SUBJECT: Request for a zone change from A-R (Agricultural -Residential.) to GC -MD (General
Commercial -Multiple Family Dwelling) District for a vacant 11 acre tract of land
located approximately 1,592 feet north of Folsom Drive.

The Planning Manager recommends denial of this zone change. The GC -MD district allows
almost all retail and set -vice businesses. The land on the sides is vacant and there are single
family residences situated west of the site. Commercial centers should be located at the
intersections of major streets. This could be considered a "spot zone" since all surrounding
zoning is A-R or RM-H.
The request is to enable the applicant to construct 150 apartment units on seven acres and
develop a retail commercial strip on the remaining four acres. Land on the cast side of N.
Major (FM 364) is vacant farm land. Located across Major to the west is an apartment
complex and a single family subdivision (Westhaven Terrace).

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
That certain 11.1 acre tract out of the W.B. Dyches Survey, Abstract 17, Jefferson County,
Texas and being out of the 200,686 acre tract conveyed to Latex Investors, LP as recorded
in Clerks File No. 2000021770 of the Official Public Records of Real Property of Jefferson
County, Texas said 11.1 acres being more particularly described by metes and bounds as
follows:

COMMENCING at a 3/4" iron rod found in the east right-of-way line of North Major Drive
for the northwest comer of the remainder of a 42.87 acre tract conveyed to First Baptist
Church as recorded in Clerks File No. 94-9423309 of the Official Public Records of Real
Property Jefferson County, Texas being the most northerly southwest corner of the said
200.686 acre tract;
THENCE North 02'49'37" West along the said cast right-of-way line of North Major Drive,
a distance of 40.00 feet (called North 02'49'37" West) to a V? capped iron rod set in the
north line of a proposed 40 foot wide DD6 right-of-way for the southwest comer of the said
11.1 acre tract and the POINT OF BEGINNING;
THENCE North 02' 4937" West continuing along the said east right-of-way line of North
Major Drive, a distance of 450,16 feet (called North 02' 49'37" West) to a Y2" capped iron
rod set for the northwest comer of the said 11.1 acre tract;
THENCE North 87' 09'40" East, a distance of 1073.99 feet to a Y2" capped iron rod set in
the west line of a proposed 50 foot wide DD6 right-of-way for the northeast comer of the
said 11.1 acre tract;
THENCE South 02' 50'41" East along the said west line of the proposed 50 foot wide DD6
right-of-way, a distance of 450.16 feet to a Y? capped iron rod set at the intersection of the
said north line of the proposed 40 foot wide DD6 right-of-way for the southeast comer of the
said 11.1 acre tract;
THENCE South 870 09'40" West along the said north line of the proposed 40 foot wide
DD6 right-of-way a distance of 1074.13 feet to the POINT OF BEGINNING and containing
11.1 acres of land, more or less.

RE: Request for the re -zoning on an eleven -plus acre site fronting FM 364 (Major
Drive), close to the Folsom Road intersection. A location map is attached for
your reference.
Gentlemen:
Please accept this letter as our request for the Planning Commission to re -zone the
captioned property from agricultural use to multi -family (24+ units to an acre) and
commercial use (GC -MD). The reason for the request is that this area of Beaumont is
transgressing from farmland to residential/commercial use. It is our intent to develop this
eleven -plus acre site fronting Fm 364 (Major Drive) into an apartment project containing
150 units; which would consume approximately seven acres of the eleven acre site. On
the remaining four acres, we plan to develop into a service station, fast food or retail site.
The four acre commercial site would front FM 364. We would begin development plans
pending your approval of our re -zoning request. Should you require any further
