Moore Mayor Pro-Tem John Davis Councilmember Becky Ames Councilmember Guy Goodson Councilmember-at-Large Andrew Cokinos Councilmember Lulu Smith Councihnembers absent: Councilmember Bobbie Patterson Also present: Stephen Richardson, Planning Director; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Nancy Nicholas, Recording Secretary and Adina Abshire, Planning Technician, APPROVAL OF THE MINUTES Commissioner Bodwin stated that he would like to make a correction to the minutes of the July 19, 1999, Regular Meeting and Joint Public Hearings regarding File # 1457-Z. The correction should read Commissioner Hernandez seconded the motion. The motion to deny carried 4:1 (Commissioner Bodwin). With no further additions or corrections Commissioner Robinson made a motion to approve the minutes as corrected and was seconded by Commissioner Bundy. The motion carried 8:0. Planning Commission August 16, 1999 REGULAR MEETING (Public Hearing) 1) Rfplat - Rosedale Acres: Consider a replat of Lot 1, Block 2 of Rosedale Acres and a variance to the required lot size. Location: San Diego Street Applicant: Faust Engineering Faust Engineering has requested that the 0.371 acre recorded lot located at the northwest comer of Griffing Road and San Diego Street be replatted as Lot I and 1B. Presently, the frontage of Lot 1 faces east on San Diego Street. There was a brick and frame house situated at the front of the lot. The lots, as proposed, would front on Griffmg Road. The original lot is 184.92 feet in length and approximately 85 feet in width. With the replat, Lot IA would contain 8,387.47 square feet and Lot 1B would contain 7,820.65 square feet. While these lots exceed the lot width and lot area requirements, they do not meet the 100 foot lot depth requirement. The Subdivision Ordinance allows the Planning Commission to grant a variance when considering a replat. A variance will need to be granted for the lot depth. Because this was a replat, is zoned RS, and the number of lots increased, a public hearing was necessary. A total of eleven notice were sent to property owners within 200 feet of the subject property. No responses in fervor and one in opposition were returned. The Planning Director recommended approval of the replat and the variance. Chairman Leister opened the public hearing and asked for applicant's comments. Richard Faust, the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Robinson made a motion to approve the replat of Lot 1, Block 2, Rosedale Acres Addition into Lots IA and Lot 1B and the variance. Commissioner Hallmark seconded the motion. Motion to approve carried 8:0. 2) Preliminaa Plat - West Oaks: Consider the preliminary plat for a 3.36 acre townhouse development. Location: 3.36 acres out of the A. Houston Survey Applicant: Richard Faust for Marino Home Builders Mr. Richardson presented the staff report. Marino Homebuilders wishes to construct six 3-unit one story townhouse structures on property east of the West Brook High School and west of Major Drive. The first phase will contain 18 units. Additional phases will add another 48 units. The property will be accessed by a public street off of Major Drive. Planning Commission August 16,1999 The developer's plan is to sell the townhouse units to individual buyers. A home owners association declaration document is being prepared showing provisions for perpetual maintenance of common open space and drives, etc. This plat was sent to all interested parties, Two comments were received: 1) Provide the utility easements as requested by Entergy. 2) Meet the drainage plan requirements of the City Engineer. The Planning Director recommended approval of the plat subject to the two aforementioned conditions, Mr. Richardson asked if there were any questions. Commissioner Lucas asked if the developer was paying for the street. Mr. Richardson stated yes. With no further discussion, Chairman Leister asked for a motion. Commissioner Bundy made a motion to approve the .Preliminary Plat - West Oaks, subject to the two conditions. Commissioner Hernandez seconded the motion. Motion to approve carried 8:0. JOINT PUBLIC HEARINGS Mayor Moore called the Joint Public Hearings of August 16, 1999, to order and explained the purpose of the joint public hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. 1) File 1460-P: Request for a specific use permit in the RCR (Residential Conservation and Revitalization) and Ll (Light Inustrial) districts for an early childhood development center (pre-school). Location: 790 Forsythe at Jefferson Applicant: Father Jeremiah J. McGrath for St. Anthony Cathedral School St. Anthony Cathedral wishes to open a pre-school for youngsters in an existing commercial brick building. The building contains 3,000 square feet. The church plans a 300 square foot addition to the southeast corner of the building. Staff parking will be in existing parking lots and student pickup will be from existing driveways. The Planning Director recommended approval of the specific use permit for the private pre- school at 790 Forsythe. Twelve notices were mailed to property owners within 200 feet of the subject property. One response in favor and none in opposition were returned to staff. Slides of the subject property were shown. Planning Commission August 16, 1999 Mr, Jerry Plaia, Consultant,'stated' that he was available for questions. Chairman Leister opened the public hearing and asked for the applicant's comments. There being none, Chairman Leister closed the public hearing. Discussion between staff concerned flow of traffic and where stop signs were located. Chairman Leister asked for a motion. Commissioner Hallmark made a motion to approve File # 1460-P as requested and Commissioner Bodwin seconded the motion. Motion to approve carried 8:0. 2) File 4 1461-Z: Request for a zone change from RS (Residential Single Family Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) district. Location: Northwest corner of South Major Drive and Walden Road. Applicant: Dr. Ravikumar Kanneganti by HBO Southern Homes Real Estate, Pat LeGrande Mr. Richardson stated that File # l 461-Z had been withdrawn at the request of the applicant. 3) File # 1462-Z: Request for a zone change from RS (Residential Single Family Dwelling to RM-H (Residential Multiple Family Dwelling -Highest Density) or a more restrictive multifamily district. Location: 8325 Walker Road Applicant: Reggie Lloyd, Sr., Pastor, Praise Christian Center This item was a request for a zone change from RS to RM-H or a more restrictive multiple family district for a 19.74 acre tract at 8325 Walker Road. The Praise Christian Center owns three tracts upon which is located a church sanctuary and classroom buildings. The church plans to build six 900 square feet one-story apartment units for senior citizens. The church asked that all 19.74 acres be rezoned. The Planning Director recommended that RM-M zoning be approved instead of RM-H zoning. This would still allow the church to build the six units and protect the neighborhood properties better. Seventeen notices were mailed to property owners within 200 feet. One response in favor and none in opposition were received by the staff. Slides of the subject property were shown. Councilman Cokinos asked Mr. Richardson if the new zoning would be for part of the land or all of it. Mr. Richardson replied that it would include the entire property. Reggie Lloyd, Pastor of the church, addressed the Commission. He presented drawings and explained the church's plans. Planning Commission August 16,1999 Commissioner Bodwin asked what would be the maximum number of units built on the property. Pastor Lloyd replied they would build up to five duplex structures. Further discussion followed between the staff and Pastor Lloyd regarding the difference between RM-M and RM-H zoning and plans for the future. Chairman Leister opened the public hearing and asked for comments in favor of or in opposition..' Mr. Bob Miller, addressed the Commission in favor of the request. Ms. Verna Fontenot, addressed the Commission in favor of the request. Ms. Connie Smith, spoke in opposition to the rezoning. Her main concern was increased traffic and noise levels. She stated that she had notified the police on three different occasions. Pastor Lloyd spoke in rebuttal. He apologized to Ms. Smith for any problems. He also stated that if he had known of her concerns, he would have taken care of them immediately. In addition, he asked Ms. Smith to please let him know of any further concerns. With no further discussion, Chairman Leister closed the public hearing. Commissioner Bundy made a motion to approve File #1462-Z with the stipulation that it be rezoned to RM-M. Commissioner Robinson seconded the motion. The motion carried 8:0. i 4). File -# 1463-P: Request for a specific use permit to allow a package store in a NC (Neighborhood Commercial) district. Location: 3290 Highland Avenue at East Alma (Formerly Terry's Liquor Store) Applicant: Derek Broussard This item was a request for a specific use permit for a package store at 3290 Highland in a NC district. The property is the location of the former Terry's Liquor Store. On the property is a 1200 square foot commercial building and seven parking spaces. The Planning Director recommended approval of this request. Seventeen notices were mailed to property owners within 200 feet. Two responses in opposition and none in favor were returned to the staff. Slides were shown of the subject property. Councilman Cokinos inquired as to the reasons for opposition. Mr. Richardson replied that the property owner was concerned about an increase in crime. Mr. Derek Broussard, applicant, addressed the Commission. Planning Commission August 16,1999 Discussion followed regarding lighting and parking facilities. Chairman Leister opened the public hearing. There being no discussion, the public hearing was closed. Commissioner Hallmark made a motion to approve File 41463-P. Commissioner Hernandez seconded the motion. The motion was approved 8:0.
