Richardson, Planning Manager SUBJECT: Request for a zone change from RM-H (Residential Multiple Family Dwelling - Highest Density) to PUD (Planned Unit Development) District for a 12.01 acre tract lying in the 3300 block of Dowlen Road. FILE: 1552-Z STAFF REPORT The Planning Manager recommends approval of the rezoning of the property to PUD (Planned Unit Development) District. The applicant's letter states that the owners want to amend the zoning..."to a PUD in order to allow some flexibility to compliment the office setting." PUD districts allow mixed residential, commercial and office land uses. Other requirements to develop a PUD include specific use permits for any use other than single family residential. A PUD must contain at least five acres of land. Buildings shall not exceed 35' in height without authorization from the City Council. There is a 25'building setback required around the entire tract. The land use plan, as required by the Zoning Ordinance, lists the proposed general land uses. These uses include holding and investment offices, real estate offices, insurance agency offices, professional business offices, doctor or dental offices, legal services, mortgage company offices, book store, jewelry store, apparel boutique and gourmet coffee shop. This 12.01 acre tract was rezoned to RM-H from RS in October of 1999. Also approved was a specific use permit for eight professional office buildings. To date, three building permits have been issued for three buildings. The original specific use permit site plan called for eight buildings. The current request shows six buildings. Dowlen Road. 2) Exhibits: "A" -Location map; "B'-Proposed zoning and existing zoning of adjoining properties; and "C'�-Land Use Plan (2 full size and I reduced copy) for phased development of this project (under construction). 3) Original survey of the subject tract from July of 1999. 4) Field note description of the subject tract (also shown on the survey). 5) Application fee (check no. 6179) for $500.00 The zoning for the subject property was amended in October of 1999 to an RM-H district and was accompanied by a specific use permit to construct an upscale professional/business office complex. The Tuscany Park project is currently under construction and will be completed in two phases comprised of six (6) stand alone buildings. At this time, the applicant/owner requests through submittal of the above, consideration to amend the zoning of this site to a PUD in order to allow some flexibility to compliment the office setting. Richardson, AICP Planning Manager 23 February 2001 Page 2 of 2 an amendment in zoning to a Planned Unit Development (PUD), the site would be platted into lots and common areas as illustrated on the attached Land Use Plan in accordance with the City's Zoning Ordinance, Section 30-29. The general appearance of the buildings will include a variety of exterior finishes and designs accented with ornamental lighting and detailed landscaping, Median modifications have recently been completed on Dowlen Road to balance access to and from the site. Buffers and fencing will be added per requirements of the existing Specific Use Permit. Easements for public utilities would be dedicated as necessary as a part of the platting work for the overall project. On behalf of the applicant, we request consideration of the attached and trust that this request will meet with favorable approval by both the Planning Commission and City Council at the Joint Public Hearing scheduled for March 19'. PUD, Planned Unit Development District Regulations General Purpose and De )Nr- and Description: The purpose of the PUD, Planned Unit Development District, is to encourage the unified design of residential, commercial, office, professional services, retail and institutional uses and facilities or combinations thereof in accordance with an approved comprehensive development plan. This district provides for greater flexibility in the design of buildings, yards, courts, and circulation than provided by other districts. Permitted Uses: Uges permitted in a PUD, Planned Unit Development District, are set forth in Section 30-24. A Specific Use Permit is required before a building permit may be issued in this district except for single-family residential development and accessory uses. Deve]ODMent Standards and Regulations: Minimum standards for developments in this district are set forth in Article 3, Section 30-29. See. 30-29. Planned Unit Development Standards and Requirements. (a) Prior to the issuance of a Specific Use Permit or any building permit for property located in a PUD, Planned Unit Development District, a general land use and density plan must be submitted to the Planning Commission. The plan shall include a schematic land use plan identifyingdoacces posgeneral uses densities, major open spaces, ;Z �a6tement indicating proposed circulation';��i�res., ; phasing of develbpment and the projected timing of each phase. The Planning Commission shall forward the plan with its recommendation to the City Council. The applicant shall pay a processing fee of one hundred ($100) dollars. Advertisement and public hearings shall be held by the Planning Commission and City Council in accordance with the notification procedure set forth for a rezoning application. (b) Size: A PUD, Planned Unit Development District, may be authorized only on sites containing five (5) or more acres of land. However, sites less than five (5) acres will be considered on merit with a Specific Use Permit. (c) Cluster Housing: If the proposed development contains cluster housing, the minimum standards and requirements set forth for cluster unit housing developments set forth in Section 30-33(B) of this Chapter shall apply. (d) Height and Peripheral.) Yard Requirements: 1. Height: Structure and buildings located in a Planned Unit Development District shall not exceed thirty-five (35) feet, without specific authorization and approval from the City Council. 2. Yards: All buildings and structures shall be set back not less than twenty-five (25) feet from any peripheral property line or street right-of-way, W#
