STAFF REPORT
The Planning Manager recommends approval of the specific use permit request subject to
a requirement that vehicles transporting swim students not block driveways or the street
pavements in the immediate neighborhood.
Marilyn Higgins and her friend Stacey Hansard teach swimming lessons in a pool located
in the backyard of Rusty Hall's home at 2608 Hazel. The hours for teaching are 9:00 a.m.
to 5:00 p.m., Monday through Thursday. They teach from June to the first week in August.
There are seven classes per day of 6-7 students in each class.

The property located at 2608 Hazel will be used for teaching swim lessons in the
backyard pool during the months of June and July. Hours of teaching lessons
are 9:00A.M, to 5:00 P.M., Monday through Thursday. Lessons are taught by
Marilyn Higgins and Stacey Hansard.
The property has afour(4) car parking apron off of Ili" Street which is an asphalt
street with drain ditches. The front of the property faces Hazel(which is curb and
gutter with a sidewalk).
The back yard has an existing six(6) foot wood fence that offers security and
privacy.
Parents bring children for lessons on the hour, either dropping them off or briefly
bringing them in. Parents do not stay so there are no cars parked on the street
for longer thanfive(5) minutes. There are no signs involved with these lessons.
There is no offensive odor, fumes, dust, noise or vibrations involved with swim
lessons. The pool is maintained in pristine condition and the quality of the water
is constantly checked.
The property (pool) has been used for the purpose of teaching swim lessons since
the early 1960s. Mr. Moody Pickett taught swim lessons here for approximately
thirty (30) years until his deteriorating health denied him this pleasure. Many
current student's parents enjoyed lessons in this pool. It would be a shame not to
be able to continue this tradition. There is no reason that these lessons would
affect anyone in the immediate neighborhood in a negative way.

This application complies with the eight conditions necessary for approval. A comment on
item 4 follows:
4) There have been complaints from neighbors regarding parking in the immediate
vicinity of 2608 Hazel. The Planning Manager will recommend approval subject to
the applicant and homeowner making sure that all loading and unloading of children
(swim students) is done in a safe manner and that cars not block the Hazel or Tenth
Street traffic lanes or block the driveways of other homeowners in the immediate
area. Otherwise, "no parking" signs on Hazel and 10"' will be considered by the City
Traffic Division.
