Richardson, Planning Manager SUBJECT: Request for a specific use permit to allow the conversion of a residential care facility into a 3-unit apartment house in an RCR (Residential Conservation and Revitalization) District at 2390 Broadway at 8"' Street. FILE: 1580-P STAFF REPORT The Planning Manager recommends approval of the request. This application is in compliance with the 8 conditions necessary for approval of a specific use permit. Judith Rich received a specific use permit in 1997 to convert a 1,970 square foot 2-story home into a residential care facility for 15 clients. She brought the property into compliance with the specific use permit regulations and conditions at that time regarding parking, screening, etc, The care facility did not meet the expectations of Mrs. Rich and she discontinued the operation just recently. She now wishes to change the format of the structure to allow 3 apartments. No exterior changes are being proposed. Multi -family uses (3 or more units) in an RCR district require a specific use permit. Exhibits are attached. I was unable make this business Profitable. I have invested a lot time and money in this neighborhood. So, I would like to turn this building in to a multi family units (3). This is the only way that I can get any return on my investment, without taking a lost. I am committed to satisfying all legal requirements and want to work with the neighbors and city to reach a mutually acceptable solution. This small business Will family owned and operated. We foresee this apartments being a great asset to the Community, giving them the opportunity to live in a homelike environment. The primary use of the property will be for three single-family dwellings. In regards to the eight zoning ordinance requirements, New Beginning Apartments as a business will not diminish, or impair property values within its vicinity. There are many businesses surrounding the proposed location. Businesses in the area include: home health agencies, business offices, and apartments, ect. Adequate utilities and drainage are provided. There is an adequate amount of parking space for the safe and convenient movement of vehicular and pedestrian traffic without adversely affecting the public or adjacent developments. Measures have been taken to control offensive orders and noises. There is sufficient landscaping and screening to ensure harmony and compatibility with adjacent property. Screening includes fencing and trees. We would appreciate your consideration in this matter and our cooperation as to the necessary requirements.
