SUBJECT: Request for a zone change from GC -MD (General Commercial -Multiple Family
Dwelling) to RS (Residential Single Family Dwelling) District for two 2-acre tracts.

STAFF REPORT
The Planning Manager recommends approval of the zone change to RS.
Sam C. Parigi, Jr., acting as agent for Mr. and Mrs. Garrett Guillory and Mr. and Mrs. Travis
Hefley, is requesting that four acres of land abutting and south of a three acre tract owned
by Mr. and Mrs. Guillory be rezoned from GC -MD to RS. Mr. Guillory desires to add two
acres to his side yard and the Hefley's will build a new home on the other two acres.
Single family homes cannot be constructed in a GC -MD District. The City Council in
January of 1998, downzoned the three acre Guillory tract from GC -MD to RS to allow him
to build his home. This change will extend the RS District about 324 feet to the south.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being two 2-acre tracts out of the W. B. Dyches Survey, Ab-17, being more particularly
described as follows:
Called Tract No. 2
BEING a 2.00 acre tract of land situated in the W.B. Dyches Survey, Abstract 17, Jefferson
County, Texas and being a pail of that certain 20.315 acre tract conveyed to James E. Parker
et al by deed in Volume 2192, Page 380 of the Deed Records of Jefferson County, Texas;
said 2.00 acre tract being more particularly described by metes and bounds as follows:

BEGINNING at a I inch steel rod found in the west right -of way line of U. S. Highway 69,
96, & 287 and the east line of said 20.315 acre tract for the southeast comer of a 3.00 acre
tract described as Parker Brothers Subdivision Unit One per plat recorded in Volume 16,
Page 18 of the Map Records of Jefferson County, Texas and being the northeast comer of
the herein described tract;
THENCE South 10' 4645 " East with the west right-of-way line of said U. S. Highway 69,
96, & 287 for a distance of 163.74 feet to a 5/8 inch steel rod set for the southeast comer of
the herein described tract;
THENCE North 89' 12' 25" West along a line being parallel to and 160.41 feet
perpendicular distance from the south line of said Parker Brothers Subdivision Unit One for
a distance of 546.77 feet to a 5/8 inch steel rod set in the east line of Voth Road and the west
line of said 20.315 acre tract for the southwest comer for the herein described tract;
THENCE North 08 0 14'30" West with the east line of Voth Road for a distance of 162.43
feet to a Y2 inch steel rod found for the southwest comer of said Parker Brothers Subdivision
Unit One and being the northwest comer of the herein described tract;
THENCE South 89' 12'25" East with the south line of said Parker Brothers Subdivision
Unit One for a distance of 539.43 feet back to the point of beginning and containing 2.00
acres of land.
The bearings recited herein are referenced to the bearing of South 10' 46' 45" East for the
west right -of way line of U. S. Highway 69, 96 & 287 per the deed recorded in Volume
2192, Page 380 of the Deed Records of Jefferson County, Texas.

stamped "RPLS 564" set in the east right-of-way line of Voth Road for the southwest comer

of 160.28 feet to a Y2 inch steel rod found for the southwest comer of said 2.00 acre tract
located between the herein described tract and said Parker Brothers Subdivision and being

THENCE 890 12' 25" East with the south line of said 2.00 acre tract located between said
Parker Brothers Subdivision and the herein described tract for a distance of 546.77 feet back

RE: Application for Amendment of the Zoning Ordinance

Dear Mr. Duren:
Please accept this letter as the owners request to down -zone Two (2) Two (2) acre tracts of land
as noted on the enclosed survey located here in the City of Beaumont, Jefferson County, Texas.
Zoning will change from GC -MD to RS. Mr. & Mrs. Garrett Guillory currently own the first
Two (2) acre tract in question and this tract is just south of their existing Three (3) acres, also
known as Parker Brothers Subdivision Unit One (1). The Guillory's purchased this Two (2)
acre tract to add to their existing homesite. They have already built a home on the Three (3)
acre tract (Unit One (1)) which is the same tract we down -zoned in January of 1998.
Mr. & Mrs. Travis Hefley purchased the adjacent Two (2) acres south of the Guillory's Two
(2) acre tract and they want to build a home on this site therefore requesting the same down -
zone from GC -MD to RS.
