Richardson, Planning Manager SUBJECT: Request to abandon the 20'wide alley lying across Block 59 of the Van Wormer Addition. FILE: 611-013 STAFF REPORT The Planning Manager recommends approval of the request to close the alley. Mr. Eduardo Lugo owns a landscape and irrigation business. He purchased all of Block 59, Van Wormer Addition from the Oxford family. This is save and except those parts of said block being in the Kansas City Railroad right-of-way. The alley extends from Avenue B east to the railroad right-of-way. The block is vacant and is zoned LI (Light Industrial) District. There were no objections to the request from those interested parties contacted by the Planning staff. No utility easements need to be retained. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES A 20 foot wide alley right-of-way extending northeast from the northeasterly right-of-way line of Avenue "B", a 60 foot wide street right-of-way, to the south line of the KCS Railroad right-of-way. Said alley is bound on the north by Lots 5 and 6, Block 59, Van Wormer Addition and bound on the south by Lots 7, 8 and 9, Block 59, said addition, containing 0.049 acres, more or less. Abandonment of Utility Easement I, Eduardo Lugo, am requesting the abandonment of the des- cribed utility easement on the attached copy of the surve- yed property. The utility easement will be used as part of the yard surrounding the new building. This building will be used for storage of equipment rela- ted to my landscape and irrigation business. This request is being made because current property lines prevent the construction of the building in the intented lo- cation.
