Moore Mayor Pro-Tem Bobbie Patterson Councilmember-at-Large Andrew Cokinos Councilmember Lulu Smith Councilmembers absent: Councilmember-at-Large Becky Ames Councilmember John Davis Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Nancy Nicholas, Recording Secretary and Adina Abshire, Planning Technician. APPROVAL OF THE MINUTES Commissioner Bundy made a motion to approve the minutes of the September 21, 1998 Regular Meeting, Commissioner Dykeman seconded the motion. Motion to approve carried 7:0. JOINT PUBLIC HEARING Mayor Moore called the Joint Public Hearing of November 16, 1998 to order and explained the purpose of the joint public hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. Planning Commisson November 16, 1998 1) File 1428-Z/P:Request for a zone change from RS (Residential Single Family Dwelling) District to RCR(Residential Conservation and Revitalization) District and a specific use permit to allow a mortgage brokerage firm. Location: 1282 Central Drive Applicant: Lawrence D. Bland, III Chairman Leister stated that Item No. 1 had been removed from the agenda. 2) File 1429-Z: Request for a zone change from RS (Residential Single Family Dwelling) District to GC -MD (General Commercial -Multiple Family Dwelling) District. (This is for a new south end post office.) Location: 3500 Chaison Avenue (Old Giles School site) Applicant: City of Beaumont Planning Division Mr. Richardson told the Commission and Council that this item was a request for a zone change from RS to GC -MD for the purpose of a new postal facility to be built in the south end of the city. The U.S, Postal Service intends to replace its existing facility in the Stadium Shopping Center with a new facility located at the old Giles School site. The Postal Service has agreed to buy the property. Fifty-two notices were mailed to property owners within 200 feet of the subject property. Two responses were received in favor and two responses in opposition were returned to staff. Chairman Leister asked if the applicant was in the audience. Mr. Richardson stated that the City of Beaumont was the applicant for the zone change. Chairman Leister then asked if there were any questions for Mr. Richardson. Commissioner Bodwin wanted to know the reasons for opposition. Mr. Richardson stated that there was concern for small children in the neighborhood and some concern for a possible housing project coming in. Mr. Richardson assured all concerned that the land would be used only for the post office. Chairman Leister opened the public hearing and asked if there was anyone to speak in favor of or in opposition. Ms. Cynthia Barbree, 1375 Church Street, spoke in opposition and stated that she did not want to see any type of multiple family dwelling. Commissioner Hallmark asked Ms. Barbree if it was just a post office being built, would she have any objection and Ms. Barbree said no. Councihnember Bobbie Patterson arrived at 4:00 p.m. Mrs. Marie Lamb, 1391 Church Street, stated she hoped a library would be built on the 1 property. She also expressed concern about big trucks coming in to deliver the mail during nighttime hours. Punning Commisson November 16, 1998 Mr. Stephen Ellis, 1355 Church Street, stated that he did not like the idea of anything coming in because of the increased traffic and noise. Chairman Leister closed the public hearing. Discussion followed between Commission and the City Council. Mayor Moore explained that the site was chosen by the Postal Service for a post office. This site was chosen so the south end of town would have a postal facility. There is no public housing involved in this request. Commissioner Hallmark questioned the fact that there was no site plan. Mr. Richardson stated that a site plan will be needed only if a specific use permit is involved. Commissioner Dykeman made a motion to approve the request subject to the zone request being changed to GC-MD-2 rather than GC -MD as requested. Commissioner Robinson seconded and the motion was approved 7:0. 3) File 1430-Z: Request for a zone change from RS (Residential Single Family Dwelling) and AR (Agricultural -Residential) to GC -MD (General Commercial -Multiple Family Dwelling) and RS and AR to RM-H(Residential Multiple Family Dwelling -Highest Density) Districts for two tracts of land containing 67 acres, more or less. Location: North of Folsom Drive as extended west of Dowlen Road and west of Dowlen Road, the abandoned Dowlen Road and Old Dowlen Road. Applicant: Lan Phelan Mr. Richardson stated that the Phelan Investment Company has a contract to buy 67.6 acres of land from Amoco. This property sits north of the proposed extension of Folsom and west of Dowlen Road. The proposed use of the property will be a neighborhood shopping center and multi -family development. Nine notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned to staff. Mr. Richardson stated the applicant was in the audience. Chairman Leister asked for the applicant's comments. Commissioner Lucas asked the applicant what the plans are with respect to access to Old Dowlen Road, Mr. Phelan replied that it was not in the immediate plans and that they would be developing a shopping center on the corner of Folsom and Dowlen. The applicant also stated that the multiple family development will be closer to the north (Old Dowlen Road). Chairman Leister opened the public hearing and asked if anyone wished to speak in favor of or in opposition. f 1 Mr. Reagan Vickers , Texaco Credit Union, was concerned with the traffic congestion in the area. Chairman Leister closed the public hearing and asked for a rebuttal. Planning Con=uon November 16. 1998 I J Mr. Phelan stated that the multiple family dwelling will be north of the credit union. Commissioner Bundy made the motion to approve the request as stated. Commissioner Hallmark seconded and motion carried 7:0. 4) File 1431-Z: Request for a zone change from HI (Heavy Industrial) to GC -MD (General Commercial -Multiple Family Dwelling) District for 5.75 acre tract. Location: 3380 Fannin Street (former BPM Club, Inc.) Applicant: Dicitie, Inc. by Roy Etie Mr. Richardson presented the staff report. The applicant wishes to convert the former private BPM Club into a residential care facility for girls. This use is not permitted in the HI district. Fifteen notices were mailed to property owners within 200 feet. One response in favor and none in opposition were received by staff. Mr. Richardson stated the applicant is in the audience. Mr. Roy Etie, 1170 Montrose, applicant, stated that the facility will be donated to Girl's Haven. Commissioner Lucas inquired about the use of the property. Chairman Leister opened the public hearing. Joe Peelan spoke in favor of the request. He stated that the facility will be renovated to house at least 30 girls and three sets of house parents. He stated that the remodeling will be done through Dicitie, Inc., and then presented to Girl's Haven as a finished product. Mayor Moore spoke in favor of the request. Chairman Leister closed the public hearing. Discussion followed as to the current zoning of the surrounding property. Commissioner Bundy made a motion to approve File#1431-Z request as written. Commissioner Robinson seconded the motion. The motion was approved and carried 7:0. THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED
