SUBJECT: Request for a zone change from RS (Residential Single Family Dwelling) and RM-H
(Residential Multiple Family Dwelling -Highest Density) to GC -MD (General
Commercial -Multiple Family Dwelling) and GC-MD-2 (General Commercial -
Multiple Family Dwelling-2) District for an 8.1851 acre tract.

STAFF REPORT
The Planning Manager recommends that the north 100'of the tract (0.5945 acres) be rezoned
from RS to GC-MD-2 and; that the south 1000'(7.5906 acres) be changed fi-om RS and RM-
H to GC -MD.
Mr. Brent Coon has purchased the BP Amoco Surplus Property Tract No. 116, situated at
the northeast corner of Delaware and Dowlen Road. This tract fi-onts along the east side of
Dowlen for 1100 feet with a depth at its north end next to the Dowlen Road Church of Christ
of 265 feet. The tract on its south end extends along the north side of Delaware 475 feet.
Hillebrandt Bayou forms the entire cast boundary line of the land.
The current zoning of the north 700'of the property is RS. The lower or south 400'is RM-H.
The applicant is asking that the north 100' be rezoned to GC-MD-2. In the GC-MD-2
district, a specific use permit is required prior to any use. The applicant has not asked for a
specific use permit at this time. His request for the south 1000' is GC -MD.
The City's Comprehensive Plan designates a "District Center" for the Dowlen/Delaware
intersection. The City Council in October 1999, rezoned a 40 acre Amoco tract located
opposite the subject tract to GC -MD and GC-MD-2. Delaware Street, a major arterial, will
be extended in the Riture west to Major Drive and beyond. The City has most of the right-of-
way needed but no date for construction has been established.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
DESCRIPTION of a 0.5945 acre tract of land out of the Hezekiah Williams League,
Abstract No. 56 located in Beaumont, Jefferson County, Texas.
ALL THAT CERTAIN tract or parcel of land being out and a part of that certain 8.1851
acre tract identified in deed as Tract Two, conveyed by Amoco Production Company to
Brent W. Coon and wife, Janet F. Coon and recorded under County Clerk's File No.
1999033674 of the Official Public Records of Real Property, Jefferson County, Texas, said
tract being more fully bounded and described as follows:
BEGINNING at a 1/4 inch (1/4") iron rod found marking the northwest comer of the herein
described tract, said comer being: i) in the east line of Dowlen Road, a 100 foot (100') wide
street right-of-way; ii) the northwest comer of the aforesaid 8.1851 acre Tract Two; iii) and
the most southwest comer of that certain 4.65 acre tract conveyed by Amoco Production
Company to Pinecrest Church of Christ as recorded under County Clerk's Film Code No.
101-95-1304 of the Official Public Records of Real Property, Jefferson County, Texas;
THENCE with the north line of said 8.1851 acre Tract Two, the south line of said 4.65 acre
Pinecrest Church of Christ tract, and the north line of the herein described tract, North 86
degrees 26 minutes 50 seconds East (N 86' 26" 50"" E) for a distance of 264.99 feet (264.99')
to a Y2inch (1/2") iron rod found marking the northeast comer of the herein described tract,
said comer being the southeast comer of said 4.65 acre Pinecrest Church of Christ tract and
also being in the westerly line of that certain 3.511 acre tract of land identified in deed as
Tract No. 2 as conveyed by Stanolind Oil and Gas Company to Jefferson County Drainage
District No. 6 (DD6) and recorded in Volume 742, Page 212 of the Deed Records of
Jefferson County, Texas (said easement partially encompasses Hillebrandt Bayou);

THENCE continuing along the westerly line of said 3,511 acre DD6 tract (westerly line of
Hillebrandt Bayou), the easterly line of said 8.1851 acre Tract Two, and the easterly line of
the herein described tract, South 01 degree 11 minutes 31 seconds West (S 01' 11' 31 " W)
for a distance of 91.41 feet (91.41) to point marking the southeast comer of the herein
described tract;
THENCE with the south line of the herein described tract, South 86 degrees 26 minutes 50
seconds West (S 86' 26" 50"" W) for a distance of 254.72 feet (254.72') to a point marking
the southwest comer of the herein described tract, said point being in the east right-of-way

Application for Zoning Amendment
In follow up to our meeting on the 6th of the this month, attached, for review
and consideration are the following:
1) Application form requesting amendment to the , Zoning
Ordinance for a 8.1851 acre parcel of vacant land located in the
3000 block of N. Dowlen Road
2) Exhibits: "'A" -Location map and "B"-Propo,sed zoning and
existing zoning of adjoining properties
3) Current survey of the subject tract (Tract Two) from July of 1999
4) Field note description of the subject tract (also shown on
survey) and descriptions of the two parcels (2A and 2B)
comprising the requested zoning amendment
5) Application fee (check no. 2393) for $500�.010
The subject property ir? a heavily wooded tract located on the northeast corner
of N. Dowlen Road and Delaware Street, adjacent to and south of the Dowlen
Road Church of Christ. The property was recently purchased from BP Amoco
by Brent W. Coon with intentions of marketing this property primarily for
commercial use in accordance with Land Use element of the City's adopted
Comprehensive Plan. The applicant/owner requests through submittal of the

above, consideration to amend the zoning of the subject site to GC -MD and GC-MD2 as
illustrated and described in the referenced attachments.
Utilities are readily available on and adjacent to the site. All water and sanitary sewer
improvements would be constructed to City of Beaumont standards. Drainage for this tract
would discharge storm water via an underground system to Hillebrandt Bayou with a
minimal amount of surface runoff onto Dowlen Load. A master plan for utilities and
drainage would be submitted in the construction plan package for site improvements. We
feel this project will enhance the surrounding area and blend very well with the existing
environment along this stretch of one of the City's busiest arterial streets.
On behalf of the applicant, we request consideration of the attached and trust that these
will meetwith favorable approval by both the Planning Commission and City Council at the
Joint Public Hearing scheduled for November 151. If you or the Planning staff should have
any questions or comments prior, to that time, certainly feel free to call.
