Bonczek, City Manager F-11:2 U IffaITI-1 Lai Commissioner Bodwin made a motion to approve the minutes ofthe Joint Public Hearing held December 18, 2000. Commissioner Robinson seconded the motion. Motion to approve carried 5:0. Planning Commission January 17. 2001 REGULAR MEETING 1) Preliminary Replat of Block 43, Calder Addition: Consider the Preliminary Replat of Block 43, Calder Addition, Lots 1-12 into Lots 1 -10. Applicant-, Fittz and Shipman, Inc. Mr. Duren stated that the subject location for a replat is the former site of the Dick Dowling High School. The City owns the property and will transfer the replatted to one or more CHDO's for the purpose of constructing single family homes. This property was rezoned from GC -MD to RS in October, 2000. The replat will decrease the number of lots from 12 to 10 in order to provide for larger lots. The replat was distributed to all interested parties and addressed all the concerns submitted. Mr. Duren recommended approval of the replat. Commissioner Lucas, acting as Chairman, asked for the applicant's comments. John Holm of Fittz and Shipman, Inc., the applicant, addressed the Commission. Commissioner Robinson made a motion to approve the Preliminary Replatof Block 43, Calder Addition, Lots 1-12 into Lots 1-10 as submitted. Commissioner Hernandez seconded the motion. Motion to approve carried 5:0. 2) Preliminary Plat of Barrington Heights. Phasi-, TV: Consider the Preliminary Plat of Barrington Heights, Phase IV, Lots 41-74, Block 3, H. Williams Survey, Ab-56. Applicant: Carroll and Blackman, Inc. Mr. Duren stated that the subject request is for a preliminary plat of a 10 acre, 34 lot, single family residential subdiv—isio'n south of Barrington Heights, Phase 11. Richard Gusernan proposes the constructiQu of homes that would front on two cul- de-sac streets. Lot widths will vary from 75' to 92' with a typical depth of 120'. This property is currently zoned A-R. In this zoning classification, minimum lot size is one acre. Mr. Guseman also has a zone change request for this property to be presented later in the meeting. N Planning Commission January 17. 2001 Engineering has required pavement section design submitted as part of the preliminary plat approval. The consulting engineer is in the process of providing that information to the City. Mr. Duren recommended conditional approval subject to the property being rezoned to RS and meeting the water and paving requirements. Commissioner Lucas asked for the applicant's comments. Joe Pattie with Carroll and Blackman, Inc. addressed the Commission. Commissioner Craig made a motion to approve the Preliminary Plat of Barrington Heights, Phase IV as submitted. Commissioner Robinson seconded the motion. Motion to approve carried 5:0. MUld" M111 Mayor Pro-Tem Goodson called the Joint Public Hearings of January 17, 2001 to order and explained the purpose of the joint hearing process and then turned the meeting over to Commissioner Lucas. He explained the policies and procedures for the hearing process. 1) File 1.537- : Request for a zone change from A-R (Agricultural -Residential) to RS (Residential Single Family Dwelling) District. Location: Adjacent to Barrington Heights Addition, Phase 11 (10.038 acres, Phase IV) Applicant: Richard Guseman, Talisman Development Company Mr. Richardson told the Commission and Council that the subject request is fora zone change from A-R to RS for 10.381 acres of land known as Barrington Heights, Phase IV. With the rezoning, 34 new single family lots will be created. Mr. Richardson recommended approval of the request. Ten notices were mailed to property owners within 200 feet. Two responses in favor and none in opposition were returned. Slides of the subject property were shown. Commissioner Lucas opened the public hearing and asked for the applicant's comments. The applicant was not present. Commissioner Lucas asked for comments id favor or in opposition. No comments were made. The public hearing was closed. Planning Commission January 17, 2001 Commissioner Craig. made a motion to approve the zone change from A-R to RS for 10.381 acres adjacent to Barrington Heights Addition, Phase II as requested in File 1537-Z, Commissioner Bodwin seconded the motion. Motion to approve carried 5:0. 2) File 1538- ' Request for a specific use permit in a GC -MD (General Commercial - Multiple Family Dwelling) District to allow the on premise sale of alcoholic beverages in an existing arcade and pool hall. Location: 2820 Washington Boulevard at San Jacinto Applicant: Thao Nguyen Mr. Richardson stated that the specific use permit request is to allow the on site sale of beer and wine at the Washington Arcade and Pool Parlor at 2820 Washington. The business currently operates in the Jewel Plaza along with a washateria, beauty shop and music store. The property is zoned GC -MD. Surrounding land uses include several restaurants, a gas station, a check cashing service as well as other businesses. Mr. Richardson recommended approval of the request. Sixteen notices were mailed to property owners within 200 feet. One response in favor and one in opposition were returned. Slides of the subject property were shown. Commissioner Lucas opened the public hearing and asked for the applicant's comments. Thao Nguyen, the applicant, addressed the Commission and answered questions concerning hours of operation. Commissioner Lucas asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Robinson made a motion to approve the specific use permit in a GC - MD District to allow the on premise sale. of alcoholic beverages in an existing arcade and pool hall at 2820 Washington Boulevard as requested in File 1538-P. Commissioner Craig seconded the motion. Motion to approve carried 5:0. 3) File 1539-P: Request for a specific use permit to allow a furniture upholstery and repair shop in an RCR (Residential Conservation and Revitalization) District in an existing structure. Location: 835 Jefferson at Wall Street (existing Quonset hut) Applicant: Helen Thomas Planning Commission January 17, 2001 Mr. Richardson stated that the applicant wants to restore furniture for her persona i needs. As stated by the applicant, this will not be a business open to the public. Activity will only occur during daylight hours during weekdays. The surrounding property is either vacant or occupied by other businesses and St. Anthony Cathedral. Mr. Richardson recommended approval of the request. Twenty-seven notices were mailed to property owners within 200 feet. Three responses in favor and one in opposition were returned. Slides of the subject property were shown. Commissioner Lucas asked for the applicant's comments. Helen Thomas, the applicant, addressed the Commission. Commissioner Lucas asked for comments in favor or in opposition. Martin Scott, Administrator of St. Anthony Cathedral, addressed the Commission. Rebuttal by Ms. Thomas. Commissioner Bodwin made a motion to approve the specific use permit to allow a furniture upholstery and repair shop in an RCR District in an existing structure at 835 Jefferson as requested in File 1539-P. Commissioner Craig seconded the motion. Motion to approve carried 5:0. 4) File 1540-Z: Request for a zone change from GC -MD (General Commercial - Multiple Family Dwelling) to RS (Residential Single Family Dwelling) District. Location: 1102 North Street at Forrest Street (2 V2 lots) Applicant: Carlos B. Zuniga Mr. Richardson told the Commission and Council that the applicant wants to build a new home at the northwest comer of North and Forrest Street. GC -MD zoning does not allow new single family construction. The City has done some rezoning of commercially zoned properties to single family recently in the area. Mr. Richardson recommended approval of the request. Twenty-one notices were mailed to property owners within 200 feet One response in opposition and none in favor were returned. Joshua Harris and Clyde Swint of United Built Homes addressed the Commission. Commissioner Lucas asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Craig made a motion to approve the zone change from GC -MD to RS for the property at 1102 North at Forrest Street as requested in File 1540-Z. Commissioner Hernandez seconded the motion. Motion to approve carried 5:0. 5) File 154 1 -P: Request for a specific use permit to allow a home inspection service office and a pest control business in an existing 2-story building in an RCR (Residential Conservation and Revitalization) District. Location: 2346 Broadway Applicant: Kenneth and Suzanne Carr Mr. Richardson told the Commission and Council that the applicants want to convert a two-story apartment house into offices for a home real estate inspection service company and residential pest control business. The applicants state that all of their business is conducted in the field. The only traffic to the office is employees. They have four full-time and two part-time employees. The applicants are requesting a waiver of the ten foot landscape strip along the east property line. Because of existing driveways, there is little room to put the landscape strip. They propose to build an eight foot wood screening fence. Mr. Richardson recommended approval of this request along with the waiver of the ten foot landscape strip along the.=t property line. Twenty-two notices were mailed to property owners within 200 feet. Three notices in favor and none in opposition were returned. Slides of the subject property were shown. Commissioner Lucas opened the public hearing and asked for the applicant's comments. Kenneth Carr, the applicant, addressed the Commission.
