WHEREAS, on February 25, 2020, the City Council of the City of Beaumont,
Texas passed Resolution No. 20-041 awarding a contract in the amount of
$1,975,777.68 to Allco, LLC, of Beaumont, Texas, for the Wastewater Treatment Plant
Trickling Filters Rehabilitation Project; and,
WHEREAS, on June 2, 2020, the City Council of the City of Beaumont, Texas
passed Resolution No. 20-110 authorizing the City Manager to execute Change Order
No. 1, in the amount of ($47,843.32), to delete the rehabilitation of the existing
distribution tubes and truss arms on the Primary Trickling Filters; delete the
rehabilitation of the existing truss arms on the Secondary Trickling Filters; provide new
hot -dip galvanized steel distribution tubes on the Secondary Trickling Filters in lieu of
new stainless steel tubes; and, rehabilitate the interior and exterior surfaces of the
center columns on each of the Primary Trickling Filters and each of the Secondary
Trickling Filters, thereby decreasing the contract amount to $1,927,934.36; and,
WHEREAS, on August 21, 2020, the City Manager executed Change Order No.
2, in the amount of $0.00, to provide for the removal and replacement of six (6) of
thirteen (13) gusset plates on the Primary Trickling Filer No. 2 center column, thereby
having no effect in the total contract amount of $1,927,934.36; and,
WHEREAS, on November 6, 2020, the City Manager executed Change Order
No. 3, in the amount of $0.00, to provide for the removal and replacement of eight (8) of
twelve (12) gusset plates on the Primary. Trickling Filter No. 3 center column, thereby
having no effect in the total contract amount of $1,927,934.36; and,
WHEREAS, on January 20, 2021, the City Manager executed Change Order No.
4, in the amount of $0.00, to provide for a time extension due to time spent waiting for
answers from the trickling filter manufacturer on repair of the south primary center
column gussets, Covid-19 quarantine of workers, and Hurricane Laura, thereby having
no effect in the total contract amount of $1,927,934.36; and,
WHEREAS, on March 10, 2021, the City Manager executed Change Order No.
4, in the amount of $0.00, to provide for the removal and replacement of four (4) of eight
(8) gusset plates on the South Secondary Trickling Filter center column, thereby having
no effect in the total contract amount of $1,927,934.36; and,
WHEREAS, Change Order No. 6, in the amount of ($38,423.00), is required to
adjust the estimated quantities in the contract to reflect the actual quantities used in the
completion of the project, thereby decreasing the total contact amount to $1,889,511.36;
and,
WHEREAS, the project has been inspected by the Water Utilities Engineering
Division and found to be complete in accordance with the provisions and terms set forth
in the contract;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the City Manager be and he is hereby authorized to execute Change
Order No. 6, in the amount of ($38,423.00), to adjust the estimated quantities in the
contract to reflect the actual quantities used in the completion of the project, thereby
decreasing the total contact amount to $1,889,511.36; and,
BE IT FURTHER RESOLVED THAT the Wastewater Treatment Plant Trickling
Filters Rehabilitation Project be and the same is hereby accepted; and;
BE IT ALSO RESOLVED THAT the City Manager is authorized to make final
payment in the amount of $94,475.59 to Allco, LLC, of Beaumont, Texas.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
