Moore Mayor Pro -Tern Becky Ames Councilmember-at-Large Andrew Cokinos Councilmember Guy Goodson Councilmember Lulu Smith Councilmembers absent: Councilmember John Davis Councilmember Bobbie Patterson Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Lane Nichols, City Attorney; Jim Cline, Traffic Engineer and Jill Cole, Recording Secretary APPROVAL OF THE MINUTES Commissioner Bundy made a motion to approve the minutes of the January 21, 1998 Regular Meeting and Joint Public Hearings. Motion was seconded by Commissioner Hallmark. Motion to approve carried 6:0. Planning Commission February 16. 1998 JOINT PUBLIC HEARINGS Mayor Moore called the Joint Public Hearings of February 16, 1998 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. 1) ✓lFile 1392-P: Request for a specific use permit to allow the use of existing structures in an RS (Residential Single Family Dwelling) District for church related activities. Location: 8235 Broussard Road Applicant: Voth Baptist Church, Don L. Plott, Pastor Mr. Richardson told the Commission that the applicant, Voth Baptist Church, is currently located at 8205 Broussard Road. The church wishes to expand into an existing vacant commercial building and house located next door to the existing church. The church is requesting a modification to the landscaping/screening requirements on the west side of the property. Along that property line is an existing chain link fence and trees and shrubs. The adjacent property owner does not want any additional screening on that property line. Mr. Richardson said if the request is approved as submitted, a modification to the screening/landscaping requirement will need to be granted. Seventeen notices were mailed to property owners within 200' of the subject property. Four responses in favor and none in opposition were returned to staff. Chairman Leister opened the public hearing and asked for the applicant's comments. Don Plott, Pastor of Voth Baptist Church, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Bundy made a motion to approve the specific use permit to allow the use of existing structures for church related activities in an RS District at 8235 Broussard Road as requested in File 1392-P, with a modification to the landscaping and screening requirements by allowing a 5' chainlink fence and trees to remain along the west property line. Commissioner LaBiche seconded the motion. Motion to approve carried 6:0. 2) File 1393-P: Request for a specific use permit to allow a general contractor to operate in a GC -MD (General Commercial -Multiple Family Dwelling) District. Location: 1310 Lindbergh Applicant: Treyco Contractors, Inc. by W. H. Koch, Jr. 2 Planning Commission February 16, 1998 Mr. Richardson told the Commission and Council that the subject property is located down the street from an electrical contracting business that was approved by the Commission and Council last month. The neighborhood along Lindbergh contains many similar businesses. The Transportation Division recommended that a handicap parking space be provided for the business. Mr. Richardson told the Commission if they approve the request, it needs to be conditioned upon one handicap parking space being provided. Fourteen notices were mailed to property owners within 200 feet of the subject property. No responses in favor.or in opposition were returned. Chairman Leister opened the public hearing and asked for the applicant's comments. William Koch, 385 Pinchback, the applicant, addressed the Commission. In response to Commissioner Lucas, Mr. Koch said that there would not be any fabrication at the subject location. Commissioner Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner LaBiche made a motion to approve the specific use permit to allow a general contractors business in a GC -MD District at 1310 Lindbergh Drive as requested in File 1393-P, subject to one handicap parking space being provided. Commissioner Bundy seconded the motion. Motion to approve carried 6:0. 3) File 1394-Z: Request for a zone change from RS (Residential Single Family Dwelling) to RM-M (Residential Multiple Family Dwelling -Medium Density) District. Location: Property fronts on Concord Road and lies west of a DD#6 ditch, which is west of Comstock Road. Applicant: Mark Musemeche (Chairman Leister recused herself from File 1394-Z and turned the meeting over to Commissioner LaBiche.) Mr. Richardson told the Commission and Council that the request is for a 12 acre tract fronting on Concord Road. The developer is planning a mixed residential development on this total 58 acres of land. He is requesting a zone change on 12 acres to allow him to build town homes at a density of 10-12 units per acre. The concept plan for this entire tract calls for this 12 acres of townhouse developments on the east/southeast party of the property and the 12 acres would be KI Planning Commission February 16, 1998 surrounded by single family residential on the west and north. Thirty-six notices were mailed to property owners within 200 feet of the subject property. Two responses in opposition and none in favor were returned. Commissioner LaBiche, acting as chairman, asked dim Cline, Traffic Engineer to come forward to answer questions from the Commission. Mr. Cline presented and reviewed the trip generation statistics for the project. Discussion between the Commissi6n and Mr. Cline regarding traffic followed. Commissioner LaBiche opened the public hearing and asked for the applicant's comments. Mark Musemeche, 2727 Allen Parkway, Houston, the applicant, addressed the Commission. Mr. Musemeche said the town homes would be from 800 sq. ft. for a one bedroom unit, 1000 sq. ft. for a two bedroom and 1400 sq. ft. for a three bedroom unit. 100-120 town homes are proposed. Responding to a question, he stated that the town homes would sell for $60,000 to $80,000 each. Commissioner Lucas asked what reasons were given on the two responses in opposition. Mr. Richardson replied that one had concerns over traffic and the other didn't state a reason. Commissioner LaBiche asked for comments in favor or in opposition. Speaking in Opposition Billy Bankston, 5515 Comstock Road, addressed the Commission. Mr. Bankston voiced his concerns regarding the dangerous curves along Concord Road. He also said that some area sewers back up when it rains and that area access is limited and congested during peak travel times currently and would only get worse. Judy Lord, 5910 Comstock Road, addressed the Commission. Ms. Lord said that there was already too much traffic in that area. Beverly Bankston, 5515 Comstock Road, spoke to the Commission in opposition to the request. Mike Hodge, 6130 Concord Road, spoke in opposition because he feels that there is already too much traffic on Concord Road. Commissioner LaBiche closed the public hearing. 4 Planning Commission rebruary 16, 1998 Discussion followed between the Commission, Mr. Richardson and Mr. Cline regarding traffic issues. Rebuttal by Mr. Musemeche and further discussion with the Commission followed. Commissioner Chisum made a motion to approve the zone change to RM-M for the 12 acre tract fronting on Concord as requested in File 1394-Z. Commissioner Lucas seconded the motion. Motion to approve carried 5:0:1 (Chairman Leister abstained.) 4) File 1395-Z: Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to GC -MD (General Commercial -Multiple Family Dwelling) District or a more restrictive district. Location: 4210 Folsom at West Lucas Drive Applicant: Lana Thompson, Independent Executrix for the Estate of Vincent J. Bruno, Sr. Mr. Richardson told the Commission and Council that the applicant wants to sell the subject property for commercial development. This property and two others north of and fronting on Lucas are zoned RM-H. The two properties immediately to the north are developed as single family residential. Property along Eastex Freeway and east of the subject tract are zoned GC -MD. Southeast of the subject property is zoned NSC (Neighborhood Shopping Center) and to the south and west is RS (Residential Single Family Dwelling) District. Seventeen notices were mailed to property owners within 200 feet of the subject property. Two responses in favor and four in opposition were returned to staff. Chairman Leister opened the public hearing and asked for the applicants comments. Lana Thompson, the applicant, addressed the Commission. Mrs. Thompson said she talked to the neighbors on either side of the subject property and that they have no objections to the zone change. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Discussion on possibly requesting one of the new zoning districts followed between Council, Planning Commission and staff. Commissioner Bundy asked for the location of property owners who responded in favor and in opposition. Mr. Richardson replied that Munro's Cleaners, located across the street from the subject property, responded in favor. The responses in opposition came from residential property owners on Folsom and W. Lucas. 5 Plawling Commission February 16, 1998 Rebuttal by Lana Thompson. Commissioner Lucas made a motion to approve the zone change request to GC -MD as requested in File 1395-Z. Motion failed for lack of a second. Commissioner Hallmark made a motion to deny the zone change request to GC -MD for the property at 4210 Folsom as requested in File 1395-Z. Commissioner Bundy seconded the motion. Commissioner Hallmark recommended that staff get with the applicant and make them fully aware of all their options outside of the RM-H district, specifically GC- MD-2. Chairman Leister expressed concern that only two or three neighbors on the north side of Folsom lie within 200' of the subject property and were thereby notified of the zone change request. Motion to deny carried 5:1 (Commissioner Lucas). S) File 1396-P: Request for a specific use permit to allow the construction of two accessory residential structures containing quarters for servants and family members. Location: 1080 Thomas Road Applicant: Rodney and Tenna Anderson Mr. Richardson told the Commission that the applicant's house plans include two living quarters abo%a the detached five -car garage and quarters within the proposed pool house. If the application is approved, Mr. Richardson suggested that the approval be conditioned upon the guest/caretaker quarters not being used as rental property now or in the future. Eighteen notices were sent to property owners within 200' of the subject property. No responses in favor or in opposition were returned to staff. Chairman Leister opened the public hearing and asked for the applicant's comments. Dr. Rodney Anderson, the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Ce Plaimiug Commission rebivary 16, 1998 Commissioner Bundy made a motion to approve the specific use permit to allow two accessory residential structures in an RS District at 1080 Thomas Road as requested in File 1396-P with the condition that the guest/caretaker quarters not be used as rental property now or in the future. Commissioner LaBiche seconded the motion. Motion to approve carried 5:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. 7
