SUBJECT: Consider a request from the abutting property owner to abandon the undeveloped
Beverly Avenue right-of-way between Trinidad and Parry.

STAFF REPORT
The applicant, Audrey M. Wilson, lives at 1399 Trinidad. Her lot extends south for 138 feet
abutting the east right-of-way line of the undeveloped Beverly Avenue. She owns Lot 1,
Block 1, Woodcrest Addition, Lots I and 2 front on Trinidad. The remaining 13 lots in
Block I of Woodcrest east of Beverly face on Wooderest Drive, a cul-de-sac extending south
from Trinidad.
On the west, Block 3 of the Eastwood addition contains 10 lots. Five of the 10 lots face onto
the west side of the subject undeveloped right-of-way. Lots 9 and 10 are developed with a
single family residence which faces Trinidad. Lot 8 and part of Lot 7 are owned by the same
person who owns parts of two lots developed with a house facing onto Berkley Avenue. The
remaining 1 V2 lots at Parry and Beverly are vacant and abut and access Parry.
Since Beverly was never paved between Trinidad and Parry either during or after
development in the abutting Wooderest and Eastwood Additions, property owners purchased
and developed residential structures facing the paved Trinidad, Berkley and Parry Streets.
Mrs. Wilson wishes to fence her portion of the street right-of-way if the abandonment is
granted. The city ditch along the west half of the right-of-way is the only utility or city
service found in the right-of-way.
All adjacent property owners have agreed to the abandonment. There were no objections to
this request to abandon the street.
If the City Council should so decide to abandon the Beverly Avenue 55' wide undeveloped
right-of-way, a utility and drainage easement 55'x 274.5'should be retained between Trinidad
and Parry for the existing ditch and future utilities if needed, in lieu of the street.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being a 55'x 274.5' segment of undeveloped and unopened Beverly Avenue street right-of-
way, said right-of-way lying and extending between the south right-of-way line of Trinidad
Street and the north right-of-way line of Parry Street at its intersection with the west right-of-
way line of the aforesaid 55'wide Beverly Avenue, containing 0.35 acres of land, more or
less.
