Moore Mayor Pro -Tern Bobbie Patterson Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Adina Abshire, Planning Technician; and Jill Cole, Recording Secretary Commissioner LaBiche made a motion to approve the minutes of the April 19, 1999 Joint Public Hearings. Commissioner Bundy seconded the motion. Motion to approve carried 6:0. Planning Commission May 17, 1999 JOINT PUBLIC BEARINGS Councilmember-at-Large Cokinos called the Joint Public Hearings of May 17, 1999 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. 1} File 1446-Z: Request for a zone change from LI (Light Industrial) to RM-H (Residential Multiple Family Dwelling -Highest Density) District. Location: 5755 and 5775 Erie Street Applicant: Mark Whiteley and Associates, Inc. Mr. Richardson stated that the zone change request is for two lots located on the east side of Erie Street, south of Cardinal Drive. The owners of these properties are trying to sell the properties for single family residential uses. The main type of land use along Erie is single family residential. Mr. Richardson reminded the Commission that this request was deferred at last month's Joint Public Hearing. There was concern expressed by a nearby property owner that there was inadequate sewer capacity along Erie. City staff contacted S. A. Webb, Director of Water Utilities, and he said that sewer capacity was more than adequate for the proposed uses. Fifteen notices were mailed to property owners within 200 feet of the subject property. No responses in favor or in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Larry Sheppard with Mark Whiteley and Associates, Inc., addressed the Commission and Council. Chairman Leister asked for comments in favor or in opposition. Johnnie Wright addressed the Commission in favor of the request on behalf of one of the property owners. Mark Whiteley addressed the Commission in favor of the request. 7 Planning Commission May 17. 1999 Robert Sells, 1618 Roberts, addressed the Commission in favor of the request. Chairman Leister closed the public hearing. Commissioner Bundy made a motion to approve the zone change from LI to RM-H for the property at 5755 and 5775 Erie Street as requested in File 1446-Z. Commissioner Robinson seconded the motion. Motion to approve carried 6:0. 2) File 1453-Z: Request for a zone change from RS (Residential Single Family Dwelling) to RM-M (Residential Multiple Family Dwelling -Medium Density) District for an 11.379 acre tract of land. Location: East of Westbrook High School, south of Evangeline West Addition and west of Major Drive Applicant: Faust Engineering and Surveying, Inc. for the owners Mr. Richardson told the Commission that the applicant, Vic Marino, has plans to build one-story townhornes on a tract of land which abuts the east property line of the Westbrook High School property. The tract is 1185' long north to south and 417' wide east to west. Major Drive lies about 700' east. The developer also has proposed to develop a 500' wide x 700' deep tract of land between the subject tract and Major Drive into a single family subdivision. There are some existing single family homes on large acreage tracts along Major Drive, but most of the land between the highway and the high school is vacant or wooded land. The Evangeline West Subdivision is to the north. The RM-M district allows a maximum density of 18 units per acre. Fourteen notices were mailed to property owners within 200 feet of the subject property. No responses in favor or in opposition were returned to staff. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Richard Faust of Faust Engineering and Surveying, Inc., the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Robinson made a motion to approve the zone change from RS to RM-M for the 11.379 acre tract located east of Westbrook High School as requested in File 1453-Z. Commissioner Bundy seconded the motion. 3 Planning Commission May 17, 1999 Chairman Leister reopened the public hearing to allow a citizen who had arrived late to speak. Clarence Lauritzen, 8695 Lafayette, addressed the Commission. Mr. Lauritzen wanted to know how the proposed development would be accessed and about the surrounding landscaping. Richard Faust responded that the access would be from Major Drive. Vic Marino of Marino Homebuilders addressed the Commission and said that the townhomes would be two and three bedroom, two bath townhomes with square footage between 1,300 and 1,800 square feet and would all be one story. He said he would leave as many existing trees as possible. He was not sure of the price range yet, but in response to Mr. Richardson, they would be priced at market rate. Chairman Leister closed the public hearing and called for a vote on the motion that was made and seconded. Motion to approve the zone change from RS to RM-M for the 11.379 acre tract located east of Westbrook High School as requested in File 1453-Z carried 6.0.
