SUBJECT: Consider the request of McDonald's Corporation to abandon Highland Avenue
north of Euclid to the dead-end at M.L.K., Jr. Parkway.

The Planning Manager recommends abandonment of the street if the City retains a general
utility easement and drainage easement (if required) to cover the entire right-of-way to be
abandoned or all services and utilities are relocated; all costs to be paid by the applicant.
McDonald's has under contract the four platted lots west of this one-half block of
Highland Avenue and the two lot remnants to the east. They are also purchasing parts of
two lots facing Washington Boulevard.
McDonald's is planning a restaurant to front onto M.L.K., Jr. Parkway. Planning
Division File 1507-Z to rezone four lots in this block (Lot 14, 15, 16 and 17, Block 2,
Arlington Addition) from RS to GC -MD will be considered at a Joint Public Hearing
today. Staff is recommending approval of the zone change.
Information regarding the abandonment request was sent out to all interested parties.
There are several city and utility company services within the 60' wide right-of-way
between Euclid and the dead-end at M.L.K., Jr. Parkway. Following is a list of what is
now in the street and comments regarding same:
1) City water - There is a 10" water main in the west side of the street right-of-way.
Can be re-routed to M.L.K. Costs paid by applicant.
2) City storm sewer - There is a 15" storm sewer in the street. This can be capped
according to City Engineer.
3) Enter gy - Three phase primary distribution line serving the Exxon station at
M.L.K. and Washington. Can be relocated. Costs paid by applicant,
4) Entex (Reliant Enter T,yJ - There is a 4" steel gas line serving as a major feed to
northeast Beaumont. Can be relocated. Costs paid by applicant.
5) Traffic and Transportation - Street light on pole near intersection of Highland and
Euclid. Can be relocated. Costs paid by applicant,
6) Southwestern Bell Co. - Bell has an underground conduit and aerial pole lead. The
telephone company has objected to the abandonment.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being an 0.34 acre tract or parcel of land, being a portion of Lots Twelve (12), Thirteen (13)
and Fourteen (14) in Block Two (2) of Arlington Addition to the City of Beaumont,
according to the map or plat thereof recorded in Volume I at Page 70 of the Map Records
of Jefferson County, Texas, together with a portion of a Fifteen (15) foot wide alley out of
said Block Two (2), said alley being vacated and closed by City of Beaumont Ordinance
recorded in Volume 414 on Page 342 of the Deed Records of Jefferson County, Texas, said
0,34 acre tract being a portion of that certain tract of land situated within the evident City of
Beaumont right-of-way of Highland Avenue (approximately 60 feet wide) as extended
through said Block Two (2) of Arlington Addition to the City of Beaumont, said 0.34 acre
tract or parcel of land being all of the Highland Avenue right-of-way extending north from
the north right-of-way line of Euclid Avenue to the southwesterly right-of-way line of
M.L.K., Jr. Parkway (Spur 380).

McDonald's Corporation is in the process of purchasing property at the above
mentioned location, for the purpose of constructing a McDonald's restaurant. Currently
there is an abandoned road, the extension of Highland Ave, which runs in between lots 14
& 12, Bock 2, Arlington Addition. I have enclosed the applications which have been
executed by the owners of the abutting property, and the application fee of $200.00.
