A Regular Meeting and Joint Public Hearings of Planning Commission and City Council
were held on October 15, 2001 with the following members present:

Commissioner LaBiche made a motion to approve the minutes of the Regular Meeting and
Joint Public Hearings held September 17, 2001. Commissioner Hernandez seconded the
motion. Motion to approve carried 5:0.

1) Preliminaly Plat-Wil low Oak Estates: Consider the Preliminary Plat of Willow Oak
Estates, Lots 1-24; 7.45 acres out of the W. B. Dyches Survey, Ali. 17.
Applicant: Fittz and Shipman, Inc. for Dup-Co Builders
Mr. Richardson stated that the subject plat is the first phase of a 12 lot single family
residential development. The property is located on the west side of Old Voth Road
at Chinn Lane.
Dup-Co Builders is proposing to develop this overall 7.45 acre tract with 24 lots
served by a 950 foot cul-de-sac. Dup-Co is requesting a variance to the maximum
cul-de-sac length requirement of 800 feet.
At the time the staff report was written, Mr. Richardson recommended approval of
the Preliminary Plat of Phase One subject to the following conditions:
0 Correct the location map.
Add 10'wide utility easements along the exterior side lot lines of Lots I
and 24, which abut Old Voth Road; and
0 Add note on plat explaining City access to water and sewer easement lying
across Lots 20-24.
However, on October 11, a letter was received from DD#6 expressing concern over
how this subdivision will drain. A copy of the letter was provided to the
Commission.
In that letter, it states that drainage of the subdivision is a real issue. For it to be
addressed, DD#6 has suggested several options. A copy of this letter was faxed to
the consulting engineer, John Holm with Fittz and Shipman. He has discussed this
with the City Engineer and the developer.
Mr. Richardson recommended approval of the plat subject to the three conditions
listed above, but also subject to the drainage of this subdivision being addressed to
the satisfaction of DD#6 and the City.
Vice -Chairman Dykeman asked for the applicant's comments.

Commissioner Craig made a motion to approve. the Preliminary Plat of Willow
Oak Estates, Lots 1-24 as requested, subject to the following conditions:
0 Correct the location map;

Mayor Pro -Tern Goodson called the Joint Public Hearings of October 15, 2001 to order and
explained the purpose of the joint hearing process and then turned the meeting over to Vice -
Chairman Dykeman. He explained the policies and procedures for the hearing process.
I File 42-HC: Consider the (HC-L) Historic Cultural Landmark Preservation
Designation for the building at 461-469 Bowie.
Applicant: Karen Ingwersen
Mr. Richardson told the Commission and Council that Dr. Hel vy Hiner, Jr., owner
of the "Coate Building" is requesting this designation. The building is currently
undergoing extensive renovation and is going to be home of a new restaurant and
jazz club.
The building was evaluated using the City of Beaumont's ten criteria for
designation. The building was constructed in 1914. Great pain is being taken to
preserve the exterior of the building. The building was home to the Bowie Club
which was one of the places raided by the James Commission in 1960.
This designation is recommended by the Beaumont Historic Landmark
Commission,
Nineteen notices were mailed to property owners within 200 feet. One response in
favor and none in opposition were returned.

Vice -Chairman Dykeman asked for comments in favor or in opposition. No
comments were made. The public hearing was closed.
Commissioner Lucas made a motion to approve the (HC-L) Historic Cultural
LandmarkPreservation Designation for the building at 461-469 Bowie as requested
in File 42-HC. Commissioner LaBiche seconded the motion. Motion to approve
carried 5:0.
2) Filel583-P: Request for a specific use permit to allow a climate controlled storage
facility in a GC -MD (General Commercial -Multiple Family Dwelling) District.
Location: 10255 Eastex Freeway
Applicant: Centurion Capital, Inc.
Mr. Richardson stated that the subject property is the former location of the old
Palace Restaurant and Club.
The owner, Bruce Craig, would like to convert the property into a climate
controlled self -storage facility. In addition to the existing building, he also plans
to make an addition to the building on the north side and construct covered parking
stalls for boats, recreational vehicles and trailers.
In 1998, a specific use permit was granted for a wholesale durable goods operation
dealing with wastewater disposal units. That specific use permit was never used.
On the site plan, as submitted, there was a concern about inadequate parking.
However, Mr. Craig has submitted a new site plan indicating more than adequate
parking. In addition, staff was recommending that four boat stalls, two at the
southwest comer and two at the northwest comer be removed in order to create less
of an impact on the residential subdivision to the west.
Mr. Richardson recommended approval of the specific use permit subject to the
removal of four boat stalls.
Ten notices were mailed to property owners within 200 feet. No responses in favor
or in opposition were returned.

Commissioner Craig made a motion to approve the specific use permit to allow a
climate controlled storage facility in a GC -MD District at 10255 Eastex Freeway
as requested in File 1583-P, subject to the removal of two boat stalls from the
southwest row of stalls and two stalls from the northwest row. Commissioner
Lucas seconded the motion. Motion to approve carried 5:0.
3) File 1584-P: Request for a specific use permit to allow a church in an RCR
(Residential Conservation and Revitalization) District.
Location: 2570 Laurel Avenue
Applicant: Reverend Dean Tucker
Mr. Richardson stated that the applicant, Reverend Dean Tucker, would like to open
Our Lady of the Light Church and Alternative Healing Center in an existing house.
Church services and other events would be held on evenings and on the weekend.
Counseling would be available to a number of health and family problems. Other
services include therapeutic massage, bookstore and gift shop and an Internet
outreach ministry.
Parking would be at the rear of the building and next door at Dr. Cobbett's dental
office. Dr. Cobbett is Reverend Tucker's wife and she has given permission to use
her parking lot. The church's use of that parking will not interfere with the doctor's
office hours.
Reverend Tucker has requested a modification to the landscaping/screening
requirements on the north and east sides of the subject property.
Mr. Richardson recommended approval of the request with a modification to the
landscaping and screening requirements.
Twenty-five notices were mailed to property owners within 200 feet. One response
in favor and one in opposition were returned.

Discussion between the Commission, Council and staff followed regarding parking.

Reverend Dean Tucker, the applicant, addressed the Commission and answered
questions regarding daily operation, staff and parking.
Vice -Chairman Dykeman asked for comments in favor or in opposition. No
comments were made. The public hearing was closed.
Commissioner Craig clarified that the parking has been reviewed and approved by
the Traffic Division.
Commissioner Craig made a motion to approve a specific use permit to allow a
church in an RCR District at 2570 Laurel Avenue as requested in File 1584-P,
with a waiver of the landscaping and screening requirements on the north and east
sides of the subject property. Commissioner Lucas seconded the motion. The
motion to approve carried 3:2 (LaBiche, Hernandez).
4) File 1585-P: Request for a specific use permit to allow a print shop in a GC -MD
(General Commcrcial-Multiple Family Dwelling) District.
Location: 2755 Washington Boulevard
Applicant: Darrell W. Redcaux
Mr. Richardson stated that Darrell Redeaux, owner of Affordable Printing, wants
to relocate his business to a space in an existing strip center.
Affordable Printing prints letterhead, envelopes, business cards, books, invitations
and carbonless forms, among other things.
Mr. Richardson recommended approval of the specific use pen -nit.
Twenty-eight notices were mailed to property owners within 200 feet. No
responses in opposition or in favor were returned.

Darrell Redeaux, 3006 Corley, the applicant, addressed the Commission.

In response to Commissioner Lucas, Mr. Redeaux said he would have a contract to
take care of chemical disposal.
Commissioner LaBiche made a motion to approve the specific use permit to allow
a print shop in a GC -MD District at 2755 Washington Boulevard as requested in
File 1585-P. Commissioner Hernandez seconded the motion. Motion to approve
carried 5:0.
5) File 1586-Z: Request for a zone change from RM-H (Residential Multiple Family
Dwelling -Highest Density) to GC -MD (General Commercial -Multiple Family
Dwelling) District or a more restrictive commercial district.
Location: 4345 Crow Road
Applicant: Robert Chapman
Mr. Richardson told the Commission and Council that the owner of the subject
property, Robert "Rocky" Chapman, wants to rezone the entire 1.232 acres at 4345
Crow Road. The property currently has a specific use permit on the front half for
office use. Two office buildings have been built.
Mr. Chapman has one client who would like him to build a free standing retail
building and another that would like a free standing office building built at the rear
of the property. The retail use would necessitate a zone change. GC -MD zoning
is to the north and west of the subject property. The Comprehensive Plan
designates this property as part of a Regional Commercial Center.
Mr. Richardson recommended approval of the request.
Thirty-three notices were mailed to property owners within 200 feet. No responses
in opposition or in favor were returned.

Robert Chapman, the applicant, addressed the Commission.

Commissioner Craig made a motion to approve a zone change from RM-H to GC -
MD for the property at 4345 Crow Road as requested in File 1586-Z.
Commissioner LaBiche seconded the motion. Motion to approve carried 5:0.

6) File 1587-P: Request for a specific use permit to allow an art gallery in an RCR
(Residential Conservation and Revitalization) District.
Location: 581 N. 9n` Street
Applicant: Ruth Megnet
Mr. Richardson stated that Ruth Megnet, owner of the property at 581 N. 9 th , wants
to open an art gallery at the former location of the Borenstein Art Gallery. The art
gallery will be open on Saturday and Sunday afternoons and by appointment.
The Traffic Manager is requiring some modifications to the proposed parking lot
at the rear of the property. Ms. Megnet is requesting a waiver of the landscaping
and screening requirements on the south and west sides of the property. To the
south is a vacant structure previously used as a florist shop and to the west is a
dentist office.
Mr. Richardson recommended approval of the request subject to the Traffic
Manager's required changes and a waiver of the landscaping/screening
requirements on the south and west sides.
Twenty-one notices were mailed to property owners within 200 feet. No responses
in favor or in opposition were returned.

Chairman Leister opened the public hearing and asked for the applicant's
comments.
Ruth Megnet, the applicant, addressed the Commission.
Vice -Chairman Dykeman asked for comments in favor or in opposition. No
comments were made. The public bearing was closed.
Commissioner Lucas made a motion to approve a specific use permit to allow an
art gallery in an RCR District at 581 N. 9' Street as requested in File 1587-P.
Commissioner Craig seconded the motion. Motion to approve carried 5:0.
7) File 1588-P: Request for two specific use permits to allow a home decor shop and
a restaurant in a PUD (Planned Unit Development) District.
Location: 3350 Dowlen Road
Applicant: Brentwood Investments Development Company, L. P.
Mr. Richardson stated that the home decor shop and restaurant would go in
Building "B" of Tuscany Park.

Brent Coon is the owner and developer of Tuscany Park, a professional office and
commercial complex. The property is zoned PUD. The property was zoned RM-H
with a specific use pen -nit for offices.
Mr. Richardson recommended approval of the requests.
Ten notices were mailed to property owners within 200 feet of the subject property.
No notices in favor or in opposition were received.

Richard Guseman addressed the Commission on behalf of Brentwood Investments
Development Company, L. P.

Commissioner Hernandez made a motion to approve two specific use permits to
allow a home decor shop and a restaurant in a PUD District as requested in File
1588-P. Commissioner LaBiche seconded the motion. The motion to approve
carried 5:0.
8) File 1589-P: Request fora specific use permit to allow two guest quarters in an RS
(Residential Single Family Dwelling) District.
Location: #6 Estates of Montelaire
Applicant: Gusernan Homes, Inc.
Mr. Richardson told the Commission that Paul Ferguson is the owner of a three acre
lot in the Montclaire Addition. He is building a 15,931 square foot main house on
the property and would like to construct two accessory guest quarters - one a 2,030
square foot free standing unit and the other a 525 square foot unit attached to a
proposed gymnasium. These structures will be placed at the rear and left rear of the
large lot.
Mr. Richardson recommended approval of the specific use permit.
Eleven notices were mailed to property owners within 200 feet. No responses in
favor or in opposition were returned.

OTHER BUSINESS
Mr. Richardson reminded the Commission and Council that a special meeting will be held
on Monday, October 22, 2001, for an annexation hearing.
