Richardson, Planning 'Manager SUBJECT: Request to abandon the 10' x 10 l ,24' utility easement situated along the northerly side of Lot 3, Bled 1, Glen !Oaks Addition at 4665 Glen Oaks Circle,_ FILE a 606-013 STAFF REPQRT The Planning Manager recommends approval of the requestsubject to the property owner entering into a contract with Southwestern Bell Telephone Company to relocate the existing phone cable and granting a new easement at his expense, The Glen Oaks Subdivision extends to the southeast off Comstock Road in north Beaumont. The applicant, Mr, "Thibodeaux, lives at 6180 Comstock on a 0.64 acre tract. His residential tract abuts and wraps around the north and west side of the subject Lot 38 which is the last numbered lot in the subdivision. He plans to build a single family structure on the lot but needs more width for the one-story house. He is asking for the abandonment of the 10' wide casement. That done, he would provide the normal S' wide building setback on the north side of the lot. A memorandum explaining the request was sent out to interested departments and utility, companies. Southwestern Bell Telephone Company has a cable line in the easement. The engineering division of the phone company says that the cable can be relocated at the expense of the applicant. Mr. Thibodeaux owns the land abutting the easement and has verbally agreed to grant a new easement for the phone company on his residential tract, .mmµ Exhibits are attached. Being a ten feat (10') wide dedicated utility easement lying along the northwesterly side o Lot 38, Block 1, Glen Oaks Addition to the City of Beaumont, Jefferson County, Texas, as shown on said subdivision plat filed for record in the Map Records of Jefferson County on August 9, 1978 in "Volume 12, Page 90, said utility easement being more particularly described as follows, For point of beginning start in the most northwesterly corner of Lot 38, Block 1, Glen Oaks Addition, same being in the southwest right-of-way Brae of Glen Oaks Circle, a 50 foot :wide public street right-of-way; thence S. 50 ° 27. along the northwesterly line of said Lot 38, Black 1, Glen Oaks Addition a distance of 101.24 feet to a point for corner, thence southeast a distance of 10 feet to a point for comer, thence N. 50 ° 27' E. a distance of 101.24 feet to a point for corner in the southwest right-of-way Brie of said Glen Oaks Circle; thence northwest along the southwest right-of-way line of Glen Oaks Circle a distance of 10 feet to the point of beginning, containing;0.0232 acres, more or less. `N 1 N.Ta-0111ky, M UM I I ar rJ1 The utility easement I desire to have abandoned, is the last lot in the Glen Oaks Addition, in the north end of Beaumont, being block 1, lot 38, or 4665 Glen Oaks Cr., and adjoining my residential homestead lot. The lot is 60' wide, and the addition has a 10' easement on the north side, running full length of the lot, which is the end, or last lot of the addition. No utilities have ever used this easement in the past 18 years that I have owned the lot. I would like to build a house on it, but to build one comparable to the adjoining homes, 50 feet is too narrow. I would appreciate your cordial consideration, to abandon this easement since it should not presents any problems to anyone. I own the property on both sides of the easement. There are storm inlets in Glen Oaks. Water drains south out of the addition into a DD#6 outfall. There is a 6" water line in the street. There is an 8" sanitary sewer in the street. Fire protection is provided by Station #8, Highway 105 and Lampman. Existing utilities and services are adequate.
