Richardson, Planning Manager SUBJECT: Request for a zone change from RS (Residential Single Family Dwelling) to GC- MD-2 (General Commcrcial-Multiple Family Dwelling-2) District and a request for a specific use permit to allow a tree service at 6640 Concord Road. FILE: 1508-Z/P STAFF REPORT The Planning Manager recommends approval of the zone change to GC-MD-2 and the specific use permit to allow the tree service. The westerly side of Concord is presently zoned GC -MD and the street will be widened as a secondary arterial in the future. Mr. and Mrs. Charles W. Morris live at 6640 Concord and operate the "Environmental Tree Service" next door to, their house on a 1.009 acre tract of land. They have been in business several years in violation of the Zoning Ordinance. They service residential and commercial accounts. The property lies north of Judy Lane. The tract backs up to the abandoned Southern Pacific Railroad right-of-way and was part of the 1957 annexation. It has been zoned RS since 1964. The Eastex Freeway lies to the west of Concord. Between the freeway and Concord are warehouses, shopping centers and vacant tracts, zoned GC -MD. There are residences located north and south of the subject property, zoned RS. The property to the east is also zoned RS. There is a heavy tree line along the abandoned railroad right-of-way. The applicant proposes to build a 10' high wood fence along his entire property line and plant waxleaf ligustrums along the fence. Concord along this segment will be widened to a 90'wide right-of-way with four lanes of traffic and curbs and gutters according to the recently updated Major Street and Highway Plan (March 7,2000), The City's Development and Strategies Diagram (Land Use), adopted also by City Council on March 7, 2000, shows this area as part of the Regional Center. That the specific use will be compatible with and not injurious to the use and enjoyment of other property, nor significantly diminish or impair property values within the immediate vicinity; 2. Comments on conditions # 1, 2, 3, 4 and 5 follow: 1 The existing tree service has been in existence for some time, albeit in violation of the Zoning Ordinance. The owner of the company resides in a residence immediately adjacent to the site of the business. He proposes to build a 30'x 50'workshop on the one acre tract and to improve and extend the driveway to the workshop. The owner• will screen the property. There is already commercial zoning across the street. 2. With the eventual widening of Concord up to Hwy, 105, traffic will most certainly increase. With this increase in traffic, the use of those properties immediately fronting on Concord will become less conducive to single family residential uses. 3. The existing drainage of the property will not be adversely affected and has been approved by the City Engineer. 4. The present driveway will be used for access at the present time. See #1 above, Concord will be widened to four lanes in the future. 5. The owner will construct a 10' high solid wood fence and shrubs to screen the entire tract.
