING Mayor Pro-Tem Ames called the Joint Public Hearing of October 16, 1995 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Embs. He explained the policies and procedures for the hearing process. 2 J Planning Commission oclober 16, 1995 1} File 1284-P: Consider an application for a specific use permit to allow a one - chair barbershop inside a residence in an RCR (Residential Conservation and Revitalization) District. Location: 1511 Wall Street between Avenue B and Avenue C Applicant: Augustine R. Meza Mr. Richardson told the Planning Commission that the applicant wants to close his present barbershop on College Street. He proposes to operate a one -chair shop iri' a front room of his home. The applicant requested a modification of the screening and landscaping requirements. An existing 6' chain link fence and shrubbery is located along the south property line. Along the east and west property lines, the applicant plans to build 8' screening fences, but there is not adequate room to put the 10' landscaping strip. Therefore, the applicant has requested a waiver to the landscaping requirement. Mr. Richardson recommended approval of the specific use permit and the modified landscape plan subject to: 1. The applicant extend his parking area 42' from the front of his lot between the house and the east property line and extend the parking area 30' across the front of the lot from the northeast corner of the property. 2. The construction of an 8' privacy fence along the east and west lot lines. Twenty notices were sent to property owners within 200 feet of the subject property. One response in opposition and none in favor were returned. Chairman Embs opened the public hearing and asked for the applicant's comments. Augustine Meza, the applicant, addressed the Commission. Chairman Embs asked for comments in favor and in opposition. Sneaking in Favor Mrs. Meza Gonzales, the applicant's sister, spoke in support of her brother's request. Chairkan Embs closed the public hearing. 3 A, Planning Commission October 16, 1995 Discussion of the fencing requirement, and only requiring a 6' fence instead of an 8' fence followed. Commissioner Clark made a motion to approve the specific use permit and modified landscaping as requested in File 1284-P, subject to 1) the applicant extending his parking area 42' from the front of his lot between the house and the east property line and extend the parking area 30' across the front of the lot from the northeast corner of tha property; and 2) the construction of a 6' fence instead of an 8' fence that will login 24' back from the front property line and extend to the rear property line and no extra landscaping required. Commissioner Leister seconded the motion. Motion to approve 7:0. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. 4
