Richardson, Planning Manager SUBJECT: Consider a request for an abandonment of a 10'general utility easement out of Lots 1-3, Heather & Corey Place Addition. FILE: 634-OB STAFF REPORT The Planning Manager recommends approval of this request for abandonment. Lloyd Guillory, owner of the subject property at 2155 Glendale, wishes to abandon this general utility easement so that he can move his fence over in order to build a shed in his backyard. It will also enable him to access his rear yard without having to drive through his front yard. This item was reviewed by all interested parties. As of the writing of this staff report, no objections have been received. Exhibits are attached. LEGAL DESCRIPTION FOR ORDINANCE PURPOSES Being a 0.0237 acre (1032.08 sq. ft.) of land out of and a part of Lots 1, 2 and 3, Heather and Corey Place, City of Beaumont, as recorded in Volume 16, Page 44, Map Records, Jefferson County, Texas; being part of a 10' utility easement as shown on plat affecting Lots 1, 2 and 3, Heather and Corey Place; said 0.0237 acre tract being more fully described by metes and bounds as follows to wit; COMMENCING at a V? steel rod found on a previous survey dated June 18, 2002, Soutex Surveyors, Inc, for the northeast corner of said Lot 1, said V? steel rod being on the southerly right-of-way line of a dedicated road named Washington Boulevard; THENCE South 00 deg., 01 min., 12 sec., west, on the east line of said Lot 1, a distance of 139.79'to a point for corner being the POINT OF BEGINNING and the northeast corner of the herein described tract; LEGAL DESCRIPTION FOR ORDINANCE PURPOSES continued THENCE South 00 deg., 01 min., 12 sec., west, continuing on the east line of said Lot 1, a distance of 5.00' passing the common comer of said Lots I and 3 and containing for a total distance of 10.00' to a point for corner being the southeast corner of the herein described tract; THENCE West, a distance of 103.2 I'to the point for corner, being the southwest corner of the herein described tract; THENCE North, a distance of 5.00' passing the common line of said Lots 2 and 3, and continuing for a total distance of I 0.00'to a point for corner being the Northwest corner of the herein described tract; THENCE East, a distance of 3.20' passing the common line of said Lots I and 2, and continuing for a total distance of 103.2 I'to the POINT OF BEGINNING and containing 0.0237 (1023.08 sq. ft.) acre of land more or less.
