SUBJECT: Request for a specific use permit for a daycare center in an RM-H (Residential
Multiple Family Dwelling -Highest Density) District at the northeast comer of
Buchanan and Cleveland.

STAFF REPORT
The Planning Manager recommends a conditional approval subject to: (1) A new site plan
be submitted showing a minimum of six off-street parking spaces; and (2) A modification
to the screening and landscaping requirements be approved by Council. The applicant is in
compliance with the six other conditions necessary for approval.
Rekeisha Lynn Ellis wishes to open a child care facility in a residence at 4210 Cleveland,
She will keep from 7 to 12 children under the ages of 14 years. She plans to be open from
6:00 a.m. to 5:00 p.m., Monday through Friday. She will not provide transportation.
The applicant is requesting a modification to the regulations of Section 30-31 (landscaping
and screening).

I am writing to apply for the Specific Use Permit to operate a Child
Care Center. At this facility, I will provide care for less than 24
hours a day for 7 to 12 children under the age of 14. As the owner
of this child care center, I am responsible for it's policies. I will
assure that the home operates in compliance with the Minimum
Standards for Child Care Centers and the child-care licensing.law,
Chapter 42, Human Resources Code.
In the operation of the child care center I will provide activities for
children according to their ages, interests, and abilities. The
activites will be appropriate to each child's health, safety, and
well-being. The activities also will be flexible and promote each
child's physical, emotional, social, and mental growth. For
example, when there is a 4 year old child enrolled, there will be a
Preschool curriculum offered for early childhood education. I am
required to serve food that is nutritious and is served in variety and
amounts adequate to ensure growth and development. There will
be rest periods for the children after their meals. There will also be
outdoor time each day that the weather permits. I plan to operate
from 6:00 am to 5:00 pm. Since I do not provide transportation,
parents will drop off and pick up their children.
As a mother and having experience working with children, opening
this child care center is a dream come true and it is a way for me to
help our community grow by providing care for working parents
with children. Also to help nurture the children of our future to be
potential assets to our community. I plan to attend Lamar
University to further my education and obtain my director's license
to operate a day care center. A daycare center is a child care
facility that provides care for less than 24 hours for more than 12
children under the age of 14. Believing that I would have success,
I do plan to build on my property.
To address the conditions under the zoning ordinance, the area and
size of my property makes it compatible with and not injurious to
the use and enjoyment of other property. The opening of this child
care center will increase property values within this area.
According to the real estate business, in the decision making of
buying a home, when there are schools, daycares, and stores in a
neighborhood it increases the value of the homes in that area. The
establishment of this child care center will not impede the normal
and orderly development just because of the history of the
Elementary school that's been in the neighborhood for years. I
have researched with the Health and Fire Departments to provide a
healthy and safe environment for the children, and to eliminate any
offences with my neighbors. Yolanda G. Duriso, a Registered
Sanitarian from the Public Health Department informed me of the
minimum requirements for food establishments which includes all
the utilities and supplies needed. And R.W. "Duce" Jones, an
Inspector/investigator from the Beaumont Fire/Rescue Services
inspected my home and informed me of the supplies I need to pass
inspection. Concerning driveways and parking spaces, I have two
driveways plus parking space on my property by the side street
Buchanan that does not have busy traffic. Parking space on my
property can hold up to 12 cars, but because parents are dropping
off and picking up, all the space will not be used at one time. This
extra space ensures that there will continue to be harmony and
compatibility with adjacent property. Finally, the property is
fenced, so the children will be safe and there will not be
disturbances to any of the neighbors. Overall, I strongly believe
the Child Care Center meets the zoning conditions because of the
size and area of my property.

am planning to open a Croup Day Care Home in my home. A
Croup Day Care Home is a facility that provides care for less than
24 hours a day for 7 to 12 children under the age of 14. In order to
open the daycare, I need a Specific Use Permit issued by the
Planning Commission and the City Council of Beaumont, Texas. I
am earnestly asking for your approval and support. By signing,

This application is in compliance with six of the eight conditions necessary for approval.
Comments on items #4 and #7 follow:
4. The site plan submitted by the applicant does not show an off-street parking plan.
The Traffic Manager states that there should be six (6) off-street parking spaces on
the subject property. She will need a revised site plan approved by the Traffic
Division prior to any permits being issued,
7. The site plan does not address any screening or landscaping. However, the applicant
owns the lot immediately to the north of the subject lot and plans to move into a
house (4230 Cleveland) already on the lot if the specific use permit is granted. She
also owns the 3 lots that front on Buchanan which lie east of and next to the subject
lot. She asks that the landscape and screening requirements be modified to what is
existing. There is a chain link fence around the lot and the property contains several
oak and magnolia trees. The three vacant lots are heavily wooded.
