SUBJECT: Consider a request for the abandonment of an un-named 60' x 3 14.54' portion of street
right-of-way.

The Planning Manager recommends approval of this request.
Douglas Barlow and John Binks, the owners of the property on either side of the right-of-way,
are requesting the abandonment of a 60'x 314.54'portion of an tin -named street right-of-way.
In September, 2000, the City Council voted to approve a zone change to RM-H for a 7.369 acre
tract of land west of N. Major Drive. Mr. Barlow and Mr. Binks have the property under
contract for sale to an apartment developer. This right-of-way was never developed.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
Being the most northerly 60'x 314.54'portioti of an un-named street right-of-way as recorded
in Vol. 1226, Page 101 of the Deed Records of Jefferson County, beginning at the south
property line of Lot 3, Rutledge Homestead Tract and terminating at the north property line of
Lot 4, of said Rutledge Homestead Tract, City of Beaumont, Jefferson County, Texas,
containing 0.433 acres, more or less.

Dear Sirs:
As owners of the property described in the attached application, we are requesting that
this Right -Of -Way be abandoned. The reason for this request is that we are currently
marketing this property and most serious inquiries have been for the construction of high
density apartment construction because of its ideal location for that purpose. We have a
potential purchaser who requires this particular change for that purpose.
