SUBJECT: Request for a specific use permit to allow a church in an RS (Residential Single
Family Dwelling) District at 5275 Phelps Road at Chapel Lane.

STAFF REPORT
The Plam-fing Manager recommends approval subject to a modification of the landscape and
screening regulations of Section 30-31 as shown on the site plan. An underground storm
sewer collection system must be approved by the City Engineer.
Mr. and Mrs. Kerry Avie, Sr., representing the House of Prayer Deliverance Church, are
requesting the specific use permit to build a new 4,356 square foot sanctuary at 5275 Phelps
Road on a 3.10 acre tract.
Mr. Avie said there are 150 church members. Louella Avie, his wife, is the pastor of the
church. The applicant is requesting a modification to the landscape and screening
regulations be approved as pail of his application.

Dear Sir,
We, the Pastor and members of the House Of Prayer Deliverance Church
will utililize the building on ' 5275 Phelps Road as a Non -Denominational
Church on Sundays for Sunday school at 9:45 a.m., morning service at
10:45 a.m. and evening service at 6:30 pm. On Mondays the building will
be used for mission and brotherhood lessons at 6:30 p.m. On Tuesdays
choir practice for the Senior and young adult choirs at 6:30 p.m. On
Wednesdays we will hold prayer meeting, and Bible study at 6:30 p.m. The
building will be used for religious teaching and the uplifting of God only.

The application is in compliance with 7 of the 8 conditions necessary for approval.

3. The City Engineer states that an underground storm sewer collection system will be
required by the City.
7. The applicants tract is 645'x 209'. The applicant wishes to construct a 6' wood fence
on the south side of the property and a connecting 6' fence at the rear (cast) of the
proposed sanctuary at a point 350'ftom the front property line. This will leave a 1.4
acre undeveloped area at the back of the church. The ordinance requires an 8" fence
on the south and cast property lines and a 10'wide buffer strip with 6' trees planted
evei y 2 5' along the buffer.
