HomeMy WebLinkAbout7-15-02 PC MinutesMINUTES REGULAR MEETING AND JOINT PUBLIC HEARING PLANNING COMMISSION CITY COUNCIL July 15, 2002 City Council Chambers A Regular Meeting and a Joint Public Hearing of the Planning Commission and City Council were held on July 15, 2002 with the following members present: Commission members present: Chairman Laurie Leister Commissioner Bill Lucas Commissioner Marty Craig Commissioner Carlos Hernandez Commissioner Dale Hallmark Commissioner Walter Kyles Commissioner Dohn LaBiche Commission members absent: Vice -Chairman Greg Dykeman Commissioner Glenn Bodwin Councilmembers present: Mayor Evelyn Lord Mayor Pro -Tern Lulu. Smith Councilman -at -Large Andrew Cokinos Councilman Guy Goodson Councilmembers absent: Councilmember-at-Large Becky Ames Councilmember Bobbie Patterson Councilman Audwin Samuel Also present: Stephen Richardson, Planning Manager; Tyrone Cooper, First Assistant City Attorney; Adina Abshire, Planning Technician; Jill Cole, Recording Secretary; Cheryl Robinson, Senior Planner and Stephen Bonczek, City Manager Commissioner Hernandez made a motion to approve the minutes of the Regular Meeting and Joint Public Hearings held June 17, 2002. Commissioner Hallmark seconded the motion. Motion to approve carried 5:0. Planning Commission July 15,2002 REGULAR MEETING 1) File 629-OB: Request to abandon the 20'x 50' alley between Lot I and Lot 12, Block 5, G. Cuchia Addition. Applicant: Bill Tran Mr. Richardson stated that the .023 acre portion of the alley is located west of Elba Street. Bill Tran, the owner of the adjacent property, is requesting the abandonment of the unimproved alley. This request was sent to all interested parties and no opposition to the abandonment was received. Mr. Richardson recommended approval of the abandonment. Slides of the subject property were shown. (Commissioner Craig arrived.) Chairman Leister asked for the applicant's comments. The applicant was not present. Commissioner LaBiche made a motion to approve the abandonment of the 20'x 50' alley between Lot I and Lot 12, Block 5, G. Cuchia Addition, located west of Elba Street as requested in File 629-OB. Commissioner Hernandez seconded the motion. Motion to approve carried 6:0. 2) File 630-OB: Request to abandon the 50'x 50' portion of Genoa St. located west of Elba Street. Applicant: Wallace L. Downs Mr. Richardson stated that the request was for the abandonment of a .057 acre portion of Genoa Street, west of Elba Street. Wallace Downs and Bill Tran, the owners of the adjacent properties, are requesting abandonment of this unimproved portion of Genoa Street. Mr. Downs states that he has been maintaining this property for at least 40 years. The request was sent to all interested parties and no opposition to the abandonment was received. Chairman Leister asked for the applicant's comments. The applicants were not present. OP Planning Commission July 15, 2002 Commissioner Hallmark made a motion to approve a request to abandon the 50' x 50'portion of Genoa Street located west of Elba Street as requested in File 630-OB. Commissioner LaBiche seconded the motion. Motion to approve carried 6:0. JOINT PUBLIC HFARINGS Mayor Lord called the Joint Public Hearing of July 15, 2002 to order and explained the purpose of the joint hearing process and then turned the meeting over to Chairman Leister. She explained the policies and procedures for the hearing process. (Commissioner Kyles arrived.) Mr. Richardson introduced Anna Varela and Bonnie Semien, Code Enforcement Officers. 1) File 1626-P: Request for an amended specific use permit to allow the expansion of the administrative offices for a home health care agency in an RCR (Residential Conservation and Revitalization) District. Location: 2325 Liberty Applicant: Nancy Carlisle, Quality Care Sitter Service, Inc. Mr. Richardson stated that Nancy Carlisle, owner of Quality Care Sitter Services, wants to expand the administrative offices of the business at 2325 Liberty. Ms. Carlisle was granted a specific use permit for the office in March, 1998. The proposal is for constructing a 17' x 34' addition to the rear of the building. Additional parking will be provided as well. Because this property is in the Oaks Historic District, the Historic Landmark Commission must approve a Certificate of Appropriateness for the construction. In addition, a variance to the rear yard setback must be approved by the Zoning Board of Adjustment. A 25' rear setback is required. A 17' rear setback is proposed. Ms. Carlisle has applied for both the CA and the variance. Mr. Richardson recommended approval of the request, subject to obtaining the necessary approvals from the Historic Landmark Commission and the Zoning Board of Adjustment. Twenty-two notices were mailed to property owners within 200 feet. One response in favor and none in opposition were returned. Slides of the subject property were shown. Chairman Leister opened the public hearing and asked for the applicant's comments. E Planning Commission July 15,2002 Nancy Carlisle, the applicant, addressed the Commission. Chairman Leister asked for comments in favor or in opposition. No comments were made. The public hearing was closed. Commissioner Craig made a motion to approve an amended specific use permit to allow the expansion of the administrative offices for a home health care agency in an RCR District at 2325 Liberty as requested in File 1626-P, subject to obtaining the necessary approvals from the Historic Landmark Commission and the Zoning Board of Adjustment. Commissioner Lucas seconded the motion. Motion to approve carried 7:0. OTHER BUSINESS THERE BEING NO FURTHER BUSINESS, THE MEETING WAS ADJOURNED AT 4:30 P. M.
