Moore Mayor Pro-Tem Becky Ames Councilmember-at-Large Andrew Cokinos Councilmember Guy Goodson Councilmember John Davis Councilmember Bobbie Patterson Councilmembers absent: Councilmember Lulu Smith Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; and Jill Cole, Recording Secretary APPROVAL OF THE MINUTES Commissioner Bundy made a motion to approve the minutes of the January 5, 1998 Joint Public Hearing. Motion was seconded by Commissioner Hallmark. Motion to approve carried 7:0. Planning Commission January 21, 1998 REGULAR MEETING 1) File 1284-P: Request for 12 month extension on a specific use permit granted on October 24, 1995 to allow a one chair barbershop out of his home in an RCR (Residential Conservation and Revitalization) District. Location: 1511 Wall Street Applicant: Augustine Meza Mr. Richardson reminded the Commission that Mr. Meza was granted a specific use permit by Ordinance No. 95-64 to allow him to operate a one -chair barbershop out of his home at 1511 Wall Street in October, 1995. Because of medical reasons, Mr. Meza has been unable to complete the six foot fence around his property which was a condition of the specific use permit. Commissioner Dykeman made a motion to approve the 12 month extension for the specific use permit granted by Ordinance No. 95-64 as requested in File 1284-P. Commissioner Lucas seconded the motion. Motion to approve carried 7:0. JOINT PUBLIC HEARINGS Mayor Moore called the Joint Public Hearings of January 21, 1998 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. i) File 1387-P: Request for a specific use permit in an RM-H (Residential Multiple Family Dwelling -Highest Density) District to allow a coin operated washateria (laundry). (Planning Commission action postponed from December 15, 1997.) Location: North side of St. James Blvd., 100' east of S. 1 lth St. Applicant: Pattie Davis Mr. Richardson told the Commission that the applicant, Pattie Davis wants to build a 1,350 sq. ft. washateria with 36 machines. The business will be open daily from 8 a.m. to 9 p.m. Ms. Davis is requesting a modification to the landscaping/screening requirements. Along the parking area on the east side of the property, only an 8' fence would be built. Along the remainder of the east side and the north side, an 8' fence and 10' landscape strip will be provided. At the request of the applicant, this request was tabled from the December 15, 1997 meeting. There were some concerns about traffic circulation with the original site plan. The applicant met with the Traffic Division and were helped with a design that would improve traffic circulation on the property. 2 Planning Commission January 21, 1998 Seventeen notices were mailed to property owners within 200' of the subject property. Two responses in opposition and two in favor were returned to staff. Chairman Leister opened the public hearing and asked for the applicant's comments. Donald Wise of Donald R. Wise and Associates, addressed the Commission on behalf of Pattie Davis, the applicant, because she was unable to attend the hearing. He discussed the parking scheme and the landscaping. Commissioner Nisby asked about a full-time attendant and about possible noise from radio "boom boxes". Mr. Wise answered questions from the Commission and stated that there would be an attendant present. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Mayor Moore returned to the hearing. Commissioner Lucas made a motion to approve the specific use permit to allow the coin operated washateria on the north side of St. James, 100' east of S. Eleventh and next to 3526 St. James as requested in File 1387-P, with a modification to the landscaping and screening requirements. Along the parking area on the east side of the property, only an 8' fence would be built. Along the rest of the east side and the north side, an 8' fence and 10' landscape strip will be provided. Commissioner Nisby seconded the motion. Motion to approve carried 7:0. 2) File 1389-Z: Request for a zone change from GC -MD (General Commercial - Multiple Family Dwelling) to RS (Residential Single Family Dwelling) District. Location: South side of and adjacent to a 150' wide GSU Co. (Entergy) right-of-way and extending between Old Voth Road and U. S. Highway 69, 96 and 287 (Eastex Freeway). Applicant: Parigi Investments, Inc. for James Parker, Trustee Mr. Richardson told the Commission and Council that the prospective purchasers of this three acre lot, Mr. and Mrs. Garrett Guillory, want to build their home on the subject property. Single family homes are not allowed in a GC -MD district. Land west and north of the subject property is zoned RS. Fifteen notices were mailed to property owners within 200 feet of the subject property. One response -in favor and none in opposition were returned. Chairman Leister opened the public hearing and asked for the applicant's comments. Sam Parigi, 445 N. 14th Street, addressed the Commission. In response to Commissioner Dykeman, Mr. Parigi said that the subject site will be accessed from Old Voth Road. 3 Planning Connnission January 21, 1999 Commissioner Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Bundy made a motion to approve the zone change request to RS for the three acre tract located between Old Voth Road and Eastex Freeway as requested in File 1389-Z. Commissioner Hallmark seconded the motion. Motion to approve carried 7:0. 3) File 1390-P: Request for a specific use permit to allow Broussard's Mortuary to construct a 115' x 30' x 40' metal maintenance and storage building for its hearses on a lot in the Oaks Historic District presently zoned RCR (Residential Conservation and Revitalization) and being on property recently acquired by the business. Location: 2003-2015 North Street Applicant: Broussard's Mortuary by Conarc, Inc., contractor Mr. Richardson told the Commission and Council that the request is to allow the expansion of a funeral home operation in a RCR District. The specific use of the subject property will be a seven bay parking garage for the funeral home hearses. The proposed facility will consist of parking bays, a wash bay and an office for the keeping of vehicle records. Access to the garage will be off of the existing parking lot. On January 12, 1998, the Historic Landmark Commission approved a Certificate of Appropriateness addressing the appearance of the building subject to two conditions: 1) That the north end of the building will be bricked; 2) Recommend that the screening requirements along the west property line be met with greenery instead of a fence. This recommendation came about from discussion on security and the problems a fence might cause by hiding places for illegal activity. Mr. Richardson said that he received a call from David Bradley. Mr. Bradley met with Mrs. Moreau, who lives immediately to the west of the subject property and Jim Broussard, the applicant. They discussed what would be necessary to meet the screening requirements. They have all agreed upon an 8' screening fence that would tie in to the northwest corner of the building and over to the adjacent property line and head south down that property line. They are also requesting a modification to the landscaping requirement on the west side. Typically, a two story building which a portion of this building will be,, requires a 7-112' building setback. The ordinance requires a screening fence and 10' landscape strip, so they are requesting a modification from 10' to 7-112' and using existing landscaping on the west side. Thirteen notices were mailed to property owners within 200 feet of the subject property. No responses in favor or in opposition were returned. 4 Planning Commission January 21, 1998 Chairman Leister opened the public hearing and asked for the applicant's comments. Jim Broussard, the applicant, addressed the Commission. He said he now had 32 employees and there is a need for security of the vehicles. Chairman Leister asked for comments in favor or in opposition. Marc McDonald, 2205 North Street, addressed the Commission. Mr. McDonald discussed the setback requirements and the bricking of the building ends. He was in opposition to the Broussard expansion. Rebuttal by Mr. Broussard followed. Mr. Richardson and the Planning Commission discussed screening, fences and use of bricks on the building's facade. Chairman Leister closed the public hearing. Commissioner Dykeman asked Mr. Richardson about certificate's of appropriateness and the timing of Historic Landmark Commission meetings and Planning Commission meetings. Mr. Richardson said meeting dates dictated the timing and that it did not make a difference on the approval process. Commissioner Hallmark again made comments about proposed screening. Commissioner Dykeman made a motion to approve the specific use permit request to allow the construction of a garage for the parking of hearses at a funeral home at 2003/2015 North Street as requested in File 1390-P, with a modification of the landscaping requirements by approving an 8 foot fence and the existing landscaping within the proposed 7-112 foot landscape strip along the west property line. Commissioner Nisby seconded the motion. Motion to approve carried 7:0. 4) File 1391-P: Request for a specific use permit to allow an electrical utilities contractor to open an office for administration and operations in a GC -MD (General Commercial -Multiple Family Dwelling) District. Location: 1225 Lindbergh Applicant: Red Simpson, Inc. Mr. Richardson told the Commission and Council that Red Simpson, Inc. wants to build a 4,982 sq. ft. office and garage building, a 2,400 sq. ft. storage building and related parking and outdoor storage. He said that access would only be from Lindbergh and not from the unimproved Goldsborough. 5 Planning Commission Jamary 21, 1998 Red Simpson, Inc. installs power lines and fiber optic cable for utility companies such as Entergy. The Beaumont branch office will employ 103 people. Access to the subject property will be off of Lindbergh. There will be no access off of Goldsborough. Twenty-seven notices were mailed to property owners within 200 feet of the subject property. One response in favor and none in opposition were returned to staff. Chairman Leister opened the public hearing and asked for the applicants comments. Gary Korry, addressed the Commission on behalf of Red Simpson, Inc. He said Red Simpson has 100 employees but only about 12 will work on site. He said that the company has rented space on Lindbergh for 2-1/2 years and had received no complaints. He commented that the company had no prior intention to use Goldsborough. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Bundy made a motion to approve the specific use permit to allow the construction of an office for an electrical power line contractor in a GC -MD District at 1255 Lindbergh as requested in File 1391-P.
