FILE: 601 -OB STAFF REPORT The Planning Manager recommends approval of the abandonment subject to retaining an casement for Entergy. There were no objections to the request. The right-of-way is no longer needed by DDH6. Entergy requires an casement from abutting property owners. Drainage District No. 6 and two abutting property owners wish to abandon a 30' wide "roadway" right-of-way which was dedicated to Jefferson County in 1957 by deed. The 30' wide strip lies along the south part of Lot 17 and the north part of Lot 18, Block 1, Wescalder Fig Acres Addition, and was to be used for "roadway purposes only, to be used forever as a road." The 30' wide strip is no longer needed by the County. No objections were received by the Planning Division in response to an information memorandum transmitted to interested parties on July 26, 2000. Entergy does have a secondary distribution line in the right-of-way. The utility company will require an easement to protect the line. The 30' wide right-of-way begins at the northwest comer of Lot 18, Block 1, Wescalder Fig Acres, same being in the east right-of-way line of Wescalder Road, a 50' wide street right-of- way, then extends 250' east. From that point the strip extends east along the south 15' of Lot 17 and the north 15' of Lot 18, Block 1, said addition to a point in the east property line of said Lots 17 and 18, Block 1, said addition. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being a 0.20 acre tract of land out of the most southerly portion of Lot 17 and a 0.39 acre tract of land out of the most northerly portion of Lot 18, Block 1, Wescalder Fig Acres, Beaumont, Jefferson County, Texas, as more particularly described in Volume 1078, Page 104, Jefferson County Deed Records, filed for record on August 15, 1957.
