SUBJECT: Request for a zone change from GC -MD (General Commercial -Multiple Family
Dwelling) to CM (Commercial -Manufacturing) District and a specific use permit to
allow the mixing of liquid chemicals for wholesale distribution to the industrial trade
from an existing brick warehouse at 1200 Laurel.

STAFF REPORT
The applicant and business owner, Mr. Vinodbhai M. Patel, an engineer, has patented
"Disolvite", a mixture of chemicals which is used in refineries to dissolve sludge in crude oil
tanks. The solvent breaks down paraffin and heavy crude oil sludge into recoverable
hydrocarbons, water and solids. It is used in tanks, marine vessels, pipelines and other
facilities. The product is safe and non -corrosive and has a flashpoint of 140' F or greater.
He will store the solvent in the existing brick warehouse at 112' F or less. There will be no
chemical waste at the storage site, the northwest corner of Laurel and Center. The property
is entirely fenced for security.
Mr. Patel has already signed a one-year lease for 4,300 square feet of the building. He also
has entered into, contracts for electrical work and mechanical equipment and installation. He
has purchased liability and property insurance, been issued a Certificate of Incorporation by
the Texas Secretary of State, is in possession of a Texas sales and use tax permit. He
received an "exemption letter" from the Texas Natural Resource Conservation Commission
(TNRCC) regarding the installation of two 1,500 gallon blending tanks.
The applicant will be in compliance with all the rules and regulations of the TNRCC and of
the U.S. Environmental Protection Agency (EPA). He will also be in compliance with the
City's fire and building codes and state laws.
Mr. Patel's business is classified in the SIC Code as SIC #5169, Wholesale Trade,
Nondurable Goods. Prior to adoption of amendments to the Zoning Ordinance on February
3, 1998, SIC 5169 were permitted in a GC -MD District with a specific use permit. The
Zoning Ordinance was amended to delete SIC 5169 from the GC -NM District due to some
of the uses permitted in that category. Mr. Patel signed his lease agreement with the property
owner on the same day. The use would now require the minimum of a C-M (Commercial -
Manufacturing) District.
Supporting documentation, exhibits and copies of various correspondence, including material
safety data sheets, are included with this request for a specific use permit and a zone change.

If this application is approved, the specific use permit should be approved subject to
Transportation Engineering's requirement to install one handicap parking space and erecting
the necessary signage.

application has surpassed the deadline (June 26, 1998),1 hope you will continue to

PRODUCT!
"Disolvite" is a patented product. It is a mixer of different chemicals (see
the attached MSDS document). This product is moderately flammable (at 140 F).
This will be used in refineries to dissolve sludge in crude oil tanks (see the
attached product brochures).
PROCESS OPERATIONS:
See the attached Process Flo,iv Diagram.
TECHNICAL INFORMATION:
The following technical measures are taken into consideration regarding
safety issues:
(1) All the equipment purchased have been carefully selected for handling
hazardous material.
(2) All electrical installation and material has been approved by the
National Electrical Code.
(3) Adequate positive ventilation system will be installed,
(4) In accordance with MSDS, Petroferm, Inc. will not exceed the
warehouse temperature above 115 F degrees (According to MSDS the
flammability of the product stands at 140 F degrees).
(5) All appropriate fire extinguishers will be placed in proper concordance
with local fire codes.
(6) Production will be based on an "order to order", batch processing basis.
This will therefore require a very minimal storage time (2-4 weeks) of our product.
We expect a maximum of 1-2 orders per month.
(7) There will not any chemical waste. Spilled chemicals will be collected
and reused.

I The brick warehouse building was constructed sometime during the 1920's and named
Magnolia Gas Products. From 1935-,1947, Magnolia Airco Gas Products occupied
the building. In 1967, Acme Transfer and Storage used the building as a warehouse.
The last major tenant, American Welding Supply, lasted from the 1960's through
1990. Except for the owner's storage use, the site has been vacant since 1992.

sludge. Then add your cutter (diesel, kerosene,
light cycle oil, etc.) at the ratio of sludge to solvent
to water as shown below:

sludge. 1N07E. Because sludges &ffer, prepare
several lab samples and test simultaneously

homogenous mixture is formed. Maintain
temperature at 95°F (35°C) for 8 to 12 hours.
Three distinct phases will emerge: (1)
Recoverable hydrocarbons will be on top, (2)
water will be in the middle, and (3) solids will
drop to the bottom. Select the ratios best suited to
your sludge and put it to work for you.

Case History: A 65,000k] tank in Penang -West
Malaysia had been out of service for 18 months
because of an approximate 1,000 metric ton
build-up of waxy -asphaltic (now dry) sludge in
its bottom. Crude was added to the tank to soak
the sludge for 15 days. After 15 days, the deptb
of the sludge remained at two feet. Circulation
was started in the tank. Approximately 4,000kg
of Disolvite was added, After 28 hours, the
circulation was stopped with no discernible
sludge located in the bottom of the tank.
Approximately $120,000 of hydrocarbons was
recovered,
Case History. A 5,000k.1 tank in Baroda, India
contained approximately 500 metric tons of
sludge. Disolvite and cutter stock were added to
the tank and circulated intermittently for
approximately 65 hours over a six day period.
Sludge samples and tests were conducted daily.
At the end of the sixth day, virtually no sludge
could be found in the tank.

This is in response to your exemption registration, Form PI-7, concerning the installation of
two 1,500-gallon blending tanks in Beaumont, Jefferson County. We understand the estimated
routine emissions are 0.002 ton per year (tpy) of orthodichlorobenzene and 0.0003 tpy of
mineral spirits.
After evaluation of the information which you have famished, we have determined that your
installations are exempt from permitting procedures under 30 Texas Administrative Code (TAC)
Sections 106.472 and 106.473 if constructed and operated as described in your registration
request. These exemptions were authorized by the Executive Director of the Texas Natural
Resource Conservation Commission (TNRCC) pursuant to 30 TAC Chapter 106. Copies of the
exemptions in effect at the time of this registration are enclosed. You must operate in
accordance with all requirements of the enclosed exemptions.
You are reminded that regardless of whether a permit is required, these facilities must be in
compliance with all rules and regulations of the TNRCC and of the U.S. Environmental
Protection Agency at all times.
