Bonczek, City Manager; and Kyle Hayes, Economic Development Director APPROVAL OF THE MINUTES Commissioner Robinson made a motion to approve the minutes of the Regular Meeting held March 6, 2000. Commissioner Lucas seconded the motion. Motion to approve carried 4:0. Planning Commission March 20, 2000 JOINT PUBLIC HEARING Mayor Pro-Tem Goodson called the Joint Public Hearings of March 20, 2000 to order and explained the purpose of the joint hearing process and then turned the meeting over to Vice - Chairman Dykeman. He explained the policies and procedures for the hearing process. 1) File 1498-P: Request for a specific use permit to allow a residential care facility (HOW Center) in an RM-H (Residential Multiple Family Dwelling -Highest Density) District. Location: 2509-11 Cable, 1094-98 Cottonwood and 1130 Cottonwood Applicant: City Planning Division Mr. Richardson stated that the subject facilities are located on the northeast and northwest corners of Cable and Cottonwood. The HOW Center is a facility offering room and board for men with substance abuse problems. Admittance to the facility requires a strict screening process. The HOW Center is a 501 (c) (3) and is governed by a board of directors. There is space available for a maximum of 27 men with 24 men typically living at the facility at any one time. A curfew of 10:00 p.m. on Sunday - Thursday and 12:00 a.m. on Friday and Saturday is enforced. The facility has been operating since 1992. The facility consists of an office/dwelling structure, two other dwelling structures, a cafeteria and a large parking lot. Mr. Richardson recommended approval of the request subject to the following conditions: 1. The facilities shall be maintained and such records of the facility shall be available for inspection by employees of the City from 8:00 a.m. to 5:00 p.m., Monday through Friday. 2. House rules shall be adopted, reduced to writing and readily available. House rules must include a minimum of curfew based on a normal 10:00 p.m. Sunday -Thursday and a 12:00 a.m. curfew Friday -Saturday which may be amended to fit special circumstances of residents. Penalty for curfew violations shall be limited to a fine or other appropriate punishment. In no event shall residents be locked out of the facility for a curfew violation. House rules shall also prohibit residents from soliciting things of value from residents of Beaumont. 3. The facility shall never have more than twenty-seven (27) overnight residents 4. The facility shall provide twenty-four (24) hour adult supervision by persons who have received training in such supervisory functions. 2 Planning Commission March 20, 2000 Provide an eight foot tall screening fence along the north side of the property at 2509-11 Cable and 1130 Cottonwood and plant shrubs on all four sides of the parking lot. In addition, Mr. Richardson recommended a modification of the landscaping requirements. Thirty-two notices were mailed to property owners within 200 feet of the subject property. Two notices in favor and none in opposition were returned. Slides of the subject property were shown. Commissioner Hallmark suggested that the height requirement for the fence on the north side be reduced from 8 feet to 6 feet. Vice -Chairman Dykeman opened the public hearing and asked for the applicant's comments. Owens J. Davillier, Executive Director for the HOW Center, addressed the Commission . He answered questions from the Commission regarding funding and the length of stays for residents. Vice -Chairman Dykeman asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Hallmark made a motion to approve the specific use permit to allow a residential care facility (HOW Center) in an RM-H District at 2509-11 Cable, 1094-98 Cottonwood and 1130 Cottonwood as requested in File 1498-P, with a reduction from 8' to 6' for the fence on the north side of the property. Commissioner Robinson seconded the motion. Motion to approve carried 4:0. 2) File 1499-Z : Request for a zone change from RM-H (Residential Multiple Family Dwelling - Highest Density) to GC -MD - 2 (General Commercial - Multiple Family Dwelling -2) and a specific use permit to allow a climate controlled storage facility. Location: 3880 Crow Road Applicant: Tom Harken, Jr. Mr. Richardson stated that the applicant asked for and received a deferral until next month. 3) File 1500-P: Request for a specific use permit to allow a church in an RS (Residential Single Family Dwelling) District. Location: Northwest corner of Dusty Lane and Black Lane. Applicant: Elder James M. Lowe 3 Planning Commission March 20, 2000 Mr. Richardson stated that the applicant wants to build a 1,344 square foot church on the property. Church activities will typically be held on Sundays and Tuesdays - Thursdays. Mr. Richardson recommended approval of the specific use permit. Fifteen notices were mailed to property owners within 200 feet of the subject property. One response in favor and none in opposition were returned to staff. Slides of the subject property were shown. Vice -Chairman Dykeman opened the public hearing and asked for the applicant's comments. Elder James M. Lowe, the applicant, addressed the Commission. Vice -Chairman Dykeman asked for comments in favor or in opposition. No comments were made,. The public hearing was closed. Commissioner Robinson made a motion to approve the specific use permit to allow a church in an RS District at the northwest corner of Dusty Lane and Black Lane as requested in File 1500-P. Commissioner Bodwin seconded the motion. Motion to approve carried 4:0. 4) File 1501-Z Request for a zone change from RS (Residential Single Family Dwelling) to GC -MD (General Commercial - Multiple Family Dwelling) or a more restrictive district. Location: 622 W. Lucas Drive Applicant: Darlene Hanna Mr. Richardson stated that the subject property contains 1.057 acres. The applicant purchased this property from the City of Beaumont. This remnant is left over from the West Lucas extension project. The applicant wants to build a retail store and dance studio on the property. GC -MD zoning and a restaurant are just south of the subject property. Because of residences to the east, Mr. Richardson recommended GC-MD-2. This would require a specific use permit before anything could be built. Twenty notices were mailed to property owners within 200 feet of the subject property. Six responses in opposition and none in favor were returned to staff. Slides of the subject area were shown. 4 Planning Commission March 20, 2000 Vice -Chairman Dykeman opened the public hearing and asked for the applicant's comments. Mark Rule addressed the Commission on behalf of the applicant, Darlene Hanna. (Councilmember Ames arrived.) Vice -Chairman Dykeman asked for comments in favor or in opposition. Mrs. Smith, 711 W. Lucas, addressed the Commission in opposition to the request. Kelly Kays, 640 W. Lucas, addressed the Commission in opposition. Rosalie Whitman, 710 W. Lucas, addressed the Commission in opposition. Rebuttal by Mr. Rule followed. Vice -Chairman Dykeman closed the public hearing. Commissioner Hallmark made a motion to approve a zone change from RS to GC- MD-2 for the property at 622 W. Lucas Drive as requested in File 1501-Z. Commissioner Robinson seconded the motion. Motion to approve carried 4:0. 5) File 1502-Z: Request for a zone change from A-R (Agricultural -Residential) to RS (Residential Single Family Dwelling) District. Location: West of Dowlen, adjacent to Barrington Heights Subdivision. Applicant: Richard Guseman - Talisman Development, Inc. Mr. Richardson told the Commission that the subject property contains 18 acres. The property will be used to build Phase 3 of Barrington Heights Subdivision. Mr. Richardson recommended approval of the zone change. Nineteen notices were mailed to property owners within 200 feet of the subject property. No responses in opposition or in favor were returned. Slides of the subject property followed. Vice -Chairman Dykeman opened the public hearing and asked for the applicant's comments. Joe Pattie of Carroll and Blackman, Inc., the consulting engineers, addressed the Commission. 5 Y 1 Planning Commission March 20. 2000 Vice -Chairman Dykeman asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Lucas made a motion to approve the zone change from A-R to RS for property located west of Dowlen Road adjacent to Barrington Heights Subdivision as requested in File 1502-Z. Commissioner Robinson seconded the motion. Motion to approve carried 4:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING ADJOURNED AT 4:45 P. M. 0
