Richardson, Planning Director SUBJECT: Consider a request to abandon the alley right- of -way in Block 41, Calder Addition. FILE: 573-OB STAFF REPORT Patrick Phelan as Trustee for the abutting owners has requested that the 20' x. 150' alley be abandoned to facilitate a planned new building for a tenant. The building will encroach into the alley. Information regarding the request was sent to all interested parties. There have been no objections to the proposal. Building plans have already been submitted for departmental review. The only utility found in the alley is a 6" diameter sanitary sewer., The Water Utilities Director of the City, S. A. Webb, has stated that the City will abandon the sewer to the property owner and that the owner will assume all maintenance of the line. The Phelans have agreed to this stipulation. No utility easement will need to be retained. Another new building for another tenant is already under construction on the block but is not affected by this requested abandonment. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES The 20 ft. by 150 ft. alley right-of-way lying south of and abutting Lots 2, 3 and 4, Block 41, Calder Addition and lying north of and abutting Lots 9, 10 and 11, said Block 41, Calder Addition, said 20'x 150' alley containing 3,000 sq. ft. or 0.068 acres of land, more or less, said alley being situated in Beaumont, Jefferson County, Texas, PUBLIC NOTIFICATION Notices mailed to property owners N/A* .
