SUBJECT: Request for annexation of three areas south, southeast and east of the City of Beaumont
totaling 4,239.68 acres, more or less. The first of two hearings for the proposed
annexation was held October 22, 2001.

STAFF REPORT
The Planning Manager recommends approval of the annexation of Areas 1, 2 and 3..
The City of Beaumont is considering the annexation of three areas of land to the south,
southeast and east of the current city limits:
Area I - located south of the southeast corporate limits, south of Cardinal Drive, Sulphur
Drive and Spindletop Avenue, extending east and west of West Port Arthur
Road and extending west of Erie St. and containing 2,728.74 acres, more or
less.
Area 2 - located along the west bank of the Neches River, extending in a northerly
direction from the corporate limits at the KCS railroad right-of-way to a point
east of Washington Blvd. if extended east to the Neches River and containing
760.71 acres, more or less.
Area 3 - located between the Neches River and St. Hwy. 347, being primarily the
Beaumont Works of the E.I. DuPont DeNernours & Co. and other tracts and
containing 750.23 acres, more or less.
The City of Beaumont is annexing these areas for the following reasons:
I Doing so will add to the economic stability of the City by ensuring that it has an
adequate tax base to provide the necessary services to its residents.
2. It is the City's desire to regulate the extent and quality of development within the areas
proposed for annexation. This will enable the City of Beaumont to plan and control the
areas' development so that it will enhance and not detract from the City.
3. To protect environmentally sensitive areas and to better regulate the quality of
development in the area.

Annexation - Area 1 2,728.74 acres +
Being a 2,728.74 acre tract, more or less, out of parts of the Pelham Humphreys Survey, Ab-
32, John A. Veatch Survey, Ab-55, James Rowe Survey, Ab-45, Christian Hillebrandt
Survey, Ab-28 and the John Douthit Survey, Ab-1 14, Jefferson County, Texas, said tract
being more particularly described as follows:
For a locative point, begin at a point in the west right-of-way line of West Port Arthur Road,
said point being in the southwest comer of the 60.72 acre Sun Oil Company tract in the
Pelham Humphreys Survey; thenee northeast to a point in the east right-of-way line of West
Port Arthur Road, the same being in the westerly line of the Gulf Refining Company 220.32
acre tract; thence in a northwesterly direction along and with the easterly right -of way line
of West Port Arthur Road and the westerly line of said Gulf Refining Company 220.32 acre
tract passing the northwest comer of same and continuing to the northwest comer of Gulf
Refining Co. Tract No. 28 (Jefferson County Appraisal District), same being in a northerly
line of a 2,810 acre tract of land annexed into the southeast part of the City of Beaumont by
City ofBeaumont Ordinance No. 88-99 on October 25,1988, said comer being THE PLACE
OF BEGINNING of the herein described 2,728.74 acre tract of land;
THENCE northeast along the city limits of Beaumont to a point in the northeast comer of
said Gulf Refining Tract No. 28; thence southeast along the east line of said Tract 28 and
continuing along the most northerly east line of the Gulf Refining Co. 220.32 acre tract to
an interior "L" comer, being in the above mentioned City limits boundary; thence
northeasterly (N. 62' E.) along the City limits line, same being along the most easterly north
line of the said 220.32 acre tract and the most westerly south line of the McFaddin, Weiss
and Kyle tract 801.6 feet to a point; thence southeasterly along the City limits boundary and
same being along and with the most southerly west line of said McFaddin, Weiss and Kyle
tract to a point in the most westerly north line of the Amoco 484.85 acre tract;
THENCE along the City limits boundary and along the north line of the said Amoco tract
north 45' east 2,301 feet to the most westerly northwest comer of the Texas Eastern
Transmission Corporation 103.89 acre tract;
THENCE continuing northeast along the north line of said Texas Eastern Transmission
Corporation 103.89 acre tract and continuing northeast to the northeast comer of a Texas
Eastern 13.12 acre tract 2,218 feet to a point located in the west line of the Lower Neches
Valley Authority (L.N.V.A.) Canal; thence continuing northeast to a point on the east line
of the L.N.V.A. Canal; thence northwest following the meanders of the L.N.V.A. Canal
along the northerly and easterly right-of-way lines of said canal to a point of intersection
with the westerly projection of that certain 31.93 acre Kyle Tract; thence continuing
northwest along the easterly right-of-way line of said L.N.V.A. Canal to a point of
intersection with the centerline of Spindletop Avenue, a 40 foot wide street right-of-way,
same being the boundary line of the corporate limits of the City of Beaumont; thence
continuing to the northwest and west along the city limits line on the northerly line of the
said L.N.V.A. Canal to a point of intersection of the City limits with the south right-of-way
line of Cardinal Drive at Highland Avenue;
Thence in a westerly direction along the city limits line, said line being 50 feet south of and
parallel to the north right-of-way line of the 220 ft. wide L.N.V.A. Canal, crossing the West
Port Arthur Road and Erie Street, and continuing along the City limits where the said city
limits curves to the northwest along with a Curve to the northwest of said canal to a point
where the north line of the L. N. V. A. Canal and the City limits intersect at the westerly
right-of-way line of Chambless Drive, a public street right-of-way; thence following the city
limits line in an abrupt turn to the north abutting the west line of the Laura Addition (Vol.
10, Page 186, Jefferson County Map Records) to a point; thence following the City limits
line in an abrupt turn to the south to a point on the south side of the L.N.V.A. Canal right -of
way; thence northwest along the City limits line along the south side of said canal for 3,900
ft., more or less, to a point; thence west 90' following the City limits line to a point for
comer in the west line of the John A. Veatch Survey, Ab-55 and the east line of the James
Rowe Survey, Ab-45;
Thence south along the City limits along the west line of the John A. Veatch Sur -Vey and the
east line of the James Rowe Survey to a point in the northeast comer of Lot 1, Eli Andrus
Subdivision (Vol. 4, P. 186, J,C.M.R,) and same being a southeast comer of the corporate
limits of the City of Beaumont; thence south 89 ft. to the southeast comer of said Lot 1, Eli

Being 53.454 acres of land, more or less, out of and a part of the James Rowe Survey,
Abstract Number 45 and the C. Hillebrand League, Abstract Number 28 in Jefferson County,
Texas and being the remainder of the tracts of land conveyed to Gerald G. Mallett and
Mildred Mallett by deed of record in Volume 827, Page 423 of the Deed Records of
Jefferson County, Texas called to be 47.8 acres and being the Eli Andrus Subdivision, plat
of which is recorded in Volume 4, Page 186 of the Map Records of Jefferson County, Texas,
and the north 4/7 of a 30 acre tract, 17.14 acres, called to be 17.5 acres in the deed of record
in Volume 899, Page 141 of the Deed Records of Jefferson County, Texas. Said 53.454 acre

BEGINNING at an old 1 " iron pipe found at an old fence comer for the northeast comer of
this tract and same being in the east line of said Rowe Survey and same being the northeast
comer of said called 47.8 acre tract and same being the southeast comer of the Sidney
Andrus 95.7 acre tract set out in the partition deed of record in Volume 83, Page 357 of said
deed records and same being the southeast comer of the 485.143 acre tract conveyed to the

Records of Jefferson County, Texas and same being the northeast comer of said Eli Andrus

THENCE South 01' 09'39" East with the east line of said 47.8 acre tract and said Andrus

89.75') to an old 1/2" iron pipe found for comer;
THENCE South 88' 53'26" West with the northerly south line of said tract and subdivision
a distance of 424.79 feet (deed cal S 89' W 425') to an old Y2" iron pipe found at an old fence
comer post for an ell comer in the east line of said 47.8 acre tract and subdivision;
THENCE South 01'30'54" East with the east line of said 47.8 acre tract and subdivision and
an old fence line a distance of 609.97 feet (deed call S 01' E 611.12') to a concrete marker
with a 1/2" iron pipe found at an old fence comer post for the southeast comer of said 47.8
acre tract and subdivision and same being the northeast comer of said called 17.5 acre tract;
THENCE South 01' 04'09" East with the cast line of said 17.5 acre tract and an old fence
line a distance of 324.58 feet to an old 3/4" iron pipe found at an old fence comer for the
northeast comer of the called 2.5 acre tract out of said called 17.5 acre tract by deed of record
in Volume 1074, Page 323 of said deed records;
THENCE South 890 00'32" West with the north line of said called 2.50 acre tract a distance
of 1970.92 feet (deed call 1969.4) to an old 2" angle iron found for the northwest comer of
said called 2.50 acre tract and being in the west line of said called 17.50 acre tract and being
in ail old fence line and same being the east line of the called 2184.72 acre tract of land
conveyed to the City of Beaumont by deed of record in Film File Code 10 1-74-1190 of the
Official Public Records of Jefferson County;
THENCE North 000 51'17 West with the west line of saidcalled 17.5 acre tract and the east
line of said City of Beaumont 2184.72 acre tract and an old fence line at 324.59 feet is an old
p. k. stake found for the southerly southwest comer of said 47.8 acre tract and said Andrus
Subdivision and continuing on said course with the southerly west line of said 47.8 acre tract
and said Andrus Subdivision and the east line of said City of Beaumont tract and all old
fence line for a total distance of 773.96 feet to a concrete marker with a 1/2" iron pipe found
at an old fence comer for an ell comer of said 47.8 acre tract and subdivision and same being
the northeast comer of said City of Beaumont tract, same being the north line of said C.
Hillebrand League and the south line of said James Rowe Survey;
THENCE South 88' 34' 13" West with the westerly south line of said 47.8 acre tract and
subdivision and the north line of said City of Beaumont 2184.72 acre tract and an old fence
line and the north line of said C. Hillebrand League and the south line of said James Rowe
Survey a distance of 1118.45 feet to a 1/2" iron rod set for the northerly southwest comer of
this tract and same being the southeast comer of the 4,536 acre tract H-243 conveyed to
Drainage District Number 6 by deed of record in Film File Code 103-74-1187 of the Official
Public Records of Jefferson County, Texas;
THENCE North 19' 45'27" East with the east line of said Drainage District Number 6 tract
a distance of 277.63 feet to a Drainage District No. 6 marker found for the northwest comer
of this tract and the northeast comer of said Drainage District No. 6 tract and being in the
north line of said 47.8 acre tract and an old fence line and same being in the south line of said
City of Beaumont 485.143 acre tract;
THENCE North 89' 00' 00" East with the north line of said 47.8 acre tract and said Andrus
Subdivision and an old fence line and the south line of said City of Beaumont 485.143 acre
tract (deed call and plat N 89' 00' 00" E) a distance of 3407.64 feet to the place of
BEGINNING.
Said tract of land herein described contains 53.454 acres of land, more or less, with Lot 41
and th north Y2of Lot 42 of said Andrus Subdivision containing 1.5 acre of land, more or
less, that was save and excepted in said deed of record in Volume 827, Page 423 of said deed
records.
The bearings shown herein are based on the bearing of North 89' 00' 00" East for the north
line of said 47.8 acre tract and Andrus Subdivision as called for in the deed for same and
shown on the plat for said subdivision.
SAVE AND EXCEPT the North one-half (1/2) of Lot Forty-two (42) of the Eli Andrus
Subdivision as conveyed to Mrs. C. W. Lindenberg in Deed recorded in Volume. 274, Page
140, Deed Records, Jefferson County, Texas and the Lot Forty-one (41) of the Eli Andrus
Subdivision as conveyed to L. D. Sprouse in Deed recorded in Vol, 297, page 511, Deed
Records, Jefferson County, Texas.

the 2,728.74 acre tract under consideration for annexation.)
Annexation - Area 2 760.71 acres +
Being a 760.71 acre tract, more or less, out of pails of the Pelham Humphreys (aka Pilham
Humphries) - Ab. 32, W. P. H. McFaddin - Ab. 689, Pierra Lemane - Ab, 163, Jeff and
James Chaison - Ab. 435, Beaty, Scale and Foiwood - Ab. 392 and D. Brown - Ab. 5
Surveys, Jefferson County, Texas, and more particularly described as follows:
For Place of Beginning start at a point on the easterly right-of-way line of the K.C.S.
Railroad, same being in the city limits line of the City of Beaumont, said point also being in
the north line of the Amoco 465 acre tract and being in the Pelham Humphreys Survey, Ab-
32; thence northeast along the city limits line and the north line of the said Amoco tract a
distance of 2,730.3 ft. to a point, and continuing in an easterly direction another 3,257.86 ft.
to a point on the southwesterly bank of the Neches River; thence east to a point in the center
of the Neches River, same being the political boundary line of Jefferson County and Orange
County;
THENCE following the meanderings of the Neches River along the center of the river in a
northerly, southerly, northerly and northwesterly direction for 15,900 ft., more or less, to a
point for comer in the center of the river; thence south to a point on the southerly bank of the
Neches River; thence continuing south along the west lines of Blocks 6 and 9 of the

Being a 750.23 acre tract, more or less, out of the J. S. Johnston Survey, Ab-34 and the
Pelham Humphreys Survey, Ab-32, located in Jefferson County, Texas and more particularly
described as follows:
For Place of Beminnin begin at a point in the center of the Neches River, same being the
common political boundary line of Jefferson County and Orange County; thence southwest
to a point on the southerly bank of the Neches River, same being in the east line of the J. S.
Johnston Survey, Ab-34, same being a northerly point in the common line which separates
the extraterritorial jurisdiction of the City ofBeaumont from the extraterritorial jurisdiction
of the City of Nederland, according to Exhibit "A" for the Extraterritorial Jurisdiction
Agreement between the Cities of Port Arthur, Beaumont and Nederland, Texas, said Exhibit
"A" being filed for record in the Map Records of the Jefferson County Clerk on September
5, 1965, in Volume 10, Page 185;
Thence south 0' 45'west along the east line of the J. S. Johnston Survey, same being in the
common line of separation between the extraterritorial jurisdiction ofthe Cities ofBeaumont
and Nederland, a distance of 4,669 feet to a point for corner; thence south 560 16' 45" west
a distance of 950.72 feet to a point for comer in the east line of the K. C. S. Railroad right-of-
way; thence north 440 07'west along the east line of the K. C. S. Railroad right-of-way a
distance of 340 feet to a point for comer; thence south 420 50'west a distance of 602.5 feet
to a point for comer in the northeast line of State Highway 347;
Thence northwest along the northeast line of State Highway 347, and continuing past the east
line of the Pelham Humphreys Survey, Ab-32, to a point of intersection with the corporate
limits of the City ofBeaumont, said corporate limits being established by City of Beaumont
Ordinance No. 88-99, dated October 25, 1988;
Thence following the corporate limits of the City ofBeaumont northeast to a point for comer
in the northeast line of the K. C. S. Railroad right-of-way; thence northwest along the
northeast line of the K. C. S. Railroad right-of-way and the city limits of Beaumont to a
point; thence in a line along the city limits ofBeaumont in a southeast, northeast, southeast
and northerly direction to a point on the southerly bank of the Neches River; thence northeast
to a point in the center of the Neches River, said point being in the common political
boundary line of Jefferson County and Orange County; Thence in a southeasterly direction
along the center of the Neches River to a point being the Place of Beginning, containing
