FILE: 1404-Z STAFF REPORT Charles Etta Woodside wishes to build a single family residence at 1036 Oakland on a tract cut out of three lots, said tract measuring 46.6' x 150'. This property lies about halfway between Ashley and Long. The commercial zoning is original to 1955. This is a mixed use neighborhood consisting of homes, vacant lots, businesses and a church. The north one-half of Block 21 - save and except that taken for M. L. K. Parkway right -of -,way - is occupied by Shanes ABC Termite Pest Control and Stearnatic Service. This is located on Ashley between M. L. K. and Oakland. The church is located on property lying at the southeast comer of Ashley and Ewing in Block 19, Jirou Addition. The applicant's nearest neighbors to the north, south, east and west are residences. This request is to downzone from commercial to residential. The 1981 Zoning Ordinance prohibits the construction of any new single family homes in the GC -MD district. The Comprehensive Plan shows this as an area of Conservation and Revitalization. This change, if granted, could be construed as spot zoning. This would be the first residential construction in this area in many years. I would likL- it if they could Zone it back to Community Property. The reason for this is that I was all set and ready to to build on 1039i% oakland and after that point and time I Found out that I could not rebuild on the property becaues they want to malce it out of Commercial. I have already hired a contractor to build my home, and I have already had my Utility Poles installed, and all of the trees has been removed from the property. I visited the Neighborhood recently and had a Patician signed by the neighbors, they all felt that they were not going no where no time soon, as some of the neighbors were not home at the time of my visit so I could not get their signatures at that point and time. I would very much appreciate it if you all could let me start re -building on my property, because it would be a very long time before the neighbors tear down.
