SUBJECT: Consider a request to abandon the 60' x 135.61' street right-of-way of Cartwright
Avenue adjacent to Lot 1, Block 13, Washington Manor Addition.

STAFF REPORT
The Planning Manager recommends approval of the request to abandon the west and final
135.6l'of Cartwright Avenue as platted, subject to the following conditions: (1) The north
3 0' x 135.6P of the street be retained as a general utility and drainage easement and (2) The
south 30'x 135.6 P of the street be retained as an access easement for Drainage District #6.
Mr. Clayton Mayfield owns the most westerly lot on Cartwright west of 23rd Street. The lot
abuts a DDY6 ditch easement on the west. This 135.61' wide lot lies on the north side of
Cartwright. The street is unimproved at this point. The DD#6 ditch turns east and lies south
of and abuts Cartwright.
Information regarding this request was sent to all interested parties. No objections were
.forthcoming. Drainage District No. 6 does require an easement for access to their ditch
#112. Storm sewers and water lines exist to the east in Cartwright but have not been
extended to the subject abutting Lot 1. The street pavement stops before it reaches Lot 1.
The retention of an easement to serve future utility and city services is recommended.

For Place of Beginnin , begin at the southeast comer of Lot 1, Block 13, Washington Manor
Addition, said addition filed for record in the Map Records of Jefferson County on August
13, 1980, in Volume 13, Page 55, said point also lying in the north right-of-way line of
Cartwright Avenue, a 60 foot wide street right-of-way;
Thence S. 88' 42'20" W. along the south line of Lot 1, Block 13, said addition, same being
along the north right-of-way line of Cartwright Avenue a distance of 135.61 feet to a point
for comer in the southwest comer of said Lot 1, same being the northwest comer of the
herein described tract, same lying in the east line of DD#6 ditch No. 112, Thence S. 0' 57'
44" E. along the cast line of DD#6 ditch No. 112 a distance of 60 feet to a point for comer
in the southwest comer of the herein described tract, same lying in the north line of said
DD#6 ditch, same being in the south right-of-way line of Cartwright Avenue;

Thence east along the south right-of-way line of Cartwright Avenue and the north line of
Ditch No. 112 a distance of 135.61 feet to the southeast comer of the herein described tract;
Thence a distance of 60 feet to the Place of Beginning, said tract lying in the City of
Beaumont, Jefferson County, Texas, containing 0.1868 acres of land, more or less.

Re: Request to Abandon Street Right of Way
Dear Mr. Duren:
My wife and I are the owners of Lot I Block 13 of the Washington Manor Addition to the
City of Beaumont. We request the City of Beaumont abandon the unpaved portion of Cartwright
Street which runs adjacent to all of Lot I and 10 feet of Lot 2 of Block 13 of the Washington
Manor Addition. The paved portion of Cartwright Street stops 10 feet short of the eastern
boundary of Lot 1. (Note: my application to abandon right of way with attached Map). This
renders Lot I unaccessible. Cartwright street is the only street with access to Lot 1.
I have spoken with the city engineers office about any plans the city may have to extend
Cartwright Street. I was told that there are at present no plans to extend Cartwright Street beyond
the present location.
I am presently keeping the grass cut on the street right of way. Additionally, persons have
begun to place trash and clean out concrete trucks on the street right of way. I have had to pay to
get the trash and concrete residue remove from the property to prevent it from becoming an
eyesore.
If the city abandons this property so that we can have access to a public street, my wife
and plan to build a residence on the property. The Washington Manor Addition was designed for
the construction of single family residences. My plans for the development of Lot I will be in
keeping with original design of the addition and will only enhance the surrounding properties.
