SUBJECT: Request for two variances concerning minimum lot depth and lot width. Replat of
Lot 3 and half of Lot 4, Block 7, Park Place Addition.

STAFF REPORT
The Planning Manager recommends approval of the depth variance for proposed Lot 3A and
the width variance for proposed Lot 3B.
The replat of Lot 3 and the east 25 feet of Lot 4, Block 7, Park Place Addition into Lots 3A
and 3B necessitates two variances. The lots are zoned RS (Residential Single Family
Dwelling) District.
There is a large house in the front of the property broken up into four apartments. There is
a garage apartment in the rear. The property is being sold to satisfy debt.
Lot 3A contains 5,354.5 square feet which exceeds the 5,000 square foot minimum. This lot
contains the four unit apartment structure. Lot 3B contains 5,791 square feet. This lot is the
site of the garage apartment.
The Zoning Ordinance requires lots in the RS District to have minimum widths of 50 feet
and depths of 100 feet. Lot 3A has an average depth of 89.765 feet. Lot 3B has a 15 foot
wide width at Palm Avenue which extends south 90.56 feet where it clears the south rear lot
line of Lot 3A. At this point the lot width is 74.66 feet.
Lot 3A needs a variance as to depth and Lot 3B needs a variance as to lot width. These may
be granted by the Commission under the regulations of Section 24-30 of the Subdivision
Ordinance.
A portion of Section 24-30 is printed here for the Commission:
Section 24-30. Variances, exceptions and appeals.
(a) (1) Where the Planning Commission finds that
extraordinary hardships or practical difficulties may
result from strict compliance with these regulations or
that public interest may be served by an alternative
proposal, it may approve variances to these
subdivision regulations so that substantial justice may
be done and the public interest secured provided that
such variances shall not have the effect of nullifying
the general intent and purpose of these regulations;
and further provided that the Planning Commission
shall not approve variances unless it shall make
findings based upon the evidence presented to it in
each specific case that:
(a) The granting of the variance will not be
detrimental to the public safety, health, or
welfare or injurious to other property.
(b) The conditions upon which the request for a
variance is based are unique to the property
for which the variance is sought and are not
applicable.
(c) Because of the particular physical
surroundings, shape or topographical
conditions of the specific property involved, a
particular hardship to the owner would result,
as distinguished from a mere inconvenience,
if the strict terms of these regulations are
enforced.
(d) The variance will not in any significant way
vary the provisions of the Zoning Ordinance,
Zoning Map, or Comprehensive Plan.
Copies of the plat were sent to interested parties. No objections were received.

Attached is a Replat of Lot 3 and the East 25' of Lot 4, Block 7, Park Place Addition..
This plat is being submitted as a replat to relocate the property line of the property.
The property is presently served by water and sewer facilities located along Palm Avenue
and Pershing Avenue. The replat will create two lots which do not meet the minimum lot
sizes described in the City of Beaumont Zoning Ordinance and the owner is asking for a
waiver of these requirements.
Forwarded to your office are two (2) mylar sepias of the replat, 25 blue line prints of the
replat, tax certificate of the subject tract, and a 3.5" disk with a dxf file of the replat.

With this application, awaiver of the minimum lot and depth requirements as referenced
in Section 24-18 of the City of Beaumont Subdivision Regulations. These requirements
are outii=4 in Section 30.25 B of the City of Beaumont Zoning Ordinance (Area and
Height Regulations). The following waivers are being requested;
Lot 3A
The lot exceeds the minimum area requirements and minimum lot width
requirements however it is only 90.5 feet in depth (minim, urn required is
100 feet). 'A waiver of the miaimu:n lot depth is being requested.
Lot 38
The lot exceeds the minimum area requirements however, at the lots
midpoint, the lot is only 15 feet in width. The rear 1/3 of the lot does
comply with the minimum lot width, requirements and the lot exceeds 100
feet in depth. The, waiver of the minimum lot depth is being requested. ,
