SUBJECT: Variance Request - Christina Court Addition, Second Phase
COMMENTS
The Planning Commission is requested to consider a variance of Article 11, Section 24-8(c), concerning
the approval period of the Preliminary Plat of Christina Court Addition, Second Phase,
The Preliminary Plat for Christina Court was approved by the Planning Commission on June 19, 1999
and the construction plans for the entire subdivision were approved August 6, 1999.
Phase 1, which is approximately one-half of the subdivision, is completed and accepted by the City.
Bill Little, the developer, is considering amending the plat for Phase 11 to provide larger lots by
combining some of the planned lots and making fewer lots. This will not affect any drainage or
engineering, only interior lot lines. He is currently in the process of studying the feasibility of such a
change.
Therefore, Mr. Little is requesting a variance to the requirement that a final plat for Phase 11 be
recorded within twenty-four (24) months from the date of preliminary plat approval or else result in
expiration of the previous approval. He is requesting an extension of twenty-four (24) months.
I recommend approval of this variance request.

Re. Christina Court Subdivision
I am hereby requesting an extension of the time requirement stating that a subdivsion must
be completed within 24 months of preliminary approval for Christina Court Subdivision.
Christina Court received prelimanary approval June 21, 1999, and the construction plans
for the entire subdivision were approved August 6, 1999.
Phase I, which is approximately one half of the subdivision, is completed and accepted by
the City. I am considering amending the plat for Phase 11 to provide for larger lots by
combining some of the planned lots and making fewer lots. This will not change drainage
or any engineering, it will only change interior lot lines. I am in the process of studying
the situation to make this decision. For this reason I am requesting an extension of 24
months.

(12) The boundaries and flood elevations of all areas located in
flood hazard areas as determined by the Flood Insurance
Rate Maps (FIRM) provided by the Federal Emergency
Management Agency (FEMA), under the auspices of the
National Flood, Insurance Program (NFIP).
(13) The location of all existing pipeline easements and
Information concerning the size of the pipe, type of product
being transported and the pressure in the pipeline.
(14) The name of the registered surveyor responsible for
preparing the plat.
(15) A list of the proposed restrictive covenants, conditions, and
limitations to govern the nature and use of the property
being subdivided.
(b) The Planning Commission shall be required to act upon an
application completed in accordance with the requirements of this
ordinance within thirty (30) days from the filing date. If the plat is
disapproved, the Planning Commission shall inform the subdivider
in writing of the reasons for such action. If said plat be not
disapproved within thirty (30) from the filing date, it shall be
deemed to have been approved by the Planning Commission.
Approval of the preliminary plat by the Planning Commission shall
also constitute the conditional approval of the final plat subject to
approval by the City Engineer of all proposed improvements plans
and a ministerial determination by the Secretary of the Planning
Commission that the final plat is consistent with the approved
preliminary plat and complies with all the requirements of this
ordinance.
(c) Approval or conditional approval of a preliminary plat by the
Planning Commission shall be valid for a period of twenty-four (24)
months from the date of approval. Failure to prepare a final plat
and have it recorded in accordance with the provisions of this
ordinance within twenty-four (24) months from the date of
preliminary plat approval shall result in the expiration of the
previous approval.
(d) (1) Before the beginning of any construction on the proposed
streets or public utilities pertaining to the subdivision,
complete final construction plans of such improvements in
the form of plats, sketches or other satisfactory written
description, certified by a registered professional engineer,

Sec. 2430. Variances, exceptions and appeals.
(a) (1) Where the Planning Commission finds that extraordinary
hardships or practical difficulties may result from strict
compliance with these regulations or that public interest
may be served by an alternative proposal, it may approve
variances to these subdivision regulations so that
substantial justice may be done and the public Interest
secured provided that such variances shall not have the
effect of nullifying the general Intent and purpose of these
regulations; and further provided that the Planning
Commission shall not approve variances unless it shall
make findings based upon the evidence presented to it in
each specific case that:
(a) The granting of the variance will not be detrimental
to the public safety, health, or welfare or injurious
to other property.
(b) - The conditions upon which the request for a
variance is based are unique to the property for
which the variance Is sought and are not applicable
generally to other property.
(c) Because of the particular physical surroundings,
shape or topographical conditions of the specific
property involved, a particular hardship to the
owner would result, as distinguished from a mere
inconvenience, If the strict terms of these
regulations are enforced.
(d) The variance will not in any significant way vary the
provisions of the Zoning Ordinance, Zoning Map, or
Comprehensive Plan.
