Street and (3) a 60' x 260'portion of the street right-of-way of Cunningham Street,

STAFF REPORT
The Planning Manager recommends approval of the request to abandon portions of Alabama
Avenue, Cheek Street and Cunningham Street subject to the moving of all utilities at Lamar's
expense or the retainment of the necessary utility and drainage easements,
Lamar University is presently in the process of constructing a second 526-unit student housing
complex on the south side of Alabama. To provide access to these accommodations, Lamar
University is proposing to construct an access entrance to the complex in the present Cheek
Street right-of-way. This access entrance would join the two complexes. Lamar University
owns all the property on both sides of the road right-of-way for each portion that is to be
abandoned.
Cheek and Cunningham Streets, from Alabama north and Alabama Avenue from Cunningham
Street east have previously been abandoned.
The Traffic Manager recommended that the most western portion of Alabama be abandoned
as well. However, an apartment complex located on the northeast comer of University and
Alabama has access to that portion of Alabama.
Lamar University understands and agrees to the City of Beaumont retaining the subject rights -
of -way as utility and drainage easements.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
1) Being a 60'x 1,193. Pportion of Alabama Avenue, beginning at the east right-of-way
line of Cunningham Street and extending west a distance of 1,193.1 feet to the
southeast comer of Lot 21, Block 15 and the northeast comer of Lot 1, Block 18,
Lama• Addition.
2) Being a 60'x 260'portion of Check Street, beginning at the north right-of-way line of
Georgia Street and extending north a distance of 260 feet to the south right-of-way line
of Alabama Avenue.
3) Being a 60'x 260'portion of Cunningham Street, beginning at the north right-of-way
line of Georgia Street and extending north a distance of 260 feet to tile south right-of-
way line of Alabama Avenue,

REP Abandonment of a portion of
Alabama, Cunningham and Cheek Street ROW
Dear Sir:
Lamar University is presently in the process of constructing a second 526-unit student -housing
complex on the south side of Alabama Street for students who attend Lamar University. To
provide access to these accommodations Lamar University is proposing to construction an access
entrance to the complex in the present Cheek Street ROW. This access entrance would join the
two complexes.
Cheek and Cunningham Streets form Alabama Street north, Alabama Street from Cunningham
Street east have been abandoned previous City Ordinances.
To keep with Lamar University's scheme of providing traffic control and security for the students,
Lamar University requests that the City of Beaumont abandon the portions of Alabama,
Cunningham, and Cheek Street. It is understood and agreed that City of Beaumont is to retain the
right of way as easements for the utilities that are presently located within them. Lamar University
owns all the property on both sides of the road right of way for each portion that is to be
abandoned.
Please process this request and place it upon the earliest available agenda for approval by the City
Council.
