Dwelling-2) to GC -MD (General Commercial -Multiple Family Dwelling) District
for a 3.2189 acre tract.

STAFF REPORT
The Planning Manager recommends approval of the zone change request to GC -MD. In
October of 1999, the City Council rezoned a 24.82 acre tract to GC -MD and the remaining
15.72 acres to GC-MD-2. The subject tract is located along the northeast part of tile GC-
MD-2 zoned tract.
The applicants have secured contracts on 3.2189 acres of land fronting on Dowlen Road.
However, one of the proposed pad sites and building is split between GC -MD and GC-MD-2
zoning. The retail buyers of the pad sites wish to have all of their property within GC -MD,
Dowlen is a major arterial. The proposal lies across the street'from a church and a future
office development site.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
BEING a 3.2189 acre tract or parcel of land situated in the Hezekiah Williams Survey,
Abstract No. 56, Jefferson County, Texas and being out of and part of that certain called
680.66 acre tract called "Second Tract" as conveyed by Treadaway Land Company et al. to
Yount -Lee Oil Company as recorded in Volume 374, Page 113, Deed Records, Jefferson
County, Texas and also being out of and part of that certain called 40.5391 acre tract of land
as conveyed by Amoco Production Company to Dowdel Investments, Ltd. as recorded in
Clerk's File No. 1999047799, Official Public Records of Real Property, Jefferson County,
Texas, said 3.2189 acre tract being more particularly described as follows:

COMMENCING at a 5/8" iron rod found for the Northeast corner of the above referenced
40.5391 acre Dowdel Investments, Ltd. tract, said corner also being the Southeast corner of
Barrington Heights, Phase 1, a subdivision of the City of Beaumont, Jefferson County, Texas,
according to the map or plat thereof, recorded in Volume 15, Page 348, Map Records,
Jefferson County, Texas and also being in the West right-of-way line of Dowlen road (based
on a width of 100 feet);
THENCE South 01 024'09" EAST, along and with the West right-of-way line of Dowlen
Road, for a distance of 220.00 feet to the Northeast comer and the POINT OF
BEGINNING of the tract herein described;
THENCE South 01 0 24'09" EAST, continuing along and with the West right-of-way line
of Dowlen Road, for a distance of 563.12 feet to a point for corner, said comer being the
Northeast comer of that certain called 24.8240 acre tract zoned GC -MD as recorded in the

Located on the West side of the 3000 Block of Dowlen Road
Beaumont, Texas
Dear Mr. Richardson:
Enclosed please find a completed APPLICATION FOR AMENDMENT OF THE ZONING
ORDINANCE, Beaumont, Texas for the property referenced above. Dowdel
Investments, Ltd., is requesting that the District Regulations in the City of Beaumont
Zoning Ordinance be changed from GC-MD-2 (General Commercial - Multiple Family
Dwelling-2) to GC -MD (General Commercial - Multiple Family Dwelling) with
regards to the above referenced tract.
As part of the due diligence and feasibility studies on this tract of land, I have reviewed
the Comprehensive Plan Report adopted by the City Council in 1982 to determine the
development plans for this tract. The Major Street and Highway Element of the
Comprehensive Plan Report indicates that the intersection of Dowlen Road and
Delaware Street is to be considered as major arterial streets. The Land Use Element of
the Comprehensive Plan Report has the above referenced tract shown as a District
Center which includes shopping centers, professional offices, recreational facilities,
Junior High Schools, churches, branch libraries, fire station and higher density
residential development.
We are currently developing a Forty (40) acre tract of land into a number of One (1)
acre to One and a Half (1 1/2) acre +/- pad -site tracts located on Dowlen Road with a
number of Big Box users for the remaining land that is east of Barrington Heights
Residential Subdivision. Starship Hallmark Card Shops and Alter's Gem Jewelry have
signed a contract to purchase Tract #2 and Tract #3, subject to all of the land covered
in the contract being completely zoned GC -MD not GC-MD-2 requiring a specific use
permit. Currently the zoning of Tract #3 is split, one-third GC -MD and two-thirds GC-

MD-2. All of Tract #1 and Tract #2 are currently zoned GC-MD-2. The prospective
buyers (Starship Hallmark Card Shops and Alter's Gem Jewelry) want continuous GC -
MD zoning.
