STAFF REPORT
RM Quality Construction, LLC has requested a Certificate of Demolition to demolish the existing
structure located at 2653 Liberty Ave. The existing structure received substantial damage from
the past hurricane events. Additionally, the applicant requests a Certificate of Appropriateness
for a new construction that will be completed under the Texas General Land Office (GLO)
Harvey Program.
The proposed home will be approximately 1357 sq. ft. in size. The construction methods
employed would dictate that the house is to be constructed with a pier and beam foundation,
horizontal 6 X inch HardiPlank sidling, anid windows will be eight (8) over eight (8) in
appearance. The roof pitch will rise six (6) inches, every twelve (12) inches horizontal distance
and the roof will be 30 year architectural shingles and black in color. The front door will be a six
(6) light paneled door. Lastly, the porch column is to be a tapered craftsman style column. The
exterior body paint is to be SW6164 Svelt Sage, the trim is to be SW7004 Snowbound and the
doors and shutters are to be SW6307 Fine Wine.
Planning staff recommends approval of both requests with the following conditions:
1. Roof overhang shall be 12"
The house is not listed in the SPARE Beaumont Survey.

Quality Construction requests a certificate of appropriateness for a new construction, that will be

The proposed home will be approximately 1357 sq, ft. in size and will contain two (2) bedrooms,
two (2) bathrooms, dining room, kitchen and living room. The construction methods employed
would dictate that the house is to be constructed with a pier and beam foundation (pilings),
horizontal HardiPlank siding, and black 30 year architectural roofing shingles. Windows will have
a one over one appearance. The exterior body paint to be SW6164 Svelte Sage, trim to be
SW7004 Snowbound and the doors and shutters will be SW6307 Fine Wine.

GLO Harvey Homeowner Assistance Program
Determination of Eligibility for Listing in, the National Register of Historic Places and
Determination of Effect to Historic Properties Concurrence Request

Dear Mr. Kockritz:
Applicant SET-0360 is seeking financial assistance through the Texas General Land Office (TX GLO) Homeowner
Assistance Program (Program) for disaster recovery funds to rehabilitate the storm -damaged single-family residence
at 2653 Liberty Avenue to local zoning standards (Project). Because the Program is funded by a Community
Development Block Grant Disaster Recovery Grant from the U.S. Department of Housing and Urban Development
(HUD), the Project is considered a federal undertaking under Section 106 of the National Historic Preservation Act
(Section 106). We are coordinating with you pursuant to Section 106, the Texas Antiquities Code, and the statewide
Programmatic Agreement (PA) between the Texas Historical Commission (THC) and the TX GLO for the Program to
seek your concurrence with our findings.
The area of potential effects (APE) for direct impacts was defined as the building footprint and, due to the scale of the
proposed Project work, the APE for indirect impacts was limited to adjacent properties within the building's viewshed.
Review of prior studies conducted in the project vicinity identified the Oaks Historic District within the APE. The district
is locally designated by the City of Beaumont and was determined eligible for listing in the National Register of Historic
Places (NRHP) under Criterion C by THC review in 2019, However, contributing and noncontributing properties within
the NRHP district boundaries have not yet been formally identified.
TX GLO conducted an inventory and NRHP evaluation to determine if 2653 Liberty Avenue is individually eligible and/or
a contributing resource to the Oaks Historic District using the NRHP criteria for evaluation (36 CFR 60.4) and the
evaluation criteria provided by THC. TX GLO determined that the building is an unremarkable example of its type and
does not possess sufficient architectural significance to be individually eligible under Criterion C. However, the building
does retain enough integrity to qualify as a contributing resource to the Oaks Historic District. Please see the attached
documentation, which includes the address, a copy of the USG S 7.5-minute quadrangle map, and a project description.
In 2020, the estimated cost to rehabilitate the residence at 2653 Liberty Avenue was approximately $204,000, which
then exceeded the Program's $200,000 cap for the rehabilitation of historic resources. With the rising costs of
construction materials over the past year, the estimated cost to rehabilitate the residence has increased from the 2020
estimate, and TX GLO has determined that rehabilitation of the residence at 2653 Liberty Avenue is not feasible within
the Program spending limits, and new residence approximately the same size (no more than 20% larger than the
existing structure's footprint) with associated utilities will be constructed on the property
The TX GLO, which has assumed HUD's environmental review responsibilities in accordance with the PA, has
determined that the Project has the potential to affect the Oaks Historic District. After applying the criteria for adverse
effect as found in 36 CFR 800,5(a)(1), TX GLO has further determined that the demolition of 2653 Liberty Avenue will
have an Adverse Effect on the district because the building has been evaluated as a contributing resource.
We request the concurrence of your office with the determination of eligibility and the adverse effect determination
pursuant to 36 CFR 800.5(c)(1). As per the Section 106 regulations in 36 CFR 800, please provide written concurrence
