ENTITLED AN ORDINANCE ISSUING AN AMENDED
SPECIFIC USE PERMIT TO ALLOW ADDITIONAL
PARKING AND TO ADD A COMMERCIAL STRIP CENTER
WITH A TAX OFFICE AND BARBER SHOP IN AN RCR
(RESIDENTIAL CONSERVATION REVITALIZATION)
DISTRICT LOCATED AT 1325 COLLEGE STREET,
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, on April 27, 2021, City Council approved Ordinance 21-019 issuing
a specific use permit to Rosa and Sifuentes Francisco Castillo to allow restaurant
parking in an RCR (Residential Conservation Revitalization) District located at 1325
College Street, Beaumont, Jefferson County, Texas, subject to the following conditions;
and,
• Landscaping and screening be installed and maintained as per ordinance
requirements, including provision of island, medians and/or peninsulas
and perimeter buffer;
• Irrigation system shall be installed and maintained for all required
landscaping;
• Replace/repair sidewalks along all streets;
• Lighting to be shielded from neighboring residential properties;
• Access drive should be off of Orange Street;
WHEREAS, the applicants, Rosa and Sifuentes Francisco Castillo wish to amend
Ordinance No. 21-019 to allow additional parking and to add a commercial strip center
with a tax office and barber shop in an RCR (Residential Conservation Revitalization)
District, being Lots 100, 101 and 102, Block 9, Crary Addition, Beaumont, Jefferson
County, Texas, containing 0.537 acres, more or less, as shown on Exhibit "A," attached
hereto and made a part hereof for all purposes; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request to amend Ordinance No. 21-019 to allow additional parking and
to add a commercial strip center with a tax office and barber shop in an RCR
(Residential Conservation Revitalization) District located at 1325 College Street, subject
to the following conditions:
and,
• Landscaping and screening be installed and maintained as per ordinance
requirements, including provision of island, medians and/or peninsulas
and perimeter buffer;
• Irrigation system shall be installed and maintained for all required
landscaping;
• Replace/repair sidewalks along all streets;
• Lighting to be shielded from neighboring residential properties;
• Parking for the restaurant and commercial building shall be separated so
that the restaurant parking lot can only be accessed from Orange Avenue;
WHEREAS, the City Council is of the opinion that the amendment of Ordinance
No. 21-019 to allow additional parking and to add a commercial strip center with a tax
office and barber shop is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby,
in all things, approved and adopted; and,
Section 1.
That Ordinance 21-019 be amended by amending the specific use permit to
allow additional parking and to add a commercial strip center with a tax office and
barber shop in an RCR (Residential Conservation Revitalization) District at 1325
College Street, being Lots 100, 101 and 102, Block 9, Crary Addition, Beaumont,
Jefferson County, Texas, containing 0.537 acres, more or less, is hereby granted to
Rosa and Sifuentes Francisco Castillo their legal representatives, successors, and
assigns as shown on Exhibit "A," attached hereto and made a part hereof for all
purposes, subject to the following conditions:
• Landscaping and screening be installed and maintained as per ordinance
requirements, including provision of island, medians and/or peninsulas
and perimeter buffer;
• Irrigation system shall be installed and maintained for all required
landscaping;
• Replace/repair sidewalks along all streets;
• Lighting to be shielded from neighboring residential properties;
• Parking for the restaurant and commercial building shall be separated so
that the restaurant parking lot can only be accessed from Orange Avenue.
Section 2
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "B"
and made a part hereof for all purposes.
Ccrflnn 'A
Notwithstanding the site plan attached hereto, the use of the property herein
above described shall be in all other respects subject to all of the applicable regulations
contained in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended,
as well as comply with any and all federal, state and local statutes, regulations or
ordinances which may apply.
The meeting at which this ordinance was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
