Richardson, Planning Manager SUBJECT: Request for a specific use permit to allow the construction of a new church oil property in an RS (Residential Single Family Dwelling) District at 1555 S. 23rd Street. FILE: 1523-P STAFF REPORT The Planning Manager recommends approval of the church. The church was granted a specific use permit for a 4,500 square foot building December 17, 1996. To date, the church has not yet started construction on the approved site. Section 30- 26 (g) requires that construction or use be substantially underway within two years of approval or the specific use permit shall become null and void. This is a new application with a revised site plan for the same tract of land. The present request proposes a 3,312 square foot sanctuary to accommodate a 125 person membership. Reverend Rackley states that an average number of persons at Sunday church services is 35. They envision that the church building will also provide space for offices, library, classrooms and a nursery. The original specific use permit was to allow a 4,500 square foot structure for a 150 person membership. The site is located just north of a wholesale plumbing and heating company and northeast of the St. Elizabeth Hospital regional laundry. The 10.292 acre tract backs up to the Hillebrandt Bayou and lies adjacent to vacant wooded tracts on the west and north. Cartwright Avenue is 500 feet to the north. Exhibits are attached. Our present congregation is in need of our own building for future growth. Our facility will include a sanctuary for approximately 125 people, offices, library, classrooms, nursery and support spaces. We propose a building of approximately 3500 square feet. We feel our use of this property is compatible with and not injurious to the use and enjoyment of adjacent property. We have sighted the structure well within the property lines and maintained a fifty foot tree buffer zone. Our entrance off Twenty-third Street and a turn -around within the - site, will insure normal orderly development and improvement of adjacent property. This design of driveways, to meet all city code requirements and more than adequate parking spaces, will not adversely affect the general public and will provide control of any noise. Directional lighting and parking lot fights will not extend above the existing tree tops so as not to shine onto adjacent property. A landscaping plan will provide more than adequate assurance that we will maximize the natural beauty of this site and insure harmony and compatibility with all adjacent property. We will provide drainage to the existing ditch and assure that water does not adversely impact our neighbors. Our intent is to comply with the City of Beaumont Comprehensive Plan as well as be excellent neighbors. Thank you for your considerations. Comments on items 1, 2, 4, 7 and 8 follow: A church located within an RS District is a compatible use and permitted with a specific use permit. The district regulations of Section 30-8 of the Zoning Ordinance state that the "...principle use of land in this district is for low density single family dwellings and related recreational, religious and educational facilities normally required to provide the basic elements of a balanced, orderly, convenient and attractive residential area ...... The site contains over 10 acres. The proposed site plan shows adequate spacing of the proposed church building, parking lots and future expansion area. The proposed church will not exceed one story in height. Twenty-third Street is a major collector street according to the Major Street and Highway Plan. Much of the property will be left in a natural state, especially adjacent to the Hillebrandt Bayou. 2. The establishment of the church on the tract will not impede the normal and orderly development of the vacant RS zoned land surrounding the church site to the north and west. Churches and schools are assets to developing residential areas if designed and sited as not to interfere with neighborhood growth. The church has ample space to build and expand in the future. Twenty-third Street carries neighborhood traffic from residential streets to two major arterials, College Street and Washington Boulevard. The church will have access only from Twenty-third Street. 7. A buffer of existing trees will be left along the north and cast property lines to screen the church. 8. The proposal is in conformance with the March 2000 Comprehensive Plan. The Comprehensive Plan designates the site as a Stable Area. One of the residential land use objectives of the plan is to "Provide residential neighborhoods with convenient, easily accessible community facilities and support services that a customary part of the neighborhood environment." One of the residential land use policies states that churches and schools are "...customarily a part of the total residential neighborhood environment......
