Richardson, Planning Manager SUBJECT: Request to rezone a 3.75 acre vacant tract from RS (Residential Single Family Dwelling) to RM-M (Residential Multiple Family Dwelling -Medium Density) District located in the 8800-8900 block of Phelan Boulevard (Calder). FILE: 1473-Z STAFF REPORT The Planning Manager recommends approval of the request to rezone the tract from RS (Residential Single Family Dwelling) to RM-M (Residential Multiple Family Dwelling - Medium Density) District. This property consists of 1-1/2 lots in the Beaumont Orange & Fig Company Subdivision. The 3.75 acres lie across the street from Westbrook High School and backs up to the Union Pacific Railroad right-of-way. The applicant, Charles D. Foxworth, Jr., (Foxworth Real Est. Co.) has been trying to sel I the vacant property for several years for single family use but has had no luck. This property was platted along the Old Sour Lake Highway in 1923. It was not annexed until 1978 and zoned residential single family. The lots average two acres each along this segment of Phelan. There are several older homes on the lots to the east and west of the applicant's property. The RM-M District will permit single family duplexes, townhomes and medium density apartments but does not permit offices or any kind of retail business or services. The RM - M District in this location will allow compatible residential land uses in the neighborhood. Exhibits are attached. Sub,'d Ladies and Gentlemen: We are requesting a change of zoning on the above referenced property from RS to RM-M. Under the present single family zoning, this 3.7 acre tract will allow the construction of only two residences. The location and railroad will not justify this development for only two homes. We have advertised this property for sale for a period often years and have had no opportunity to sell it for that purpose. It had also been on the market prior to that time. There are other tracts which back up to the railroad that have been on the market for a similar period with no results. We believe that the highest and best use of the property would be for Residential Multiple -family Dwelling -Medium Density.
