Richardson, Planning Manager SUBJECT: Consider a request for the extension of a specific use permit time limit for a period of one year for the operation of a rental hall in an RCR (Residential Conservation and Revitalization) District. FILE: 1534-P STAFF REPORT The Planning Manager recommends approval of this request for an extension until November 28,2003. Yvonne Como, property owner, is requesting a one year extension of a specific use permit granted for a rental hall for weddings, receptions, parties, family and class reunions and other celebratory assemblies. The property is located at 1685 Park Street. City Council approved the specific use permit in November, 2000. Ms. Como states that she has been trying to get investors to partner with her for the operation of the business. Additional time is needed to complete the financial arrangements and to complete the requirements for occupancy. While these arrangements are being made, the property is being maintained in a responsible manner. Exhibit is attached. A TTORIVEY A T LA W Mr. Stephen C. It is my understanding that operation of a business activity pursuant to a specific use permit must begin within two years of the date the specific use permit was granted. I therefore have until November 28, 2002, to began operation of the rental hall at the above address. Unfortunately, I will not have completed all of the necessary requirements by that date. I hereby request an extension of time for a period of one (1) year to satisfy all occupancy requirements. I am the sole owner of the above property. At the time of purchase, the building was occupied and my plans contemplated continued leasing while I readied the premises for operation of my business. Again unfortunately, the then tenants elected to terminate their occupancy but city requirements about which I was unaware made it impossible for me to continue to lease the property under the same circumstances that it had previously been leased. The building has therefore been vacant since July, 1999. During the interim, I have had continuing expenses including debt service, utilities, insurance and upkeep. I have also sought investors to partner with me for the operation of my business. Several prospects requested time while they tried, albeit unsuccessfully, to raise the capital needed to join the venture. I am presently pursuing other investors and will require time to both complete our financial arrangements and then to complete the requirements for occupancy. Let me hasten to say that my property is being maintained in a responsible manner while I endeavor to meet city requirements. As previously mentioned, the property is insured and it is well maintained. It is not an eyesore, it is not a public nuisance and it is therefore not a liability to the community. The one-year extension requested will not impact negatively on the community. But for the fact that traffic is not seen on the property, one would not know that it remains unoccupied. I respectfully request that you grant a one (1) year extension to allow me time to complete all city requirements for occupancy of the above referenced property.
