Commissioner Craig seconded the motion. Motion to approve carried 5:0. Planning Commission July 16,2001 REGULAR MEETING 1) Preliminary Plat - Washington West. Section Two: Consider the Preliminary Plat of Washington West, Section Two; 8.98 acres out of the A. Savery Survey. Applicant: Fittz and Shipman for New Cornerstone Builders Mr. Richardson stated that the subject request was for a 34 lot single family residential subdivision. This property abuts Washington West, Section One. The Plat was distributed to all interested parties. A number of comments were received pertaining to fire hydrants, dead-end streets, etc. A revised plat was submitted addressing those concerns. DD#6 has expressed concern about the possible flooding in Section Two. Section One had high water and some house flooding during the recent heavy rains. A note has been added to the plat which states: "All residences shall have minimum floor elevation 26.00 (ft.) per Jefferson County Drainage District No. 6 requirements." The consulting engineers will show the elevations of each lot on the final plat. The base flood elevation shall be 25 feet according to DD#6 engineers as determined by an earlier drainage study. A note will also be placed on the plat denoting that part of the subdivision lies within the "B" or 500 year flood zone. Mr. Richardson recommended approval of the plat as submitted on the revised preliminary. Chairman Leister asked for the applicant's comments. John Holm with Fittz and Shipman, the applicant, addressed the Commission. In response to Chairman Leister, Mr. Holm said that during the recent storm, two houses in Section One flooded up to about an inch. DD#6 immediately had a survey crew out there determining the flood plain from that storm, and, as a result, they added 12 inches to it and that's where the 26 feet came from. Commissioner LaBiche made a motion to approve the Preliminary Plat of Washington West, Section Two as requested on the revised plat. Commissioner Craig seconded the motion. Motion to approve carried 5:0. JOINT PUBLIC HEARINGS Mayor Pro-Tem Goodson called the Joint Public Hearings of July 16, 2001 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. planning Commission July 16,2001 File 1561 -P: Request for a specific use permit to allow a parking lot for a dental office in an RM-H (Residential Multiple Family Dwelling -Highest Density) District. Location: 3395 North Street at 18" Street Applicant: Mark Whiteley and Associates, Inc. Mr. Richardson stated that the proposed parking lot would be for 10 cars. Three dentists at 3313 North Street at IH-10 practice together and are in need of additional parking space. They have purchased the old two-story residence at 3395 North and will have it tom down. Ten parking spaces for employees will be constructed at the South or rear ofthe 140' x 1051 tract. Access will be by a driveway from 18d'Street. The front of the lots will be kept natural. An 8'tall screening fence will be installed along the south and east sides of the property. The site plan as submitted does not show a 10' wide landscape strip along the south and east sides of the parking lot or the 6' landscape strip on the north or west sides of the parking lot. If the parking lot is approved as submitted, a modification of the landscaping requirements need to be approved as well. Mr. Richardson recommended approval of the request with a modification of the landscaping requirements. A large majority of the property will be left in its natural state, so the parking lot should blend in with it. Sixteen notices were mailed to property owners within 200 feet of the subject area. No responses in favor or in opposition were returned. Slides of the subject area were shown. Chairman Leister opened the public• hearing and asked for the applicant's comments. Andy Duke, one of the dentists requesting the specific use permit, addressed the Commission. (Vice -Chairman Dykeman arrived.) Chairman Leister asked for comments in favor or in opposition. Mrs. Tullos, 3365 North, addressed the Commission in favor of the request. She did.ask for clarification of the type fence between the subject property and her M= P Planning Commission July 16.2001 (Mayor Moore arrived.) In response to Chairman Leister, Larry Sheppard of Mark Whiteley and Associates said the dentists have no other plans for the property other than the parking lot. The public hearing was closed. Commissioner Craig made a motion to approve the specific use permit to allow a parking lot for a dental office in an RM-H District at 3395 North Street with a modification of the landscaping requirements as requested in File 1561-P. Commissioner LaBiche seconded the motion. Motion to approve carried 6:0. 2) File I : Request for a zone change from A-R (Agricultural -Residential) and RS (Residential Single Family Dwelling) to RS, RM-H (Residential Multiple Family Dwelling -Highest Density) and GC-MD-2 (General Commercial -Multiple Family Dwelling-2) District for approximately 185 acres (5 tracts). Location: Folsom Drive and Major Drive Applicant: La -Tex Investors, Worth S. Moffett, III, et al Mr. Richardson stated that the subject property is located north of the Folsom Extension and east of Major. The property is being rezoned from AR and RS to RS, RM-H and GC-MD-2. Two pieces of the original 200 acre tract were rezoned earlier this year to RM-H and GC-MD-2 with a specific use permit. A concept plan, upon which today's zoning request is based, has been drawn up for the remaining 185 acres. The concept plan and zoning scheme call for RM-H and GC-MD-2 along Folsom and Major and buffering the 97.5 acres of RS located at the interior of the property. The plan, as submitted, is in compliance with the City's Comprehensive Plan. Mr. Richardson recommended approval of the request. Twenty-four notices were mailed to property owners within 200 feet. No responses in favor or in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Milt Prewitt, representing the applicant, addressed the Commission. 4 Planning Commission July 16.2001 Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Bodwin made a motion to approve the zone change from A-R to RS, RM-H and GC-MD-2 District for approximately 185 acres (5 tracts) on Folsom at Major Drive as requested in File 1562-Z. Commissioner LaBiche seconded the motion.* Motion to approve carried 6:0. 3) File 1563 : Request for a zone change from RS (Residential Single Family Dwelling) to RM-M (Residential Multiple Family Dwelling -Medium Density) District. 1.52 acres out of the D. Easley League. Location: 8010 Tram Road at Major Drive Applicant: Johnny and Melanie Babineaux Mr. Richardson stated that the applicants want to construct a total of 12 multi- family rental units on the property. This property is in an area that has seen little development in years. Mr. Richardson recommended approval of the request. Seven notices were mailed to property owners within 200 feet. No responses in favor and one in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Johnny Babineaux, the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner LaBiche made a motion to approve the zone change from RS to RM-M District for 1.52 acres out of the D. Easley League at 8010 Tram Road at Major Drive as requested in File 1563-Z. Commissioner Craig seconded the motion. Motion to approve carried 6:0. 4) File 1564-P: Request for a specific use permit to allow a charter school in a GC - MD (General Commercial -Multiple Family Dwelling) District. 1.14 acres out of the N. Tevis Survey, Tr. 59 and 59A, Plat C-6 Location: 209 N. I l' Street (leased space) Applicant: Brenda Lewis, Principal, Eagle Project 5 EM Planning Commission July 16.2001 Mr, Richardson stated that the applicant has requested a specific use permit to establish a charter school for high school students inside a 6,500 square foot lease space in an existing commercial building. The hours of operation will be from 8 a.m. to 2 p.m. Monday through Ffiday. The applicant states that 150-200 students will be enrolled. Mr. Richardson recommended approval of the request. Twelve notices were mailed to property owners -within 200 feet. No responses in favor or in opposition were returned. Slides of the subject area were shown. Mayor Pro -Tern Goodson inquired about parking space. Chairman Leister opened the public hearing and asked for the applicanti comments. Chuck Cook with Eagle Charter Schools in Lewisville, Texas, addressed the Commission and answered questions.. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Craig made a motion to approve a specific use permit to allow a charter school in a GC -MD District at 209 N. I Vh Street as requested in File 1564-P. Commissioner Bodwin seconded the motion. The motion to approve carried 6:0. File 15 : Request for a zone change from RM-H (Residential Multiple Family Dwelling -Highest Density) to GC -MD (General Commercial -Multiple Family Dwelling) or a more restrictive district. 34.849 acres out of the W. B. Dyches League. Location: West of Old Dowlen Road (abandoned) and north of Kroger Center Applicant: Mark Whiteley and Associates, Inc. for M. A. Phelan, II, Trustee Mr. Richardson told the Commission and Council that the subject request was spurred by the expansion of the retail development anchored by Kroger. The property immediately to the south was rezoned to GC -MD in 1998. As part of that rezoning, the subject property was rezoned RM-H. However, the change in land use.necessitates the need for a zone change. Mr. Richardson recommended approval of the request. Z Planning Commission July 16. 2001 Twelve notices were mailed to property owners within 200 feet. Two notices in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. Larry Sheppard with Mark Whiteley and Associates, the applicant, addressed the Commission. Lan Phelan with Phelan Properties addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner LaBiche made a motion to approve the zone change from RM-H to GC -MD District for 34.849 acres on Dowlen Road as requested in File 1565-Z. Commissioner Hallmark seconded the motion. Motion to approve carried 6:0. 6) File 1566-Z: Request for a zone change from RS (Residential Single Family Dwelling) to GC -MD (General Commercial -Multiple Family Dwelling) or a more restrictive district for 1.808 acres out of part of Bloc ' k 3, French Heights Addition. Location: North of E. Lucas Drive, east of Concord Road, behind H. E. B. Store Applicant: Fittz & Shipman, Inc. for Family Services of Southeast Texas Commissioner LaBiche recused himself from this case. Mr. Richardson told the Commission and Council the front portion of the subject property is already zoned GC -MD. Family Services of Southeast Texas has purchased this property and is planning to build 4-5 unit apartment buildings and then rent the apartments to qualified occupants. In addition to the apartments, other facilities will be built including a community center, playground, laundry room, etc. Mr. Richardson recommended approval of the request. Twenty-fournoticcs were mailed to property owners within 200 feet. No responses in opposition or in favor were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. W n Planning Commission July 16,2001 John Holm of Fittz and Shipman, the applicant, addrissed the Commission. Janett: Walker of Family Services addressed . the Commission. She said the apartments would be for women and children. Chairman Leister asked for comments in favor or in opposition. Mrs. Alpers, 5385 Pine Burr, addressed the Commission and asked about the privacy fence. The public hearing was closed. Commissioner Hallmark made a motion to approve a zone change from RS to GC - MD District for 1.808 acres north of E. Lucas Drive, cast of Concord Road, behind the H. E. B. Store as requested in File ' 1566-Z. Vice -Chairman Dykeman seconded the motion. Motion to approve carried 5:0: 1.
