SUBJECT: Request to abandon the undeveloped Matthews Drive between Phelan Boulevard and
Calder Avenue.

STAFF REPORT
The 552 foot segment of Matthews requested for abandonment has never been constructed
as a street. It has a 40'wide right-of-way and extends in a north to south alignment.
There are no City utilities inside the right-of-way. This is a wooded area of west Beaumont
lying between Shakespeare on the west and Pinchback on the east.
Buckner Retirement Services has purchased a 17.65 acre tract of land abutting the east line
of Matthews, A residential care facility is planned for the site. Mary Fiorenza owns the tract
abutting the west side of the street right-of-way. She has also signed the petition for
abandoning the street.
Staff sent information to all interested parties regarding this application. No objections have
been received. No public easements will need to be retained.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
BEGINNING at the intersection of the north line of Calder Avenue with the east line of
Matthews Street for the southeast corner of the said 0.5068 acre tract;
THENCE North 840 3 01 3 5 " West, along the said north line of Calder Avenue a distance of
40.21 feet to the intersection of the said north line of Calder Road with the west line of
Matthews Street for the southwest corner of the said 0.5068 acre tract-,
THENCE North 000 251 01 " West, along the west line of Matthews Street, a distance of
545.78 feet to the intersection of the said west line of Matthews Street with the south line of
Phelan Boulevard for the northwest corner of the said 0.5058 acre tract;

THENCE along the said south line of Phelan Boulevard with a curve to the left having a
chord bearing of North 78' 10' 34" East, a chord distance of 40.81 feet and a radius of
5 8 13.86 feet, a distance along the curve of 40.71 feet to the intersection of the said south line
of Phelan Boulevard with the said east line of Matthews Street for the northeast corner of the
said 0.5068 acre tract;
THENCE South 00' 25' 0 1 " East, along the said east line of Matthews Street, a distance of
557.99 feet to the POINT OF BEGINNING and containing 0.5058 acres of land more or less.

Dear Steve:
The Buckner Retirement Services,, Inc., on behalf of their Calder Wood -Buckner Retirement
Community requests that the 40 foot wide Matthews Drive right of way be abandon.
Matthews Drive is unimproved and the abandonment would be consistent with the previous
closures of Pinchback Road (May 16, 1960) and Levert Street (May 16, 1978). The properties
adjacent to the subject right of way lend their RM-H zoning to developments like the planned
Buckner Retirement Community Village. The additional property that would be mutually shared
would enhance development.
It is our request that this matter be scheduled for the joint public hearing of July 20, 1998.
If you or your staff have any questions regarding this application, please advise.
