Richardson, Planning Manager I SUBJECT: Consider request to abandon a 0.101 acre portion of Florida Avenue between Erie and Cardinal Drive. FILE: 626-OB STAFF REPORT The Planning Manager recommends denial of this request. Gene Van Meter, the applicant, is requesting this abandonment of the dead-end portion of Florida Avenue. It is not being maintained currently by the City of Beaumont. This remnant was left over when Cardinal Drive was developed. Mr. Van Meter states that the subject right- of-way is now used for the dumping of garbage. The only property that uses the subject right- of-way for access is Mr. Van Meter's. The Traffic Manager, in his review of the proposed request, said that the City needs this right- of-way for future intersection improvements or re -alignment associated with roadway widening (Florida Avenue) or safety enhancements. Presently, the widening of this portion of Florida is not on the CIP. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being a 50' x 88' portion of Florida Avenue, beginning at the southeast corner of a 0.66 acre tract out of the Annie T. Warren Subdivision and owned by Gene A. Van Meter, thence south a distance of 50' to the south right-of-way line of Florida Avenue, thence along the south right- of-way line of Florida Avenue for a distance of 88', thence north a distance of 50' to the southwest comer of said 0.66 acre tract, thence along the north right-of-way line of Florida Avenue for a distance of 88' to the point of beginning, containing 0.101 acres, more or less, Gene A VanMeter 550 Langham Road Beaumont, Texas 77701 May 23, 2002, Mr. Stephen Richardson Planning Division City Hall, 801 Main Street Beaumont, Texas 77701 Re: Application for Abandonment of Right -of -Way, But Retain Utility Easement Dear Mr. Richardson: By this letter of application, along with several enclosures relative to same, I request the City's approval to abandon the dead-end portion of West Florida which is not being maintained by the City of Beaumont. The subject right-of-way was for decades a portion of Florida Avenue which extended westward and continuing to outside the city limits. Later, with the development of Cardinal Drive (Hwy. 69, 96), this small portion of Florida which is 88 feet in length became a mere remnant or stub of a street not needed. In more recent years this 88-ft. x width of Florida area has been used primarily for a garbage disposal drop' -off location and for other illegal uses, all of which are negative influences to our city. Presently, I am making significant improvements to this property abutting this small portion of dead -ended Florida, the subject of abandonment. This portion of street is my only legal access to my property at 1902 Florida, (Also referred to as 1902 W. Cardinal Drive.) Further, this portion of Florida's dead -ended is not being used nor is it needed by any other property owner(s). My only nearby neighbor, Mr. Robert Aldredge, owner of Kay Electronics at 1910 W. Cardinal Drive joins me in support of this application for abandonment. Please see his signature of support on the list of adjoining property owners. Kay Electronics has its driveway access directly from Cardinal Drive. By this letter I request your earliest consideration of this application and to process same for soon approval.
