SUBJECT: Request for a specific use permit to allow a barbershop in an RM-H (Residential

The Planning Manager recommends approval of the requested specific use permit for a
barbershop in an RM-H (Residential Multiple Family Dwelling -Highest Density) District.
This request is to legally authorize an existing barbershop located in a residential
neighborhood. Mr. Lawrence Lavergne submitted this application in response to repeated
contacts from Code Enforcement personnel in the Development Services Division of
Public Works. Barbershops are not permitted in an RM-H District without a specific use
permit. This application is made to cure an existing zoning violation. The shop is not
"grandfathered" in as a use.

The propose use is for a Barber Shop. No landscaping or screening buffers are necessary
because my neighbors have no problem with the current situation.
1. The specific use has been compatible with and not injurious to the use and enjoyment of
other property, and has not diminish or impair property values within the immediate vicinity.
In fact, there are several other businesses operating in the immediate vicinity.
2. There is no surrouhnding vacant property.
3. Adequate utilities, access roads, drainage and other necessary supporting facilities are
currently and has been in existence.
4. The general public has not been affected by the disign, location and arrangement of the
driveway and parking.
5. All activities of the barber shop are conducted inside the building and there are no odor,
fumes, dust, noise or vibration associated with the activities of barbering.
6. No directional lighting lighting has been necessary because the is only open during the day
time.
7. AR owners of adjacent properties have been contacted and have signed letters stating that
they have no problems with the barber shop which has been in operation for years.
8. The proposed use is in accordance with the comprehensive plan.
