SUBJECT: Consider a request to abandon a 4 foot wide alley right-of-way lying between Lot 8,
Block 87, Cartwright Addition and Lots 8, 9, 10 and part of Lot 11, Block 10,
Arlington Addition.
STAFF REPORT
The Planning Manager recommends abandoning the alley but retaining a general utility
easement to serve the utilities in the alley.
Hi-Lo Auto Supply owns 170 feet of frontage along the north side of Washington at Neches.
They plan to build a 6,000 square foot O'Reilly Auto Parts Store on the property, which
consists of Lots 8, 9, 10 and 20 feet of Lot 11, Block 10, Arlington Addition. They are also
purchasing the south 35 feet of Lot 8, Block 87, Cartwright Addition which lies north of and
adjacent to the 4 foot wide alley requested for abandonment.
Hi-Lo is requesting that the adjacent portion of said Lot 8 be rezoned to GC -MD to match
the current zoning of the lots on Washington Boulevard where they plan to build. The 35
foot wide tract will be used for parking, landscaping and an 8 foot high screening fence. This
request is File 1516-2 and is on the joint public hearing agenda for June 19, 2000.
There is a 6 inch sanitary sewer line in the alley and overhead electric lines, cable television
and telephone lines also in the right-of-way. Since the O'Reilly site plan shows no proposed
building over the alley, retaining an easement would protect the existing utilities.
There is a 20 foot wide north -south alley which separates the east and west halves of Block
87, Cartwright Addition. The west half of the block faces Neches and the cast half faces
Park Street. The east half of the 4 foot wide alley, that part adjacent to Lot 9, Block 87,
Cartwright Addition, is not part of this abandonment request --- only the west 160 feet of the
alley. The Cornerstone Church of the Nazarene (formerly the First Church of the Nazarene)
is selling the vacant lot parcel to Hi-Lo.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
All of that part of a 4 foot wide alleyway extending from the east right-of-way line of the
Neches Street 60 foot wide right-of-way 150 feet cast to the west line of a 20 foot wide alley;
thence an additional 10 feet to the centerline of said 20 foot wide alley; said alley to be
abandoned situated north of Lots 8, 9, 10 and pail of Lot 11, Block 10, Arlington Addition
and south of the west half of Block 87, Cartwright Addition, containing 0.015 acres, more
or less.

We are submitting an Application for Amendment of the Zoning Ordinance and for Alley Abandonment for
property located on Neches Street just north of the property we now own at 1050 Washington Blvd which
is the South 35 feet of Lot 8, Block 87 of Cartwright Subdivision.
THE REASONS FOR THE ALLEY ABANDONMENT:
We request that the alley located between this additional property and the property we own be abandoned
as it is not currently used as an alley and we will be able utilize the area as shown on the attached proposed
site plan.
