Moore Councilmember-at-Large Andrew Cokinos Councilmember-at-Large Becky Ames Councilmember Lulu Smith Councilmembers absent: Councilmember Guy Goodson Councilmember Bobbie Patterson Also present: Stephen Richardson, Planning Manager; Murray Duren, Senior Planner; Tyrone Cooper, First Assistant City Attorney; Adina Abshire, Planning Technician; and Jill Cole, Recording Secretary APPROVAL OF THE MINUTES Commissioner Lucas made a motion to approve the minutes of the Regular Meeting held December 6, 1999. Commissioner Hallmark seconded the motion. Motion to approve carried 6:0. M Planning Commission December 20, 1999 REGULAR MEETING 1) Preliminary Plat -Gladys West Subdivision, Section Six: Consider the Preliminary Plat of Gladys West Subdivision, Section Six; 9.05 acres out of the H. Williams Survey, Ab-56. Applicant: Fittz and Shipman, Inc. for Nichols Development Company Mr. Richardson informed the Commission that the preliminary plat is for a single family townhouse subdivision. The single family portion is zoned RS and the townhouse portion is zoned RM-H. As part of this development, Indian Blanket, Rosewood and Buttercup will be extended and connected to provide another exit onto Major Drive. Two private drives will serve the townhouse portion of the development. This plat was submitted to all interested parties and all the concerns of the various parties have been addressed. Mr. Richardson recommended approval of the plat. Chairman Leister asked for the applicant's comments. John Holm of Fittz and Shipman, Inc., the applicant, was present. Vice -Chairman Dykeman made a motion to approve the Preliminary Plat of Gladys West Subdivision, Section Six as requested. Commissioner Hernandez seconded the motion. Motion to approve carried 6:0. 2) File 592-OB: Request to abandon 3 feet of a 12 foot utility and drainage easement in Lots 1-4, Block 4, Sheridan Park Addition. Applicant: Toby White, et al Mr. Richardson told the Commission that the subject request is to abandon the east 3 feet of a 12 foot wide drainage and utility easement at the rear of Lots 1-4, Sheridan Park Addition. Mr. White, owner of Lot 1, has made this request in order to construct a swimming pool in his rear yard at 1405 Sheridan. Three other adjacent property owners have joined Mr. White in this request. This abandonment was submitted to all interested parties and no objections were received. Mr. Richardson recommended approval of the request. Pa Planning Commission December 20, 1999 Chairman Leister asked for the applicant's comments. Toby White, the applicant, addressed the Commission. In response to Commissioner Hallmark, Mr. Richardson said that the abandonment would be on Lots 1-4. Commissioner Hallmark made a motion to approve the request to abandon 3 feet of a 12 foot utility and drainage easement in Lots 1-4, Block 4, Sheridan Park Addition as requested in File 592-OB. Commissioner Lucas seconded the motion. Motion to approve carried 6:0. JOINT PUBLIC HEARINGS Mayor Moore called the Joint Public Hearings of December 20, 1999 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. Chairman Leister stated that Item 3 on the agenda, File 591-OB, will be deferred until the January 19, 2000 meeting. 1) File 1486-P: Request for a specific use permit to allow a new church in an RS (Residential Single Family Dwelling) District. Location: 7830 State Highway 105 Applicant: Grace Church, Blaine McFarlin, Associate Pastor W. Richardson told the Commission and Council that Grace Church wishes to build a new church on the subject property. A 12,600 square foot sanctuary that seats approximately 478 persons is planned. 210 parking spaces are also planned. Another 9.8 acres north of the subject property will be purchased for future expansion. The specific use permit meets the eight conditions for approval, therefore Mr. Richardson recommended approval of the request. Twenty-nine notices were mailed to property owners within 200 feet of the subject property. Two notices in favor and one in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Ralph Martin, Pastor of Grace Church, addressed the Commission. 9 Planning Commission December 20, 1999 Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Hallmark made a motion to approve the specific use permit to allow a new church in an RS District at 7830 St. Hwy. 105 as requested in File 1486-P. Commissioner Lucas seconded the motion. Motion to approve carried 6:0. 2) File 1487-P: Request for a specific use permit to allow a massage therapist along with a full service salon to include hair styling, tanning booths, nail care and sale of health care products in an RCR (Residential Conservation and Revitalization) District. Location: 2680 McFaddin Avenue Applicant: Cynthia A. Kendrick Mr. Richardson told the Commission and Council that the applicant, Cynthia Kendrick, proposes to open a full service salon with massage therapy and tanning booths in an existing structure. The request was reviewed by the Traffic Manager and he recommended approval subject to the driveway being widened to 22 feet. In addition, Ms. Kendrick is requesting a modification to the landscaping and screening requirements for the east property line. An 8 foot tall fence would be required on the north and east and a 10 foot wide planted buffer strip is required. However, there is not room to meet the requirement of the 8 foot fence and 10 foot landscape strip. Mr. Richardson recommended approval of the request subject to the widening of the driveway to 22 feet and a modification to the screening and buffering requirements on the east property line. Twenty notices were mailed to property owners within 200 feet of the subject property. One response in opposition and none in favor were returned to staff. Commissioner Hallmark suggested tapering of the cast property line fence once it enters the front yard setback area. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Cynthia Kendrick, the applicant, addressed the Commission. Ms. Kendrick said that they would gladly widen the driveway, perhaps an entrance on one side of the oak tree and an exit on the other side. n • r� Planning Commission December 20, 1999 Chairman Leister asked for comments in favor or in opposition. No comments were made. Chairman Leister closed the public hearing. Commissioner Lucas made a motion to approve the specific use permit to allow a full service salon with massage therapy and tanning booths in an RCR District at 2680 McFaddin as requested in File 1487-P, subject to the following conditions: (1) Widen driveway to accommodate commercial traffic as per Traffic and Transportation requirements; and (2) Modification of the landscaping and screening requirements along the east property line as allowed by Section 30-31 (b) 3. Commissioner Hallmark seconded the motion. The motion to approve carried 6:0. 3) File 591-OB: Request for a text change to Chapter 30, City of Beaumont Zoning Ordinance, amending Section 30-23.1 to include the Major/Dowlen/GIadys/Hwy. 105 Sign Overlay District and to apply it to area in the west end of Beaumont.. Location: Area bordered by the south side of Highway 105, 100 feet east of Old Dowlen Road, 100 feet east of Dowlen Road, 100 feet south of Gladys and 100 feet west of Major Drive. Applicant; City of Beaumont Planning Commission As stated at the beginning of the Joint Public Hearings, File 591-OB will be deferred until the January 19, 2000 meeting. OTHER BUSINESS Chairman Leister welcomed Mrs. Marty Craig as the newest member of the Planning Commission. THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED AT 4:15 P. M. W
