REGULAR MEETING AND JOINT PUBLIC HEARINGS PLANNING COMMISSION AND CITY COUNCIL February 15, 1999 City Council Chambers A Regular Meeting and Joint Public Hearings of the Planning Commission and City Council were held on February 15, 1999 with the following members present: Commission members present: Chairman Laurie Leister Commissioner Sally Bundy Commissioner Dale Hallmark Commissioner Dohn LaBiche Commissioner Glenn Bodwin Commissioner Albert Robinson Commissioner Carlos Hernandez Commission members absent: Vice -Chairman Greg Dykeman Commissioner Bill Lucas Councilmembers present: Mayor David W. APPROVAL OF THE MINUTES Commissioner LaBiche made a motion to approve the minutes of the February 1, 1999 Regular Meeting. Commissioner Bundy seconded the motion. Motion to approve carried 7:0. Planning Commission February 15, 1999 REGULAR MEETING 1) File 584-OB: Request to abandon the 20' wide platted alley located in Block 5, Pear Orchard Addition and Block 60, Jef Chaison Addition. Applicant: City of Beaumont Planning Division Mr. Richardson told the Commission that the abandonment request was for a 20' x 662' wide alley right-of-way extending across a vacant block of land between Avenue A and Chaison. This is -the site of the proposed south end branch of the new post office and is the old Giles School site. No objections to the abandonment have been received by the Planning Division. No utility easement is required. A slide of the subject property was shown. Commissioner Hallmark made a motion to approve the abandonment of the 20' wide alley located in Block 5, Pear Orchard Addition and Block 60, Jef Chaison Addition as requested in File 584-013. Commissioner LaBiche seconded the motion. Motion to approve carried 7:0. 2) Preliminary Plat - Windsor Gardens, Section Three: Consider the Preliminary Plat of Windsor Gardens, Section Three, 13 lots, 4.295 acres, H. Williams Survey, Ab-56, Beaumont, Texas. Applicant: Carroll and Blackman, Inc. for B.A.G. Enterprises, Inc. Mr. Richardson told the Commission that this proposed 4.295 acre residential subdivision contains 13 single family lots. The property lies west of Sections One and Two of Windsor Gardens. In those two sections, streets are private and will be built to city standards. This plat was reviewed by all interested parties and no objections have been received by the Planning Division. The applicant is requesting a waiver of the temporary cul-de-sac requirement at the end of Windsor Parkway. Property immediately to the west is reserved for future residential development. Chairman Leister asked for the applicant's comments. Joe Pattie of Carroll and Blackman, Inc., the applicant, addressed the Commission. Mr. Pattie said that the developers have expressed an interest in developing the property to the west to a point where Shakespeare could be extended north of Gladys. For now, however, the street will dead end at the west ►a Planning Commission February 15, 1999 line. This will be the last unit of Windsor Gardens until such time that additional property is acquired. While there isn't a cul-de-sac, there is an alleyway about 180' from the intersection where cars can turn around. Commissioner Robinson made a motion to approve the Preliminary Plat of Windsor Gardens, Section Three as requested. Commissioner Bundy seconded the motion. Motion to approve carried 7:0. JOINT PUBLIC HEARINGS Mayor Moore called the Joint Public Hearings of February 15, 1999 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister, She explained the policies and procedures for the hearing process. 1) 1311�!-Z: Request for a zone change from RS (Residential Single Family Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) District or a more restrictive district. Location: 5200 block of Allen Drive Applicant: Michael Wirfs Mr. Richardson told the Commission and Council that the zone change request was for a vacant lot in the 5200 block of Allen Drive. The applicant owns and operates a self-service car wash immediately adjacent to this property at 5195 Concord. He wishes to purchase the subject property for expansion of his car wash. Fifteen notices were mailed to property owners within 200 feet of the subject property. One response in favor and none in opposition were returned to staff. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Michael Wirfs, the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Bundy made a motion to approve the zone change from RS to GC - MD for the property in the 5200 block of Allen Drive as requested in File 1437-Z. Commissioner Robinson seconded the motion. Motion to approve carried 7:0. 3 Planning Commission February 15, 1999 2) File 1438-Z: Request for a zone change from GC -MD (General Commercial - Multiple Family Dwelling) to RS (Residential Single Family Dwelling) District. Location: 5200 block of LaBelle Road Applicant: J. Douglas Blevins Mr. Richardson said that the subject property contains 2.74 acres. The owners of Lots 2-5, Block 1 of the Korry Acres Addition are requesting this rezoning. The subject property is developed with single family homes or vacant. The owner of Lot 3 wishes to sell that lot to an individual who wishes to build a single family home on the property. Single family is not permitted in GC -MD. Fourteen notices were mailed to property owners within 200 feet. Three responses in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Juett Douglas Blevins, the applicant and owner of Lot 3, addressed the Commission. Mr. Blevins said he has a potential buyer who wants to build a home on the property. Chairman Leister asked for comments in favor or in opposition. Glenn Wise, 3255 Charles Street, addressed the Commission in favor of the zone change. Mr. Wise is the potential buyer of a portion of the subject property. Chairman Leister closed the public hearing. Commissioner LaBiche made a motion to approve the request for a zone change to GC -MD to RS for the property in the 5200 block of LaBelle Road as requested in File 1438-Z. Commissioner Hernandez seconded the motion. Motion to approve carried 7:0. 3) File 1439-P: Request for a specific use permit to allow the construction of an accessory structure, being a garage apartment, in the rear yard of a home in an RS (Residential Single Family Dwelling) District. Location: 1135 Central Drive Applicant: Dale and Paula Beaty Mr. Richardson said that the request for a specific use permit is to allow the construction of a garage apartment in the rear yard of a home in an RS District. ►,i Planning Commission February 15, 1999 The applicants wish to build a two -bedroom garage apartment in the backyard. The property itself measures 200' x 223'. The Zoning Ordinance allows garage apartments in an RS District if used by members of the family who are the main occupants of the principal dwelling. There are other garage apartments and guest quarters in the immediate area. Twenty-one notices were mailed to property owners within 200 feet. Four responses in favor and one in opposition were returned to staff. Slides of the subject property were shown. Discussion between the Commission, City Council and staff followed. Chairman Leister opened the public hearing and asked for the applicant's comments. Dale Beaty, the applicant, addressed the Commission. He assured the Commission and Council that the proposed structure would be used for guests and friends visiting them and not as rental property. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Bundy made a motion to approve the specific use permit to allow a garage apartment at the rear of the home at 1135 Central Drive as requested in File 1439-P, with the condition that the structure not be used as rental property. Commissioner Bodwin seconded the motion. Motion to approve carried 7:0. 4) File 583-OB: Request for the adoption of The Avenues/College Street Area Neighborhood Plan. Applicant: City of Beaumont Planning Division Mr. Richaidson told the Commission and Council that The Avenues/College Street Plan encompasses the area generally bound by M.L.K. to the east, Fourth Street to the west, Fannin to the north and Franklin to the south. The Planning Division worked with The Avenues Neighborhood Association in developing this plan. In November, 1998, The Avenues Neighborhood Association endorsed the plan. Bart Baker, Planner, reviewed the highlights of the Neighborhood Plan. Chairman Leister opened the public hearing and asked for comments in favor or in opposition. 5 t Planning Commission February 15, 1999 Roberto Flores, 2425 Buchanan, addressed the Commission and Council in favor of the Plan, Mr. Flores serves on the Board of Directors for The Avenues Neighborhood Association. Chairman Leister closed the public hearing. Commissioner Hallmark made a motion to approve the adoption of The Avenues/College Street Area Neighborhood Plan as requested in File 583-OB, Commissioner Robinson seconded the motion. Motion to approve carried 7:0. 5) File 585-OB: Request for the adoption of the West Oakland/Pear Orchard Neighborhood Plan. Applicant: City of Beaumont Planning Division Mr. Richardson told the Commission and Council that the West Oakland/Pear Orchard Neighborhood Plan encompasses the area generally bounded by Washington to the north, Cardinal Drive to the south, Avenue A and the Southern Pacific Railroad to the east and 1-10 to the west. This month, the West Oakland/Pear Orchard Neighborhood Association endorsed the -Plan. Bart Baker, Planner, reviewed the highlights of the Neighborhood Plan. Chairman Leister opened the public hearing and asked for comments in favor or in opposition. Gracie Middleton, 1585 Auburn Drive, spoke in favor of the Neighborhood Plan. Chairman Leister closed the public hearing. Commissioner Bodwin made a motion to approve the adoption of the West Oakland/Pear Orchard Neighborhood Plan as requested in File 585-OB. Commissioner Robinson seconded the motion. Motion to approve carried 7:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED AT 4:40 P. M. R
