STAFF REPORT
The Planning Manager recommends approval of this request subject to the property owner
meeting all applicable city codes.
Total Restoration Company is applying for a specific use permit to allow a building
construction/general contractor business at 10295 Eastex Freeway. This property is the former
location of Girls' Haven,
Total Restoration Company repairs/restores buildings and structures damaged by water or fire.
The subject property will be the location of the company's Beaumont District Office.
The applicant states that no contractor equipment will be parked or scattered around the
property. The type of materials the company uses for repair will be stored in a proposed 7,000
sq. ft. warehouse behind the existing structure.
In addition to Total Restoration's office and warehouse, a 12,150 sq. ft. commercial building
and 7 units of multiple family dwellings are proposed. Another area in the northeast comer of
the property in also designated for future commercial use. Commercial and multiple family are
permitted by right in a GC -MD District.
When the business owner originally came to the City to get building permits, it was to install
a new roof and to do interior work. The building was not to be occupied until a Certificate of
Occupancy was issued. However, a parking lot was installed and an owner identification sign
was constructed without any permits. The Fire Marshall states that a fire hydrant needs to be
installed because the property does not have adequate fire protection. Therefore, staff is
recommending that the approval of this specific use permit be approved conditioned upon the
business owner complying with all applicable city codes. Failure to do so could be reason for
revocation of the specific use permit.

In 1998, City Council approved a specific use permit to allow a wholesale durable goods
business on the property immediately to the south of the subject. That business never
materialized. In 2001, City Council approved a specific use permit to allow a climate
controlled storage facility on the that same property.

Attached are our application & forms for aSpecific Use Permit for the subject property together with the
application fee of $350,00.
The proposed use of the former Girl's Heaven building (10205 Eashx Fnoo*my) is for the Total
Restoration Company's Beaumont Oktdd Offioe, Total Restoration repairs/restores buildings and/or
structures damaged bywater orfire. Their business activities fall within general contractors requirements
necessitating the specific use permit request,
The Total Restoration business for building repair does not uU|i|ize maheda|m, supplies and equipment
usually associated with general contractors. No contractor equipment will be parked or scattered around
the property and the type Vfmaterials they use for repair will be stored inthe proposed warehouse behind
the existing building. The equipment parked on the premise will be trucks and vans consistent with their
business.
We will like to appear before the Planning & Zoning Commission on February 19, 2003.

EIGHT CONDITIOINS FOR THE SPECIFIC USE PERMIT
1. Use of the property is consistence with the use designated for the existing zoning — GC -MD. The
type of business for the existing structure (Former Girl's Haven) will not diminish or impair
property values within the vicinity. Planned development will increase values,
2. The establishment of the specific use will not impede the normal and orderly development but will
enhance the surrounding property developments.
3. All utilities are either existing and/or approval has been received to connect utilities to all existing
and proposed structures. Access to Old Voth Road and Eastex Freeway presently exist.
Adequate drainage will be designed and constructed.
4. TxDot approval for two driveways to Eastex Freeway frontage road has been received. Access
road to Old Voth will replace the existing dirt drive. Parking for all buildings will meet City of
Beaumont codes.
5. The development of the facilities shown on the site plan will not create odors, fumes, dust, noise
or vibrations,
6. No directional lighting will be provided and lighting will not affect the neighboring properties.
7. Sufficient landscaping and wooden screening fences between commercial and multi -family uses
will be installed. Landscaping shall be consistent with City of Beaumont Codes.
8. The proposed site plan is in accordance with the area zoning and comprehensive plan.
