Moore Mayor Pro -Tern Bobbie Patterson Councilmember John Davis Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Stanley Hatcher, Planning Technician and Jill Cole, Recording Secretary APPROVAL OF THE MINUTES Commissioner Bundy made a motion to approve the minutes of the April 20, 1998 Joint Public Hearings. Commissioner Nisby seconded the motion. Motion to approve carried 5:0. Plamiing Commission May ta, 1998 JOINT PUBLIC HEARINGS Councilmember-at-Large Ames called the Joint Public Hearings of May 18, 1998 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. 1) File 1408-Z: Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to GC -MD (General Commercial -Multiple Family Dwelling) District or a more restrictive commercial district for six lots fronting the south side of Washington Boulevard. La ation: 2700 block of Washington, lying between St. Hwy. 124 and Goliad Street. Applicant: Sam C. Parigi, Jr., agent for the owners Mr. Richardson told the Commission that the property owners of the six lots have requested this change. Lot 1 is occupied by two frame rent houses that front on Goliad. Lots 24 are currently vacant. A check cashing business is proposed for those lots. Lots 5 and 6 are occupied by Patillo's Barbeque Restaurant. The zoning to the north, east and west is GC -MD. To the south is RM-H. Twenty-eight notices were mailed to property owners within 200 feet of the subject property. One response in favor and one in opposition were returned to staff. Chairman Leister opened the public hearing and asked for the applicant's comments. Sam Parigi, Jr., the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Bundy made a motion to approve the zone change from RM-H to GC -MD For Lots 1-6, Block 6, Booker Heights Subdivision as requested in. He 1408-Z. Commissioner Chisum seconded the motion. Motion to approve carried 5:0. 2) File 1409-P: Request for a specific use permit to allow a consignment shop (retail, used women's and children's clothing) and an office for a graphics and business forms business in an RCR (Residential Conservation and Revitalization) District. Location: 2251 McFaddin Avenue (existing frame residence) Applicant: Clay Cabeen, Jr. Mr. Richardson told the Commission and Council that the request was to allow a consignment shop for retail sales of used women's and children's clothing and a 2 Plaming Commission May 18, 1998 business for a graphics and business forms business in an existing structure at 2251 McFaddin. The property is zoned RCR. The applicants, Mr. and Mrs. Cabeen wish to open a clothing consignment shop and a graphics and business forms firm in what was once a single family residence. The only external change would be the addition of an owner identification sign. That sign will be subject to the historic district regulations and will require a certificate of appropriateness. Parking would be provided on the existing parking lot to the east. The applicants have- an agreement with the owner of the parking lot to provide the necessary parking. The Traffic Engineer has suggested that the specific use permit be revoked if the parking agreement is every nullified. The applicants are requesting a modification to the landscaping/screening requirements. There is a 6 foot chainlink fence along part of the east property line. A 6 foot tall wood fence is along the south property line. (Vice Chairman Provo arrived.) Fourteen notices were mailed to property owners within 200 feet of the subject property. Four responses in favor and none in opposition were returned. Chairman Leister opened the public hearing and asked for the applicant's comments. The applicants were riot present. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Chisum made a motion to approve the specific use permit to allow a consignment shop and an office for a graphics business at 2251 McFaddin as requested in File 1409-P, with the stipulation that the specific use permit be revoked if the parking lot agreement is ever nullified and with a modification to the landscaping/screening requirements as requested. Commissioner Bundy seconded the motion. Motion to approve carried 6:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED. 3
